Mangalore: Medical negligence case - Time for reality check in healthcare

Mangalore, Jul 9: Believe you me, I am one of those who believe doctors are human beings too and attribute no divine status to them. Doctors make mistakes too. That in Mangalore case of medical negligence, of leaving behind artery forceps in the pelvic area of an operated person, came to light on doctor’s day, was a mere coincident. Mangalore city surroundings, boasts of six medical colleges and students from across the country come here to get qualified in medicine. 


What happens when a city gets more medical colleges? Does it become healthy or does it diagnose itself with more sickness? With so many super-specialty hospitals with state of the art diagnostic and surgical equipment, generally one would expect a good medial care. Go to most of the hospitals you would be surrounded with students who bombard you with questions. And this is repeated in turn, perhaps giving you feeling - are they finding out what you are telling is the truth? Does patient care become a thing confined to hoardings and other advertorial material?

The woman in this case lived with the forceps for almost four years, as a result of which there was internal injury. She was operated and the “Deposit of negligence” was removed but not without resultant damage. The doctors who operated the woman for the second time briefed the media saying it was an accident defining “it can happen anytime with anyone.” A disgusting defence. Most of the cases of medical negligence slips out as there is no visible proof but in this case denial was almost impossible, as the shiny shape of scissors in radiograph made it impossible to deny the charge. 

That in court of law it is almost impossible to prove a case of medical negligence, reflects more about legal system than lacunae in medical profession. Where does one pin the responsibility of medical negligence? The consent you give before a surgical procedure seems to absolve themselves of any kind of malpractice and negligence. “Media blew it out of proportion” said one of the doctor reacting to the incident, further adding “media does not give publicity to the achievements of the doctors” - I beg to differ. There are numerous reports lauding the efforts of doctors to save a life, perform that rare surgery. Giving the patient the wrong dosage, giving the patient the wrong medication, leaving things inside the patient's body after surgery, are not common mistakes but playing with precious life.

Most of the medical consultants have teaching profession in the medical colleges. Their consulting hours are jam-packed with patients, perhaps depriving of each patient the due attention. With the terrible pressure on time management it is humanly not possible to give attention to one patient he deserves. Around two years back, I went to doctor for consultation and the clinic was closed with message on the door- If you don’t trust us don’t come to us. I later learned doctors were on strike that day. Of course, how can we afford to have doctors who go on strike, who are given the charge of patient care? Doctors of course can go on holidays but not on strike.

We always need good doctors to treat us well and we love them for giving their time and expertise to enable us to walk back again. That, as a society we are well fortified to withstand drawbacks in political, economic and legal arena. We can stand worst roads, bad drains, erratic electricity, or a life without gadgets or even a bad neta but how can we not have good doctors to whom we could go and say “Doctors, do whatever it takes but save my loved one’s life.” To whom can we plead our weakness when we are not healthy? To whom do we feel trusted and say “I give myself totally to you Doctor, do whatever with me but don’t send me back in a state worse than the one which I came in”. 

To be doctor is to be divine and discharge a sacred duty. “We run to your succor, Oh dear Doctor, heal me and heal thyself.”

If the institutions where they are employed pay their doctors well they need not go else where to earn.So kindly reserve your comments to yourself. You have no idea how much doctors are paid in India. The hospitals where they are employed pay the doctors peanuts and earn in crores.

    Mr Joe. Let us first decide that all capitation based admissions should be stopped. Only merit based admissions should be allowed.
    Doctors do not make money, they are only paid salaries. It is the institutions which make money. So, let institutions offer free service. The word charitable institution is a misnomer. It should be profitable institution.

    A DOCTOR : Mistakes can happen as human being (Human Errors).We can accept it, if a Small tiny operation tool was missed out into a human body during an operation then we can assume that because of the size its was mistakenly missed out, But.,leaving behind such a big tool as seen in the X-ray report,cannot be an error. It is definitely Negligence/Carelessness if not intentionally. This also shows a poor work practice,as., One should not rest the tool inside the working body while not in use., the Doctor should use a tool Holder or a Tray for the tools to keep back the tool/tools immediately after working or making use of the tool.

    Mr. Joe, that happens when you are paid well. Do you know the doctors renumeration in the United States. It is fifty times what a doctor is paid in india. Here these medical colleges and hospitals pay pittance. Instead of taking 2 good doctors and paying them we'll, they take 10 with the same budget and keep them underpaid and frustrated. This makes them to do some private work to make ends meet. Which doctor would not love to work in a single place and offer services to complete satisfaction, if they are paid well. This does not happen. The institutions make money from them as well as crores from students. Clinics rarely function we'll today as big hospitals with directors with no medical knowledge have taken over, just like walmart and are dictating terms to doctors. What value do they have?

