Are Courts Pioneering Women’s Liberation?

October 8, 2022

I'm not particularly a feminist, but if you get women off the animal cycle of reproduction and give them some say in how many children they'll have, immediately the floor will rise.” Christopher Hitchens (1949-2011), British-American author and journalist who wrote or edited over 30 books.

Time was when women liberationists took to streets or stage to advocate and advance their demands which included equality of treatment compared to their male counterparts. That phase seems to be out now. The next phase was lobbying law-makers to pass legislation and rules to match the rights enjoyed by males. Governments and legislatures have been dragging their feet on this front. Now the judiciary has been stepping into this void and coming with judgments which might compel legislatures, specially parliament , to come up with laws that bridge the gap between men and women in this critical area. The latest Supreme Court judgment in this area was delivered recently and was widely covered and commented on as in the following report in The Hindu and excerpted below.

Supreme Court ruling on abortion comes as a ‘ray of hope’, say activists

The judgment is hailed as progressive as it entitles all women a right to safe and legal abortion along with an emphasis on their right to bodily autonomy without authorization from third party.

The historic judgment of the Supreme Court Bench led by Justice D Y Chandrachud that unmarried women in a consensual relationship are also entitled to safe and legal abortion along with its strong emphasis on women’s right to bodily autonomy without the need for authorisation from a third-party to access abortion was welcomed as “progressive” and a “ray of hope” at a time sexual and reproductive rights have come under threat globally.

“This ruling interprets the provisions of the Medical Termination of Pregnancy Act, 1971 in a progressive manner and questions the unreasonable classification made by this law. This interpretation is the law of the land and will ensure that single women seeking abortion beyond 20 weeks cannot be refused on the grounds of the narrowness of the law,” said Anubha Rastogi, independent lawyer and campaign advisory group member, Pratigya Campaign.

The SC judgment followed a petition seeking inclusion of unmarried women within the ambit of Rule 3 B of the Medical Termination of Pregnancy Rules 2003 amended in October 2021 for abortion between 20-24 weeks of gestation period. The rule defines seven different categories of women who could access abortion within this gestation period, including survivors of sexual assault or rape or incest, minors and women with change of marital status during an ongoing pregnancy. Such women have to obtain permission from two doctors, who have to be of the opinion that the continuance of the pregnancy could either risk the life of the woman, or the child. For an abortion up to 20 weeks, permission from one doctor is sufficient.

Activists and advocates often rue that the right to abortion is not an absolute one in India, but conditional, and women have no agency as they have to seek the permission of a medical practitioner. The SC on Thursday (29/9/22) recognised this gap, calling it a “provider-centric” law, and asserted that reproductive autonomy “requires that every pregnant woman has the intrinsic right to choose to undergo or not to undergo abortion without any consent or authorisation from a third party”.

The court also liberally interpreted Section 3 B and said a variety of changes in “material circumstances” could be grounds for seeking abortion between 20-24 weeks such as when “a woman loses her job or if domestic violence is perpetrated against her or if she suddenly has dependents to support” or when she is “diagnosed with an acute or chronic or life-threatening disease which impacts her decision on whether to carry the pregnancy to term.”

“At a time when sexual and reproductive health and rights are under threat globally, this progressive judgment stands out as a ray of hope,” said V.S. Chandrashekar, campaign advisory group member, Pratigya Campaign.

“We hope that this judgment could be a step towards making our abortion regime more liberal and pro-women. The law must recognise abortion as a woman’s choice, as is the practice in over 70 countries,” Poonam Muttreja, the Executive Director of Population Foundation of India, said. “We need to ensure our laws don’t reflect any moral judgment on women who choose to abort.”

The Population Foundation of India also recommends increasing the gestation period for all women as medical technology advancements have shown that abortion beyond 20 weeks is safe and certain foetal abnormalities can only be detected after 20 weeks.

India’s first Cardinal, the late Cardinal Valerian Gracias, had the habit of peppering his sermons and speeches with anecdotes. Here is one he frequently used for different times/audiences.

Even as late as post-Second World War, women had no voting rights in England.

So, every Sunday evening they would demonstrate in London’s public grounds and gardens.

A very common slogan was “We shall not be dictated by men”. On the following Mondays, they would attend their offices and the first thing they would do was to go to the cabins of their bosses, with pencil and note-book in hand, to take down in short-hand the letters to be typed on the day and the following days.

...Contd, missed out is their (elite and communist chinese ) more liberal live-in relationships, for moral corruption and more liberlism. But Divine Laws, warning, Divine Judgements are clear in a message to John Leary dated Tuesday, June 30, 2015: “My people, in the first reading you are reading of how My angels were leading Lot and his family out of Sodom before it was destroyed by fire. The angels warned them not to look back at this destruction, but Lot’s wife looked back, and she was changed into a pillar of salt. In America and many countries, you are seeing the many sins of abortion, same sex marriage, fornication, adultery, masturbation, and prostitution. The stench of your sins, and the angels of the aborted children are rising to heaven as a witness against your people. At the end of the Antichrist’s reign during the tribulation, you will again see the fire of My justice fall upon the earth in My Comet of Chastisement. I will raise My people up so they are not killed by the comet. Then I will recreate the earth, and I will bring My faithful down into My Era of Peace as a reward for their obedience to My laws. Be prepared to suffer the coming Christian persecution, as My angels will protect My people at My refuges.”

Liberation or Slavery ? Following on why... Are we supporting murder in the name of freedom in the first place as new life begins at conception ? Animating the Body the Soul given by God at conception, body the box (which originally designed by God) comes from parents. This murder of innocents planned or started by socialist russian or then USSR around 1920 for Control, Divide and Rule. Same ideology they have pushed first in the west and now seems spreading worldwide in the name of liberalism which is a modern name for communism. One step further to it is, same sex marriages and one more recent their no gender policy or ideology where young kids are being brainwashed by western elite liberalists. This evil trend is being taught in western kindergartens, schools, colleges and other educational institutions; Little ones are being indoctrinated, making them believe that neither sex nor gender exist; that you can be male or female at the same time and they are telling girls and young women the same. Confusing and traumatizing kids and young. Some have undergone sex change surgeries as well. All for breaking of Families, by bringing in 'Modern Thinking', Society, Nations for ruthless communist control worldwide by much depopulation or population control for better dictatorship or state control as in Communist China, Socialist Russia, North Korea and Venezuela. ////// Further to this 'their' viruses, sterilizing most of humanity by vaccines in the name pandemic or virus strains and global warming or climate change which they again blame on population but use weather modifying HAARP machine or technology. Also wars again depopulation, destructions for economy losses and for creating artificial shortages including food or famine and creating hunger for state control. /////// So this abortion and all above depopulating technics and some more like nano tech gene edited transhumanisation are related and to bring liberalism worldwide for total surveiled with Artificial Intelligence using much advanced smart camera including mobile technology for communist one world godless religion and government control, through their infiltration in worldwide governments and religions. Which they call it as the great Reset or UN Agenda 21 and Agenda 2030 in the name of sustainable world development or 4th Industrial Revolution. So modern technological communist slavery started with Abortion. One needs foresightedness to see this or happenning front of our eyes worldwide. (And world economic forum leading from front on this and most liberal young world leaders in many nations controlled by World Economic Forum or WEF, Globalist Elite and Communist China)
