Malali masjid row: HC directs Mangaluru court not to take out any order

Mangaluru, Jun 14: The high court directed civil court of the city not to take out any order with respect to the issue of temple like structure found in Malali mosque.

One member bench of Justice Sachin Shankar Magadam, which held an inquiry on the petition filed by Dhananjay, resident of Tenkalaipadi village of Mangaluru and Manoj Kumar, Badugalaipadi village.

The bench which heard the argument by the lawyer for the petitioners served notice to president of Malali town Juma masjid and postponed the inquiry to June 17.

Vivek Subbaredday, senior counsel for the petitioners said, “An inspection needs to be done about the temple like structure that is found in Malali mosque. The court should nominate a commissioner for the same. Hence, the civil court has to hold inquiry with regards to appointment of commissioner. In addition, the case is in civil court. The civil court said that it will decide on the validity of the case. But public pooja land act does not apply to archaeological structures.”

Petitioners Manoj and Dhananjay had approached civil court not to demolish the temple like structure at the disputed land belonging to Wakf. But the civil court is first inquiring on the legitimacy of the case. Hence, the petitioners had approached high court.