    Mr Joe I don't think you should glorify American doctors. There are umpteen no of cases where operations have been done on the wrong side of the brain or wrong limbs have been amputated. What we need in India is a strong regulatory board which overlooks the functioning of hospitals and Nursing homes. There should be no compromise on pt safety, and safe surgical practices. I think today it is essential for every hospital in India to be NABH certified to avoid such mishaps.

    Thank Sir for your observation on my comments. I agree with you that mistakes are made by doctors all over. However what I wanted to emphasize is the fact that our doctors should spend sufficient time before and after the surgery with the patients and that patient care should have priority over any material gains.     Mr Joe you are missing the point . The entire regulatory system needs to be changed. No point in blaming doctors, nurses or hospitals . We have a sick regulatory system. Most of the medical schools are owned by politicians and liquor barons who are least bothered about quality.

    My brother prescribed TB medicine and he was taking one month, next we took him for check up he diagnosed no TB, this was a simple error by the Laboratory report been interchanged, after we realize that in this profession all are butchers beginning till end

    Anywhere we go to hospital we hear only about surgery. it has become such a common thing. doctors do their best to save life whether young or old. No one does mistake purposely. But the case of mangalore NH is unpardonable. thank god God has saved her till now. we come to know only the doctors who have done the surgery. Nice that the nurses who assisted and given the instruments and mops to the doctor have escaped. poor thing ,for the whole episode only doctor is blamed. I suggest take out the name of all those assisted the surgery and those who have given the injection. then all will take more responsibility hereafter atleast.

    doctors do surgery to save life. they alone cannot do but they require the help of assistance and nursing personnel. I wonder how can the nurse one who scrubbed for the surgery could get correct count when when one artery is missing. I presume the doctor ask the nurse to count the instruments and mops before closing the abdmen

    I agree with pradeep. patients are patients. They trust the whole staff of the hospital. Where can the 1 or 2 doctors reach when there are so many patients in the hospital. In some hospital there may be one or two doctor and 20-30 staffs. If staff too take real responsibility many of the problems can be avoided. major or minor surgery is a team work. all those who are in healing service take equal responsibility especially all those who do and assist in surgery.

    Giving the wrong injection, dose, wrong file, wrong lab report, damaging the eye etc. In the above cases the higher up will try to defend the staff saying it is our duty to defend our staff. But I do not approve it as bad staff will damage the reputation of the hospital which is built by dedicated staff and not just money, equipment or building, so don't defend just terminate cause they may end up doing same mistake to you.

    No doubt, leaving mops or artery behind is unpardonable. But surgery is a team work. Why it was not visible to anyone or one who took the count of the instruments and mops.If doctor is in stress others those who assist her in the surgery should have eyes and in case any doubt in taking count after surgery tell the doc before closing. even nurses should be very careful as they take the count.

    Apropos my comment to Daijiworld this morning I would like to add that it is medical etiquette in he modern world for a surgeon to ensure that he spends sufficient time with the patient duly advising him/her regarding the surgery the patient has to undergo.

    In the developed countries a surgeon assisting the person performing the surgery spends at least half an hour explaining to the patient regarding the surgery he has to undergo duly highlighting the need for surgery and details and the kind of prosthesis that needs to be applied. Thereafter the main surgeon performing the surgery spends at least another half an hour explaining the details of surgery and the need.

    The cost of prosthesis etc. are discussed well in advance with the guardian or the caretaker of the patient and never at the last moment. Again - just before the surgery a senor nurse spends quality time with the patient explaining further the details procedures etc.

    Most impotently the patient or guardian of the patient is provided with a chart duly detailing the post operative systems and carefully providing a schedule of POST-SURGERY appointments to ensue that the patient is well taken care of after the surgery. In he entire PATIENT-CARE process every one concerned instills confidence in a patient and does not leave him/her in doubt.

    ALL THIS MEANS AN EMPHASIS ON THE CARE OF THE PATIENT AND NOT ON THE REMUNERATION. IN OTHER WORDS THE EMPHASIS IS ON THE PATIENT AND NOT MONEY WHICH IS SECONDARY.

    It is my hope that these concepts are faithfully followed by THE NOBLE MEDICAL PROFESSION.

    What I understand according to the situation in Mangalore is there are too many doctors in Mangalore waiting to make their income any way. There are too many medical educational institutions in Mangalore which cater education to even unworthy students.
    The end result is all we know. What they would come out with.
    There is no quality but just quantity.

    but every profession should do the same ,unfortunately it does not happen
    In society if you tell that u r a Doctor , everyone charges you more
    After all Doctors are ed on their merit basis not on their moral obligation
    You people complain about the charges of the doctor, but Govt Charges Taxes on medicine, Instruments , Commercial charge for electricity and Water.No one speaks about that.

