Anti-conversion ordinance becomes law in Karnataka as Governor gives assent


Bengaluru, May 17 (IANS): Karnataka Governor Thaawar Chand Gehlot on Tuesday gave his assent to the ordinance promulgated by the BJP government on the controversial Karnataka Protection of Right to Freedom of Religion Bill, 2021 popularly known as the anti-conversion bill.

The ordinance was sent to the Governor's approval by the ruling BJP after a recent cabinet decision.

With the Governor according to the permission for the proposed bill, the ruling BJP is all set to implement the bill which proposes stringent measures on religious conversion activities and may create a lot of chaos in the state.

The bill has been passed by the Assembly but is yet to be presented in the Legislative Council, where the ruling BJP is one seat short of majority. However, the top leaders have decided to put the bill into execution through an ordinance - which will have to be approved by both the houses within 6 months.

The Council elections are scheduled to be held on June 3 for seven seats. The BJP is likely to win 4 seats and attain full majority, and then passage of the bill would be easy, sources said.

The Karnataka government had tabled the controversial measure in the Assembly session in Suvarna Vidhana Soudha at Belagavi on December 21, 2021.

All legal entities, educational institutions, orphanages, old age homes, hospitals, religious missionaries, and NGOs are brought under the purview of institutions.

According to new law, any converted person, his parents, brother, sister or any other person who is related to him by blood, marriage, or adoption or in any form associated, or colleague may lodge a complaint of such conversion which contravenes the provisions. The offense is made to be non-bailable and cognizable offense.

The bill proposes a declaration before conversion of religion and also pre-report about conversion. A declaration post-conversion is also proposed. If any institution violates the act, the imprisonment of up to five years with a fine of Rs 25,000 is prescribed.

If the convertee is a minor and mass conversions take place, the imprisonment is extended up to 10 years.

The bill proposes protection of right to freedom of religion and prohibition of unlawful conversion from one religion to another by misrepresentation, force, undue influence, coercion, allurement, promise of marriage or by any fraudulent means and for the matters connected therewith or incidental thereto.

"No person shall convert or attempt to convert, either directly or otherwise, any other person from one religion to another by use or practice of force, undue influence, coercion, allurement or by any fraudulent means or by any other means or promise of marriage, nor shall any person abet or conspire such conversion," it says.

The act also underlines that, provided that if any person reconverts to his immediate previous religion, the same shall not be deemed to be a conversion under this act.

"Allurement" has been defined as including any gift, easy money or material benefit either in cash or kind, employment, free education in school or college run by any religious body, promise to marry or portraying practice, rituals and ceremonies or any integral part of a religion in a detrimental way vis-a-vis another religion, or glorifying one religion against the another religion, according to the bill.

The bill also proposes grant of appropriate compensation by the accused of up to Rs 5 lakh. If the accused repeats the offence, the bill proposes a jail term of not less than five years and a fine of Rs 2 lakh.

The anti conversion law is to deny marvelous Gospel of Jesus Christ to people of our country and to harass and imprison followers of Christ. The matter of fact is to stop kingdom of God Roman's killed Jesus but in his resurrection he conquered the world. Kingdom of God include peace and prosperity. Jesus said Iam the way truth and life.     All these politicians in their greed to remain in power and playing these dirty tricks to please their supporters. A day will come when these brainless supporters start suffering their masters will be no where to help them. Sooner it happens it will be better and before it is too late. At the behest of the bad elements that are hell bent to create trouble in the peaceful society this law will be a boon for them to take advantage of the situation. Only time will prove the out come and impending disasters that are to fall on the people. It is a wake up call to all those who fall prey for inter religious relationships.

    Yes the law is not against those who convert voluntarily. Today in the 21st century nobody is converting anybody by force or by promises of material or economic benefits. We are not scared of the law. The fear is about misuse or abuse of the law thru false allegations and filing false charges. There is no provision in the ordinance for those filing false cases, which should also be made a punishable offence.

    Worth of Hinduism?? The mere fact that all the religions have been flourishing In India, thanks to the inclusiveness nature of Hinduism. The first mosque in India was facilitated and built by a Hindu King. The current government will be replaced by new one and this law will be repealed or amended by the next government. But demeaning Hinduism is not called for Mr. Flavian. Moreover, the BJP government do not represent Hindus, not me at least!

    The Provision for compensation of 5 lakhs will be a lure for some people to hoist false allegations as the act will be cognizable offense without bail, the chances of it being misused are far greater than being any solace for the alleged victims turning the alleged perpetrators into real victims.

    The successor of Mother Theresa, Sr. Nirmala and her younger sister were Hindus. When their father, a military man, came to know that they were converting to Christianity, he came to the Ashram with a gun to shoot them. After seeing the activities of the Mother Theresa Ashram, what happened to him we do not know. He went back without harming his daughters. I have come across many Dalit men and women in Mumbai coming and requesting priests to convert them. Some Hindu girls wanted to marry Christian boys, since they were not getting any Hindu boy without dowry and ornaments. I have heard on TV, the leader of 18 crore tribals, saying that they are not Hindus, they believe only one God and on earth nature is their God. He said govt only helps them and calls them Hindus for vote purpose. Though, govt cannot help dalits from atrocities, it fears that they are easy preys for conversion.

    Only persons who can really tell if there is inducement are the dead ancestors. Alas they have been sidelined. This is nothing but an insult to the dead ancestors of those who want to convert. This bill also creates some serious doubts whether anybody can become a Lingayat? is this a self goal? Well this bill does not specify the immediate religion of the Hindus if they want to give up Hinduism.

Easter bombings were by govt. but blamed on Islamic fanatics according to the Bishop there, All the present agitations like Halal, Azan etc., too were banned there while the Rajapakshe family were enjoying 5 posts in govt. and were amassing wealth. But starvation brought them together & goons supporting ruling party attacked peaceful protester who were on protest from a month, which lead to all the violent push back & politicians are hiding & running away from people there.

    Thank you so much for your beautiful explanation. My question is when these buddhists ill treat hindus alongwith Christians and muslims, our govt. cannot see ? I have seen some what's app forwards where buddhists accuse missionaries. Why these people do not convert others ? Their population increased just like that ? Is it possible to our govt to accommodate all tamilians if they come back ? I feel, here too these people's agenda also the same....

    This law gives full right to others to interfere with a person’s right. This means anti social elements can decline person’s right to willful conversion. This is murder of democracy and anti constitutional law.
