Government tables triple talaq bill in Rajya Sabha amid uproar


New Delhi, Jan 3 (IANS): The government on Wednesday tabled the triple talaq bill in the Rajya Sabha amid uproar, with the Congress and other opposition parties demanding that it be reffered to a parliamentary panel for detailed consideration.

As Law Minister Ravi Shankar Prasad tabled the Muslim Women (Protection of Rights on Marriage) Bill, 2017 that seeks to criminalise instant divorce by uttering talaq thrice, Congress leader Anand Sharma moved a notice stating that the legislation be referred to a select committee.

The Minister objected saying the Congress was stalling the bill and not understanding the urgency to enact the law that criminalises the practice of instant triple talaq and imposes a jail term of up to three years on the guilty husband. The bill has been cleared by the Lok Sabha.

Prasad said "the practice continues" even after the triple talaq bill was passed in the Lok Sabha and cited an alleged case of a woman in Moradabad who was divorced instantly over dowry.

Sharma argued the bill had shortcomings and needed to be referred to a panel to clear them.

"The rule is very clear. If the member in charge moves the bill, it will be taken into consideration. I move the following motion that this House being strongly committed to women's rights wants to refer the bill to (a) Select Committee," said Sharma, also a member of the Business Advisory Committee.

Finance Minister Arun Jaitley, who is also the Leader of the House, mounted a strong defence of the government saying the bill had already been circulated two to three days in advance.

"Notice for consideration of an amendment has to be given at least one day ahead. This motion was not given one day before," Jaitley said.

    This is a hasty bill, not well thought out and, of course, not well-drafted.
    If passed into a law, prescribes a punishment of a fine and imprisonment up to three years for the husband. It is also cognisable and non-bailable.
    Let’s understand what cognisable means: policeman does not need a warrant to arrest the accused. It also means that the complaint can be made by not just the victim, in this case the wife, but by others too. In fact, any information against the husband can lead to an arrest.
    Care to think how it will be misused? Anyone with an axe to grind can get a Muslim man jailed. The way our courts are overburdened it may be a long time before justice prevails.
    The other provisions of the bill are subsistence allowance for the wife and dependent children and custody of children to the wife. How can a man who is in jail provide for his family or fight a custody battle for his children since no court will grant custody of children to a man in jail? A woman who sought to save her marriage by ensuring that instant triple talaq is illegal is not being served justice if her husband can be thrown into jail on a cognisable and non-bailable warrant. Just imagine her life. Imagine the life of her children. And to top it all she’s still married to him. Since the instant triple talaq has already been declared illegal she can’t even remarry after the iddat or waiting period.
    In a climate where Muslim men are already living in the fear of being lynched for being perceived as cow smugglers, eating or storing beef, for "love jihad" etc, one more law could be added to harass, jail and demonise them.
    What was the hurry? Why the community that this bill was aimed at consulted?
    How can uttering a string of words that have no legal standing be a crime at all?
    How can the state punish you for saying something that has been invalidated by the highest court of law?
    Saying 'talaq talaq talaq' is now legally no different in its effect from saying 'kabaddi kabaddi kabaddi'

    This law should be extended to inlude all religions who renounce their wives even without uttering talak.
