Udupi: Son forces property transfer, throws elderly parents out of house

Udupi, Jun 29: Malpe police have registered a case following a complaint filed by a 69-year-old woman, Sarasu Suvarna, a resident of Badanidiyoor village, alleging that her younger son forcibly transferred her property into his name after assaulting and threatening her.

According to the complaint, Sarasu Suvarna was residing with her second son, Vinod Suvarna, in a house that was registered in her name. It is alleged that Vinod repeatedly demanded that the house be transferred to his name. When she refused, he allegedly assaulted both her and her husband, Dasu Thingalaya, and threatened them.

The complainant further alleged that Vinod forcibly took her to the sub-registrar's office and got the ownership of her 11 cents of land and the house transferred to his name against her will. He is also accused of threatening her not to disclose the incident to anyone.

Subsequently, Sarasu Suvarna approached the AC court seeking legal action. Upon learning about the court proceedings, Vinod allegedly forced Sarasu, her husband Dasu, and their daughter Vinutha out of the house.

Based on the complaint, Malpe police have registered a case. Further investigation is underway.

    Very sad and bad.One thing I cant understand is a grown up person should have make his own living and residence with family.Well here it is happened quite opposite.He still lived with parents(is ok)but later forcing them to make parents property in his name taking them to sign in front of judge?Is it allowed by forcing one to sign in front of judge?Doesnt he have the right to say nothing can be done with force? Only with free will?Noone can help the woman now to get her rights and house ,Property? Well he will get his reward soon when his children will show the same way.However where are parents now living on road?Such a son would noone have.Reward for upbringing.Mother should have put him long back out.Now she should fight for rights.Hope she will be successful and have her land and house.

    These type of incidents are very common nowadays; most children coerce the parents to transfer the entire property in their name when the parents are alive fearing that the property might be taken over by another sibling or relative close to the parents, or someone having legal right in the same! If the property is transferred via a gift deed without specific conditional clauses, it would be very difficult to get back the same! A classical such case, available in the public domain, is that of, late, Vijaypath Singhania! This is a warning bell to all parents to not transfer the property in anyone's name till they are alive or if very necessary then make a CONDITIONAL GIFT DEED!!

    I strongly condemn the son's actions. No child has the right to force elderly parents to transfer their property or throw them out of their own home. It is commendable that the parents approached the police and filed a case. If the property transfer was obtained through force the registration should be declared null and void and the parents should be restored to their rightful home. Justice must prevail.
