Centre opposes triple talaq, polygamy among Muslims in SC


New Delhi, Oct 7 (PTI): For the first time in India's constitutional history, the Centre today opposed in the Supreme Court the practice of triple talaq, 'nikah halala' and polygamy among Muslims and favoured a relook on grounds like gender equality and secularism.

The Ministry of Law and Justice, in its affidavit, referred to constitutional principles like gender equality, secularism, international covenants, religious practices and marital law prevalent in various Islamic countries to drive home the point that the practice of triple talaq and polygamy needed to be adjudicated upon afresh by the apex court.

"It is submitted that the issue of validity of triple talaq, nikah halala and polygamy needs to be considered in the light of principles of gender justice and the overriding principle of non-discrimination, dignity and equality," the affidavit filed by Mukulita Vijayawargiya, Additional Secretary in the Ministry, said.

Responding to a batch of petitions including the one filed by Shayaro Bano challenging the validity of such practices among Muslims, the Centre first dealt with the right of gender equality under the Constitution.

"The fundamental question for determination by this court is whether, in a secular democracy, religion can be a reason to deny equal status and dignity available to women under the Constitution of India," it said.

Referring to constitutional principles, it said that "any practice by which women are left 'socially, financially or emotionally vulnerable' or subject to the whims and caprice of men-folk is incompatible with the letter and spirit of Article 14 and 15 (Right to Equality) of the Constitution".

Linking the issue with the Right to Life and Personal Liberty, the Centre in its 29-page affidavit said "gender equality and the dignity of the women are non-negotiable, overarching constitutional value and can brook no compromise.

"These Rights are necessary in letter and in spirit not only to realise the aspirations of every individual woman who is an equal citizen of this country but also for the larger well-being of the society and progress of the nation, one half of which is made up by women".

    Marriage in Islam is a sign of God’s power and glory. The Qur’ãn says:“From His signs is that He has created for you spouses from yourselves so that you may get peace [and tranquility] through them and He placed between you love and mercy.In these are signs for the people who reflect.” (Ch ar-Room, 30:21)
    Islam did not invent the system of polygamy. It existed long before Islam came into the scene of world events.The Bible says that Lamech, the grandson of Adam, “took unto him two wives: the name of the one was Adah, and the name of the other Zillah.”3
    So polygamy has existed from the earliest days of human history.

    And so let it be known that Islam did not initiate the system of polygamy it existed from the early dawn of human history. When Islam came on world scene in the seventh century of the Common Era, it inherited the existing marriage system. Condoning of polygamy should not be seen as a piece of pure male chauvinism.

    It is to the credit of Islam that it modified and reformed the system in existence at the time.

    Firstly, of all, Islam put a limit to the numbers of wives that a person can have at one time — maximum of four wives at one time.

    Secondly, Islam put stringent conditions on a person who wanted to marry a second wife. He must be able to provide and maintain the family, and also deal with both on basis of justice and fairness. In Chapter 4 (Surah an-Nisaa), verse 3, after allowing the Muslim men to marry two, three or four wives, the Qur’ãn immediately says:“but if you fear that you will not do justice (between them), then (marry) only one” (Ch an-Nisaa, 4:3)
    Looking at the psychology of humans, only exceptional people have that quality of justice and fairness. The same Ch 4,verse 129, says:“And you do not have the ability to do justice between the wives,even though you may wish (to do so)…”(Ch an-Nisaa, 4:129)

    To be honest the Triple Talaq is almost a non issue and activists are trying to make it a centerpiece of Muslim gender issues and turning a mole hill into a mountain. There are more pressing issue confronting Muslim woman, most of whom live in abysmal conditions of poverty and destitution. It is this appealing condition that needs an urgent focus. Newspapers and media are blaring day in and day out the plight of these women. But his does not in any way detract from the gravity of the issue of Talaq that has now become a rage in feminist circles.

    All too often, Muslim women are used as pawns to justify Western imperialism, colonialism, and militarism. Rape, sexual harassment, and violence against women are not isolated to a particular faith, but instead, exist in every country, religion, and community that is patriarchal.
    It is interesting to examine the context under which a little known lawyer practicing in the Supreme Court, Balaji Srinivasan, who has no claims to be an expert on Muslim family law struck upon this strategy.
    Empowering women should be as much a man's responsibility, as it is a woman's aspiration. Interestingly, some of the most influential Islamic feminist thinkers are men.
    O People, it is true that you have certain rights over your women, but they also have rights over you. Remember that you have taken them as your wives only under God’s trust and with His permission. If they abide by your right then to them belongs the right to be fed and clothed in kindness. Treat your women well and be kind to them, for they are your partners and committed helpers.

    IN ISLAM IT HAS 3 MONTHS TIME. FIRST U NEED TO SIT AND TALK. SECONDLY KEEP ARBITR ONE FROM HUSBAND AND NEXT FROM WIFE. STILL IF IT DOESENT SOLVE. U CAN BE SEPERATED AFTER 3 MONTHS.

    BUT LATER MAY BE AFTER 6 MONTHS.IF U FEEL U DONE WRONG. AND U WANT UR WIFE BACK. U CAN RE MARRIAGE HER WITH NEW MAHR. IF U AGAIN FEEL TO BE SEPARTED. U CAN SAME PROCEDUCURE. AND U CAN REMARRY. ONLY 3 TIMES IS ALLOWED. AFTER THAT U CANNOT RE MARRY HER.

    Yes unequal laws...Similar to in Islam it is women who request dowry not men...
    Do Men and women play international football or cricket together...why is it if they are equal...
