Udupi, Nov 5: The parishioners and other locals of Shirva church submitted an appeal to the sub-inspector of Shirva police station urging him to intensify the investigation and also warned that more vigorous protests will be held in future if no proper action is taken on their petition.

The petition mainly says that immediately after the death of Fr Mahesh D'Souza, the church bells were not rung and the community was not informed. This should have been done as per the rules of the Christian community. The parishioners came to know about the death through social media.

When the parishioners went to the church after hearing the suicide news of Fr Mahesh D'Souza, they were  told that the body was shifted to KMC morgue. When the parishioners checked the parish priest was not available at the premises, says the petition. 

Once a priest is ordained, he becomes the member of the church and his family will not have any right on him. But surprisingly so far neither the parish priest, nor the bishop of the diocese have filed a complaint requesting the investigation in the death of Fr Mahesh, adds the petition. 

When questioned by the parishioners, the bishop of the diocese negated of filing a complaint and the parish priest was silent on the subject. Because of this people, irrespective of religion and caste took out the silent protest, the petition says. 

BJP district president Mattar Ranthankar Hegde also joined the protest along with Carlod Castelino, Dolphy Castelino and Sunil Cabral who led the protest.

People from all communities joined the protest. 

SDPI and some overseas asociations like USWAS Dubai and SWAK Kuwait also rendered support, informed the protesters.

Udupi, Nov 5: Protesters demanding probe into the death of Fr Mahesh D’Souza began their march towards Shirva police station on Tuesday, November 5. 

Around 500 protesters gathered at Shirva Church in the morning and began their march. 

Many shops closed shutters when the procession went through the town. 

The protesters will submit a petition at the police station. 

Similar protests were held on November 2 and 3 also in the church premises.

    Whether it is antiquated or not, one has to follow the proper procedure laid down in CrPC, which is the law of land??

    I would urge you to read IPS officer turned lawyer's two books by this upright officer, and open your closed mind!!

    This might be clear case of sui.. But according to the 306 section of the Indian Penal Code, a person abetting the suicide of another person shall be punished with imprisonment up to 10 years and shall also be liable to fine.

    Let the law take its course now.
    You have done your part very effectively and forcefully. Petition is submitted.
    Allow the 60 days time and investigation to proceed.
    Stop spreading all Gossip and rumours. Already the name of three youths is maligned. Daijiworld has highlighted this sad story.
    If unnecessary pressure (public or political) is mounted in such cases, there are chances of innocent persons being framed to close the case.
    Truth takes time but "Will" and "Has" to Prevail.

    out that 100 from Non community
    about 80 from shirva parish
    others from neighboring parish

    Under Indian law, no FIR is necessary UNLESS the post-mortem reveals that the death was not a suicide. Post-mortem reports can take two months and more to arrive.

    Even if the police go for an FIR, the court of law finds no use for it. It is an exercise that serves no legal purpose.

    Furthermore, where FIR serves some purpose, there is no time limit to lodge an FIR.

    So...

    ... an absence of an FIR in the current case is a perfectly normal process.

    But people just want to create conspiracy theories!

    Inquest Report under Section 174 CrPC
    For the purpose of the unnatural deaths, the executive magistrate upon the intimation by the Station House Officer or some other Police Officer specially empowered by the State Government, shall prepare an inquest report which shall contain the minute details regarding the cause of death of a person. Inquest report is prepared by District Magistrate, Additional District Magistrate, Sub-divisional Magistrate, or Mandal Executive Magistrate especially empowered in this behalf by the State Government[1] when the deaths are sudden and unexplained.

    The deaths that the Section 174 talks about are:

    Suicide,
    Murder,
    Animal attack,
    Death by machinery,
    Or death under circumstances raising reasonable suspicion that some other person has committed an offense.

    The matter is handled by the Superintendent of police of the district, the highest ranking police officer in that district.

    At this level, the officers are well-versed in law.

    They do not need to copy-paste something from the Internet, just to continue with the conspiracy theories.

    A Superintendent of police of the district would know the proper process to follow. Needless to say, she is perfectly following it.

    If law enforcers know law so well, why lawyers are required; so many so called criminals get acquitted after arguments by legal experts!

    Does it really matter how many and their whereabouts? Parishioners are asking for justice to their most respected priest.. If the church leaders convince or take some initiative in this investigation would help or solve many unanswered questions.. sometimes the truth will never come out of most persuasive influential society.. however, every one has their own opinion.. prayer can do many miracles.     Dead body of Fr.Mahesh took to KMC without any consent!

    This is such a horrifying incident...Are we obeying the Church Rules?

    The matter has been in the hands of the civic law & order (i.e. police) from day one.

    In fact the highest police official of the district has been personally handling the matter.

    This means that the church administration has ZERO role to play in the matter - once the police take it over.

    So, a protest by the people is meaningless.

    Let’s not divert the topic between private and personal..questions raised here are about law and order, investigations according to IPC and police departments due diligence. Also parishioners are questions church authority competency.
