Give compensation to endosulfan victims in 3 months: SC to Kerala Govt

New Delhi, Jan 11 (PTI): The Supreme Court directed the Kerala government to disburse compensation and rehabilitation package for endosulfan pesticide victims in Kasaragod district of the state within three months.

A bench headed by Chief Justice J S Khehar ordered the state government to provide a compensation of Rs 5 lakh each to the next of kin of persons who died following exposure to the pesticide and those who became bed-ridden or mentally retarded.

The court passed the order on petition filed by CPIMs youth wing Democratic Youth Federation of India (DYFI) seeking country-wide ban on sale and production of endosulfan in its present form or any other derivative in the market.

DYFI had contended in its petition that a large section of people had been directly affected because of the use of endosulfan, already banned in 81 countries.

Endosulfan is an off-patent organochlorine insecticide and acaricide.

In 2011, the top court had banned the production, sale and use of the controversial pesticide in the country holding that human life is more important than anything else.

Thirty years after the Bhopal gas tragedy, as victims still battle for a fair and complete compensation, documents accessed by Down To Earth show that Union Carbide could have been made to pay a much larger compensation.

Toxic material remains in Bhopal, and in the decades since the disaster many of those who were exposed to the gas have given birth to mentally or physically disabled children. Indian officials estimate that up to 50,000 people were left permanently disabled as a result of the leak. Bhopal locals have been campaigning for decades to have the area properly cleaned, but Human Rights Groups say thousands of tons of hazardous waste are still buried there.

UCC and UCIL agree to pay $470m (£299m) to settle the initial fight for compensation in India's Supreme Court in 1989. As the survivors' legal representative, the government had asked for $3.3bn (£2.1bn).

BP has agreed to pay a record environmental fine of $18.7bn to settle legal actions brought by the US and several states over the fatal 2010 Gulf of Mexico oil spill.

But victims of UCC has only paid mere amount Rs25000 after years of legal battle.Does Supreme Court cares for the lives of Bhopal Gas tragedy?
