Won't tolerate sexism in name of custom: SC


New Delhi, Apr 19 (DHNS): The Supreme Court on Monday said it would not tolerate any gender discrimination in the name of religious custom and practices, as amicus curiae Raju Ramachandran submitted that restriction of a particular age group (women) to Sabarimala temple is a facile argument.

"The gender equality is a constitutional message and any ban on entry of women in the temple cannot be claimed as a right to manage religious affairs by its management," a three-judge bench presided over by Justice Dipak Misra said while hearing a challenge to the practice of banning entry of women between 10 to 50 years in Kerala's historic shrine.

The bench, also comprising Justices V Gopala Gowda and Kurian Joseph, reiterated that it would test the "so-called" customary practice under the provisions of the Constitution.

    For all people....

    Muslim Women can pray at Mosque...There's no restriction ...In Gulf countries you can see Muslim Woman go to Mosque and pray ..Hadith :
    Prophet said: "Do not prevent your women from going to the mosque, even though their houses are better for them." (Reported by Abu Dawud)

    Its only because of few 'paid' Mullahs, woman are restricted to enter Masjid in India..STill few Mosques allow ladies to enter

    Regarding 'Triple talaq' issue ...Again its because of few cut throat paid mullahs people are in dilemma !! 'Triple talaq' said at one go is considered to be of one count...Here's the hadith (Sunnah) for it

    Ibn ‘Abbaas (may Allaah be pleased with him) who said: At the time of the Messenger of Allaah (peace and blessings of Allaah be upon him), Abu Bakr and the first two years of ‘Umar’s caliphate, a threefold divorce was counted as one. - Muslim Hadith

    Its because of so many sects emerging in Islam, half knowledge mullahs are issuing fatwas on their own without referring to the originals (Quran and Sunnah) and people following it blindly ..

    Gender discrimination is there in all the religions and this society is male dominated society. All the religions put so many restrictions on women. I don't think supreme court can change this. Despite having strict ruling from the SC, still the SC/ST people are not allowed to enter the temple. So the customs will continue in India.

    Lydia Lobo, Hindus will welcome the court decision as they did earlier in many cases..Womens are worshipped as Goddess then there is no question of discrimination in Hinduism..but NGOs & court also totally misplacing the whole issue..its not gender bias or discrimination..INDIA has nearly a crore temples, only handful wont allow because of century old tradition which is well recorded..out of crores if 4-5 temple wont allow then how it can be discrimination!!..how many temple in around Manglore or on in Karnataka wont allow women? none..so exception are not examples..there are centuries of history behind some temples and searching logic in faith is just nonsense..look at one community which wont allow women in any where in INDIA or country!!..i remember few years back in manglore there was huge controversy when women try to pray at a prayer hall(i think in BAVUTA GUDDA)..did they allowed or are they continuing praying there..NO..Do you know SC hearing tripple talaq issue & trying amend personal law but almost all organisation up in arms against SC and SC also passing the buck to central Govt!!..its there in every community, secularism not confined to one religion..courts,law must apply to every one equally..

    If you feel its alright for just 4-5 temples not to allow women in, others don't feel so. You should either support the change or pretend to be an ostrich. Because, the matter has reached the courts, does not remain with a handful of dictators.

    A certain religion, in countries where such religion's government is running, does have palatial size of places of worship that accommodate men and women. But, they assemble segregated. Do check with some of those who are outside India. If such huge places of worship are to be built in India too, certainly they will make provision for women's prayer area - the matter is not at all a taboo in other parts of the world.

    ..Its not about alright, becoming ostrich or agitating against court..Hindus never opposed or agitated about any changes saying its heavenly rule...problem is its how some sections, NGOs, courts spread misconceptions or use words like gender bias or sexism..if its so, it should have been rampant every where..its not the case..some NGOs fighting against dress code..court will entertain it because God will not differentiate with dress..can you say it sexism..in GOA churches also introduced dress code, Golden temple has dress code..social media abuzz with SUSHMA,s head toe cover infront of KHOMENI..but men wont do it..is it sexism or tradition or countries culture !!..

    Dress code is for covering the entire body while in a place of worship. I say, a Salwar/Khameez covers maximum, compared to a Saree - what do you say ? Not only in Goa, all over the world, priests request church-goers to dress as per the sanctity of a place, not turn it into a fashion parade. Nobody is stopped from wearing pant/top, jeans/shirt, skirts (long enough, not a mini), besides Saree and Salwar Khameez.

    Good move by SC and expect more in many other political areas too.
    First constitution then religious laws but all these for better society.
    There may be similar scriptures in all other religions as below for Christians but one need to bring out and practice

    Totally agree with the courts. If the entry is really sacrilege, then let those women face the wrath of the Lord.
    True devotees will refrain from breaking away from the tradition. Let trupti desaees enter the temple.

    The change that is currently taking place is after demand from reference religion, not others. If at all you are sympathizing towards those in other religions who may be suffering from gender discrimination, let us work out on that too, but first lets deal with this matter. At the same time, do list out what kind of discrimination you see in other religions.

    Good that its religions factor alone that suppresses women to this extent. If it had happened in all fields, we would have had just mothers as a woman, would not have had a female PM, President, Scientists, astronaut, Administrators, pilots, Police personnel, Judges, Doctors, Nurses, Teachers and other roles played by women.

    If a temple can have female priests, why not women be allowed to enter certain temples is a question. If you have heard about 'Kanakana Kindi' in Udupi, the feeling is same for women as was for Kanaka Dasa.

    Purity/impurity, touchability/untouchability is all made by us humans. For a deity, all his/her devotees are alike, no higher nor lower. If I am not mistaken, Sabarimala Aiyappa is an incarnation of Shiva, who went to great lengths to favour his lower-caste devotees against the practices of Brahman priests.

    Cool.. Shankar... Cool... Women who are affected by the Triple Talaq are in the court, demanding to bring amendment in laws that pertains to them. Please be patient and support them in their fight - don't laugh at their cost.

    Curtailing human rights to Christian nuns ? Have you seen any nun in shackles ? What makes say they are deprived of human rights ? Common man, its like Sadhvis in Hindu who wear saffron, eat 'bhune channa' for meal, sleep on stone laid surface, renounce worldly pleasures.. Be glad that Christian nuns live decently in their convents, enjoy meals cooked in common kitchen, wear simple cotton clothes and pray at liberty. They involve in social work and helping the poor. They have excess to education, many of them are highly qualified and work in hospitals, schools. What is your complain ? What are they deprived of ?

    Triple Talaq is much better than single Talaq or divorce.Triple talaq is 3 stage of of Talaq will be completed only after 3rd and final divorce in between there is enough opportunity to come to term.Only male dominated society misused saying it once.There is evidence in hadis rule where prophet considered 3 talaq given at a time considered as single talaq and made couple to live together.Study Islam before judge
