Judicial activism forces Karnataka BJP to clean up its image

Bengaluru, Jul 17 (IANS): Karnataka is witnessing a spate of positive developments, thanks to High Court judge Justice H.P. Sandesh who has exposed the "nexus" between the ruling government and bureaucracy.

"I am a farmer's son. I will go back to farming, I don't need to stick on to this job," he announced in the open court while lashing out at the ruling BJP and Karnataka Police Department for their inaction in major cases of corruption.

Justice Sandesh's observations forced the ruling BJP government which was mired in calculations of upcoming Assembly elections less than 10 months in the state to act.

The state witnessed arrest of on duty senior IPS officer ADGP Amrit Paul and on duty IAS officer, former Bengaluru Urban DC J. Manjunath. The arrest of an on duty IPS officer of the rank of ADGP was made for the first time in the history causing severe embarrassment to the state police department.

The authorities had turned a blind eye to the alleged involvement of top bureaucrats. Though, fingers and evidence pointed out the clear role of Amrit Paul in the Police Sub-Inspector (PSI) Recruitment Scandal, the state government had washed its hands off by transferring him.

The Criminal Investigation Department (CID), which is probing the scandal, did not seem to take action against the senior IPS officer. On the other hand, though the arrested accused stated that he had received a bribe on the instructions of the Deputy Commissioner of Bengaluru Urban district, the Anti-Corruption Bureau (ACB) officers were hesitant to name him in the FIR.

Justice Sandesh rapped the probing agency which resulted in first making DC Manjunath as the 4th accused and followed by his arrest. The two developments made the entire state take note of judicial activism. The common people, progressive thinkers hailed the bold statements of Justice Sandesh. Even ruling BJP leaders off the record expressed their agreement with what Justice Sandesh has remarked.

Dr B. P. Mahesh Chandra Guru, former Professor, Dean and activist, while talking to IANS stated that democracy is surviving in the country mainly because of judicial activism and accountability.

"It is due to the creative and active role of the judiciary, democracy is intact. Progressive thinkers and common people should join their hands with the judiciary to protect the constitution and democratic system," he reiterated.

"The activism of the judiciary has brought immense happiness. The statements of the Supreme Court Chief Justice N.V. Ramana and High Court Justice Sandesh have been made after careful consideration of existing situations and timely," he says. CJI Ramana observed that the judiciary is only answerable to the constitution.

Mahesh Chandra Guru states that since many years money and caste power are visibly dominating the political scenario. The public administration is at a crossroads, politicians are not accountable to the judiciary. "Ever since the double engine government has assumed power in the state and at the center, the public order is disturbed," he explained.

Justice Sandesh had in the open court stated that he is ready to be transferred. "I am ready for it for the good of people. I don't fear anyone. I am ready to bell the cat. I have not done any property after becoming a judge. I don't care if I lose the position of judge. I am the son of a farmer. I am ready to till the land. I don't belong to any political party. I don't adhere to any political ideology," he remarked in the open court.

"Are you protecting the public or the tainted? The black coat is not for the protection of the corrupt. The corruption has become a cancer and it should not reach the 4th stage. What should be done when the fence eats up the crop?" Justice Sandesh questioned.

Commenting on the Police Sub-Inspector Recruitment Scandal, Justice Sandesh stated that the crime is heinous than a murder and equated it to terrorism. "In case of a murder one person dies. Here, 50,000 candidates are put to difficulty. If every recruitment is made in the same fashion, do you want the court to sit quiet?

He further stated that PSI Recruitment Scandal is a terrorism unleashed on society. The society and common people are hailing judicial activism and extending their support. A Public Interest Litigation (PIL) has been submitted demanding probe on threat of transfer to Karnataka High Court sitting judge Sandesh and asking for security cover.

