'Waited for long', SC to decide punishment for Vijay Mallya in Januray 2022


New Delhi, Nov 30 (IANS): The Supreme Court on Tuesday said it has waited for sufficiently long, and the process to award punishment to Vijay Mallya in a contempt of court, in which he was held guilty in July 2017, must get over. The top court has scheduled the matter for disposal in January, where it will decide the quantum of punishment for him.

Solicitor General Tushar Mehta, representing the Centre, submitted a note by the Ministry of External Affairs for the court's consideration.

A bench headed by Justice U.U. Lalit, citing the note, said that Mallya's extradition proceedings have attained finality, as he has exhausted all avenues of appeal in the UK. However, certain confidential proceedings are going on and the UK has not disclosed the details of these proceedings. The top court noted that due to these proceedings Mallya's presence could not be secured, despite its directions.

The bench said the process to award sentence to Mallya in the contempt of court matter must get over, as the top court has waited sufficiently for long. The top court said it is up to Mallya to appear in person or advance arguments through his counsel, but the matter has to see the light as it is getting adjourned from 2017, when he was found guilty of contempt. Citing that only sentencing is pending for the last four years, the bench said: "Matter in terms of directions issued by this court in its 2017 order shall now be listed on 18 January 2022."

According to a judgment delivered on July 14, 2017, Mallya was found guilty of contempt for not paying Rs 9,000 crore worth of dues to the banks despite repeated directions. Additionally, he was also accused of not disclosing his assets and also secretly trying to dispose of the assets to defeat the purpose of recovery proceedings.

On October 6, last year, the Ministry of Home Affairs (MHA) has told the Supreme Court that the UK Home Office has intimated that there is a further legal issue which needs to be resolved before Vijay Mallya's extradition takes place and this issue is outside and apart from the extradition process having effect under the UK law. The affidavit had said that Vijay Mallya's surrender to India should, in principle, have been completed within 28 days after he lost the appeal against extradition. However, the UK Home Office intimated that there is further legal issue which needs to be resolved before Mallya's extradition takes place.

On November 2, the top court had asked the Centre to file a status report on extradition of the fugitive businessman within six weeks. On January 18, the Centre had informed the Supreme Court that Vijay Mallya's extradition has been raised at the highest political level, but the UK government has refused to share the details of the confidential proceedings delaying his extradition.

    Mallya had 4500 crores in debts but were doubled by add on interest rates. He had offered to pay all his debts with a rebate but he was denied that to help Modis who had runaway with many times more . Here in India Ramdev, Ambanis and Adani owe more than 1&half lakh crores to the banks which are reduced by big margin by the government thereby bankrupting our banks which had our money which they had lent to these defaulers without any securities. Indian banks have seized 13000 crores worth assets of Mallya and some were sold to recover their amount which means this case should be dismissed as no standing by the court.

    People, Private enterprises Create jobs for people and revenue for the State ( State and Central Governments). Look at China, till 1972, Chinese economy was slightly ahead of us, see now since last 50 years it is 5 times than ours....why? Because Private entrepreneurs are encouraged. India is not competitive in doing business....our infrastructure is weak....and production cost is not competitive than many Countries including China... that's why we cannot compete with China in Industry. We should stop criticizing businessmen and envy them ( Which has become habit to us since our Independence ) ....we should encourage them as long as they create jobs and pay taxes honestly... Be it Calendars, Battery Operated Vehicles, Aircrafts or any other products... I know most of you have cultivated envy towards rich and successful people....stop doing that...try to be successful yourself... and be a productive Citizens yourself... ...Tak...Takk...

    What punishment when he is physically not present in india. Is it BJP’s famous ‘Virtual Cyber Voice Vote’ punishment to fool people. SC should not skip steps to find out how he and so many other financial fugitives escaped from india so easily and with so much money with one way ticket?????…….Master criminals are here in sheep’s clothing and avatar who point fingers at others to shield their own grave crimes.     If Mallya has paid most of the crores he had defalcated, he deserves a clean chit, unlike Nirav Modi and others who left holding the Indian creditors an empty net and are in safe havens. If it is just a contempt of court, Mallya needs to employ furter counsel in India or sent from the UK to represent him and explain to the Court why he cannot appar in person - that he will be arrested as soon as he lands. He has been battered enough in the courts and for far too long.

    While not endorsing what MR MALLYA has done - HAs repaid many debts and many recoveries - company shares transferred etc - assets attached etc -- very close to overall debt/ default of nine thousand crores-- But overall has become poster boy for govt to show they are anti corruption - anti defaulters - Clean Govt --etc etc etc - BUT TRUTH/ reality is we are heading to TWENTY LAKH crores of defaults - npa's - wilful defaulters- FRAUDS -- by MARCH 2022 -- very many big names still enjoying in INDIA- Many Others outside - INDIA - CHOKSI etc --
