Penalty of equal amount for receiving cash over Rs 3 lakh: Adhia


New Delhi, Feb 5 (PTI): In a bid to check generation of black money, a steep penalty awaits those accepting cash in excess of Rs 3 lakh, beginning April 1, to settle any transaction.

A ban on cash transaction of more than Rs 3 lakh has been proposed in the Budget for 2017-18.

In an interview to PTI, Revenue Secretary Hasmukh Adhia said the penalty for doing cash transaction will be steep and the receiver will have to pay an amount equivalent to the cash received.

"Supposing you do a transaction of Rs 4 lakh in cash, then the penalty would be Rs 4 lakh. If you do a transaction of Rs 50 lakh, penalty would be Rs 50 lakh," he said, adding that the penalty will be levied on the receiver.

So, if someone buys an expensive watch for cash, it is the shopkeeper who will have to pay the tax, he said, adding that the provision is to deter people from doing large cash transactions.

Demonetisation brought to account the stock of black money and now the government wants to stop future generation of the same.

The government, he said, will track all large cash transactions, and also curb the avenues of conspicuous consumption through cash.

People with large sum of unaccounted money usually spend it on holidaying or buying luxury items like cars, watches and jewellery. The new cash curbs will mean that such spending avenues are curtailed, disincentivising people from generating black money.

Adhia said that the previously notified rule of quoting PAN for any cash transaction above Rs 2 lakh stays.

Finance Minister Arun Jaitley had in his Budget for 2017-18 proposed to insert Section 269ST in the Income-Tax Act to state that "no person shall receive an amount of Rs 3 lakh or more by way of cash in aggregate from a person in a day; in respect of a single transaction; or in respect of transactions relating to one event or occasion from a person".

However, the restrictions will not apply to the government, any banking company, post office savings bank or co-operative bank.

Adhia said the Budget proposes to levy penalty on a person who receives Rs 3 lakh and above.

A panel of Chief Ministers headed by Andhra Pradesh Chief Minister Chandrababu Naidu had in its interim report just days before the Budget recommended a cap on cash transactions beyond a threshold and a tax on payments of over Rs 50,000 as a way of discouraging people from using physical currency.

    Something seriously wrong the policy makers ..i can give or take 2.99 every day .

    The policy should be ' All cash transactions above 10k will need to be reported or proper records maintained . go ahead and take 10 lakhs cash but have a proper record

    It seems BJP is digging its own grave!
    Draconian rules & penalties imposed on people & taking away people's freedom to have transactions in any mode is very dangerous move.
    First make sure digital mode is hack proof, should the system fail & all the money in that mode disappears in a second, will Finance Minister make good the loss? How to prove you have lost that much money unless one has proof in black & white for the same?
    It seems either the Government or Banks are on Slippery road of having their books in RED, hope one fine day government won't say all the money above a limit can't be withdrawn for a certain period as well.

    I have seen people getting raided by income tax officials. The raided people will be back to work next day morning. Raids were the sake of bribes. When they get it whole issue solved. Sad but true.

    JUST LIKE DEPOSITING EVERY DAY 1999 TO ANY PARTY FUND.ALL RULES ARE JUST TO GET CREDIT THAT THEY HAVE DONE SOMETHING GREAT. NO SUBSTANCE.AT LEAST THE PAN CARD NUMBER OF THE DONOR TO BE REGISTERED FOR EVERY DONATION TO ANY PARTY FUND .

    Intention of the government is to loot traders and make rich Banks, Paytm's and Government rich at the cost of traders. Why traders have to loose 2% to 5% (including service charge and service tax) on card and digital transactions ?

    Make all digital and card transactions charge free first not only for customers but also for traders.

    In our country, there is no social security like developed countries. Then why you are squeezing citizens by Excise, Customs, VAT, Income Tax, Service Tax and now these penalties of tax terrorism ? People are ready to pay through digital mode fully when you remove transaction charges. You can't loot and profit at the cost of citizens. Also, give social security through the tax collected from citizens. You have never passed on crude price decline to citizens. Who has benefited from that loot ?

    Agriculturists need not worry as it is a state subject. Deal in cash as you want or through co-operative societies. Because, government seldom comes to your rescue in case of difficulties like crop failure, drought or debt traps.