    People that take oath to serve the nation / people / public good must be of courage and must be trained in selfless service and 100% commitment to the Oath they take. There are many ways to make money if that is the intension and they must not take to the noble procession of civil services and work for the constitution of the country. It is true that continued association with criminals and politicians makes any honest serviceman/woman to be dishonest, but then they must have basic minimum conscience to heed to the higher call and to the Oath they have taken for fear of GOD or a higher power or at least Natural Law of cause and effect.... as KARMA follows through. It can be said that there is collateral damage, natural Law and Karma and natural calamities occur, be it floods, famine or other hygiene & healthcare issues. It is not natural when nature tries to warn man to mend his/her ways and man ignores and keeps at it to persecute the powerless human/animal/ creature unnecessarily and over powers beyond all sense and humanity... be it blaming the dead and stooping to old ways of blame game and winning elections. It is very heartening to see How the Election machinery is used and power has it that the state that rules reproduces a victory because adequate provisions are already made and ballot (EVM) are already in place to present a hat trick win ( presumed for another 42 years ( 50 years have been already ear marked) for safron rule. It is only in states that are non safron Bengal, Kerala, Telangana, Andhra, TN, Orissa, where safron is still not infiltrated into the administration and sanity prevails lest the current administrations there sleep off like did the lazy, corrupt congress that have ruined the country and let the brigade run riot and A great country like Hindustan / Bharat / India be mismanaged, ridiculed and questioned and summoned for every fanatic act that takes the land of sages and wise poets and inventors and noble men back by decades

    Thanks for Justice Ramana and Justice Sandesh for being honest and truly serving the nation with brave and courageous judgements. In the present central government tenure all the institutions are captured either by money power or muscle power(ED,CBI, EC and INCOME TAX). even the judiciary is effected as a few judges are lure by Rajya Sabha posts and so on. People are slowly loosing faith in judiciary system because of some vultures (bad judges). Kudos to you both Justice Ramana and Justice Sandesh for uplifting the morale of other judges in general. The nation loves you both and will remember you'll both for your guts and actions.

    Thank God for people like justice Sandesh and Ramana for standing up for justice and against corruption. Misrule by BJP has made a mess of everything in India like recent entrance exams for universities for the students. No apologies or re-examination for the students who missed their exams due to incompetence of government.

    Non Parliamentary words ! Even UK or US Senate never thought of banning or branding such words are non parliamentary because they are straightforward or allow things to function keeping the ethics of transparency and freedom expression in a accepted common language.     4 pillars of democracy .. Today all have failed .. An occasional star judge comes once in awhile .. Justice Sandesh .. rare breed .. soon to be extinct .. But the State salutes this judge .. All systems .. appointments .. cbi .. ED .. IAS ..all diluted after 2014 .. these are facts .. As Advaniji famously observed on the press during emergency ..You were asked to bend but you decided to crawl .. Today all crawling needlessly and allowing ruling dispensation to be emboldened..     Rupee value has gone to..... Against USD and all GCC currencies and World currencies and the brains and supporter of BJP give reasons as its not only Indiann rupee but so many world currencies are going through similar fate but Modi's brain would not admit that it's due to non performance of ruling party. Foreign Inveseters have divested and withdrew capital to the tune of 50 Billion Dollars and as such rupee value is going down or facing free fall. Now they are busy making a dictionary of non parliamentary words. English is a borrowed language and Indians are teaching the use of English. All nothing but authoritarian rule (this word too cannot be used in PARIAMENT)

    the worst ever corrupt rule of bjpigs has pushed even a sitting judge of high court to openly admit the atrocities in court during the proeedings..this is the first such instance in independent inida...if these dogale chaddis are not kicked out, the whole nation will be on the brink of civil war.

    I salute you Justice Sandesh for your brave effort to help clean the corrupt system. The country is in dire need of honest and upright officials like Justice Sandesh. We need people like T.N. Seshan, Julio Reberio and Justice Santosh Hegde. We don't need people like Narendra Modi or Rahul Gandhi.