    Leaving an artery forceps inside after an operation is unpardonable crime. This only shows how careless the Doctors at Mangalore Nursing Home is.They must be brought under law and punished. Most nursing homes in Mangalore are not of state of teh art Hospitals

    Doctors all over the world are considered as LIFE SAVERS and there is a lot of dignity attached to this profession.

    If these doctors are busy - they should go through a study in TIME MANAGEMENT. Again A GOOD DOCTOR should consider his job as sacred. In my long experience with doctors, I have come across several of hem going all out to help the patients. I tend to think that the healing starts with the expression and encouragement of a good doctor. I have had occasions of meeting doctors not only in India but all over the world and particularly in U.S.A. and most of them focus on their patients - trying their best to ensure that the patients are restored to normal health.

    If a doctor is too busy or too occupied he might as well defer the surgery instead of putting a life in danger. ABOVE ALL - I REPEAT ABOVE A GOOD DOCTOR SHOULD BE SERVICE ORIENTED AND NOT MONEY ORIENTED.

    Let us hope that the future generation of doctors will try to make this world a HAPPY PLACE TO DWELL IN.

STEREOTYPE attempt in justification of blunder committed by a team of negligent medical professionals cannot be overlooked if there are 10 other blunders happening in the society. You might have heard that "TWO WRONGS CAN NOT MAKE A RIGHT"…As such, if 10 other different wrong things are happening in our society does not permit or give open permission to a bunch of negligent medical professionals to breach the trust & play with the life of an innocent patient and break the hopes of family members. It is very easy for us to write casual comments sitting on the luxurious sofa through a laptop like the fans sit in the air-conditioned gallery blowing whistle cheering the foul game played by their own team. But it is the life of a patient that was at risk and it cannot be brought back by just saying a “SORRY, it was a mistake!” It was a life threatening mistake and the entire team should be held accountable including the doctor who led that team but shamelessly trying to pass on the blame to team members instead of accepting moral responsibility…..

    Food for thought. Too many hospitals in Mangalore. Medicine and medical treatment has become ethic less business. Just lost 5 lakh and demands are more for further treatment without any improvement. The concept of "repeated lavish spending customers" has become "repeated lootable patient.

    sorry but i beg to differ.. no doubt its a huge mistake to leave a forceps behind after surgery but doctor isnt alone to blame for this.. ot is run by a team n doctor s only a part of it.. nobody leaves mops or forceps behind on purpose..
    N yeah reporting a rare surgery is no big deal.. when a doctor s accused of a negligence not even a single media highlights any of his previous achievements.. how many life he has saved previously, how many diseases he has cured none..
    N people in india can tolerate bad roads, a poorly built building, a bad neta, power cut for more then 24hrs, but they need a perfect, all life saving, ideal doctor who should serve perfectly irrespective of all odds they face in their life..
    why cant u fight for perfect engineers wen a bridge or building collapses.. why cant u fight for good netas wen u see potholes in every inch of our roads.. why cant u ask for perfect govt officials wen u spend hours or days or months in govt offices just to get one work done.. why this discrimination.. A doctor makes a genuine attempt to save a critically ill patient.. remember unlike machine humans arent created by humans.. v cant just repair humans.. v can only make an attempt to save a life.. v are not GODS for the n th time..

    With regard to other wrong doings listed by you, it reflects the result of our country’s faulty democratic systems & values. In our great country where anybody with power & money in the pocket can easily buy PENAL CODES and alter the law books to safeguard their own interest, what else can we expect here? Unfortunately, handful of illiterate politicians decides the destiny of 1.25 billion people that includes highly literate people like doctors, engineers, scientists, lawyers, judges, professors etc. We ourselves are to be blamed for today’s system failure. We helplessly watch that only 10,000 politicians (40% with hard core criminal background) are destroying the democratic values of the country by using our own democracy cleverly!! In our country, we make tea vendors, barbers, cobblers, dacoits, murderers, rapists, prostitutes netas overnight and we helplessly watch them growing so big that some day, they can also go on to become our Prime Ministers or Constitutional Heads in future and decide our destiny. However, there is no comparison of Medical profession to them coz this profession is UNIQUE!! When somebody falls sick, they cannot go to barber or cobbler or any of the above listed people for that matter seeking for cure. They only go to the “Doctor”!! Coz people trust a medical professional more than anybody else in this world though they fully aware that Doctor is not ALMIGHTY GOD. Poor innocent people are not only spending their life time savings in paying the costs, but also entrusting upon with their invaluable LIVES. Hence, there should not be any remote possibility also left for such negligence. When a medical professional start thinking negligence as silly as any other small mistake then I am sorry to say that such people are not genuinely DOCTORs at heart but only on PAPERs that has no more value than a tissue paper used in the toilet.
