150-year-old Christian divorce law to be amended soon


New Delhi, Nov 13 (DNA) : Christian couples' wait for two years for seeking divorce by mutual consent may soon end as a nearly 150-year-old law is set to be amended to lower the requisite separation period to one year following persistent demand from the community. The government has put the Divorce (Amendment) Bill, 2016 in the 'tentative list of government legislative and financial business' expected to be taken up during the winter session of Parliament beginning November 16.

However, the proposal to amend the provisions dealing with Christian marriages is yet to be cleared by the Union Cabinet.

According to the Law Ministry proposal, the Divorce Act, 1869 would be amended to halve the separation period for couples from the present two years to one year before they can file for divorce by mutual consent to bring it at par with laws governing other communities.

The separation period under the Hindu Marriage Act, Parsi Marriage and Divorce Act and the Special Marriage Act is one year. Section 10A(1) of the Divorce Act, added through an amendment in 2001, says that a couple seeking divorce should be living separately for a period of "two years or more".

Against the backdrop of a Supreme Court order in April last and persistent demands by members of the community, the Law Ministry has decided to move the proposal to reduce the separation period. Questioning the existing law, the Supreme Court had urged the Centre to make necessary amendments. "Should Christians stay separated for minimum two years when the period prescribed for others is one year? It does not make sense to us. It is a pure question of law and you (government) should have acted on your own," a bench of Justices Vikramjit Sen and A M Sapre had observed.

The bench delivered the order on a petition filed by a Delhi resident. Some high courts have also struck down the provision of two-year separation. The ministry has also proposed another amendment in the law to enable any of the spouses living in India to file for divorce. As of now, both husband and wife should be living in India when the petition for dissolution of marriage is moved.

Also, if the law is amended, then it will allow a woman to move the divorce petition in the district court within whose jurisdiction she ordinarily resides. As per the existing provisions, a petition can be filed only where the marriage was solemnised or where the couple reside or last resided together.

The Law Commission had on several occasions in the past recommended amendments to the Divorce Act to make it more women-friendly.

    It's true what God has joined . . . But while marrying the couple has to give their consent freely without any reservation. In case the consent was not free, the marriage would be annulled. But before annulling the marriage, the couple has to get a divorce from the court as all the marriages are civilly registered. It is here that the Christian couples had to wait for an additional year.

    Thanks for Mr.Fedrick and Mr.ALex for educating me on this subject.
    Let me clarify myself that I have no intention of hurting anyone's religious feelings.

    In my opinion it is internal matter of Christians of India.
    Christian decoscene can solve this subject more easily with intervention of 'Vatican' and 'pope' advice.

    I strongly believe country's law minister,sitting judges,lawyers and Prime Minister who have no understanding in the book of God
    can solve this problem.

    Also I would emphasise on mending the two hearts rather encouraging the breaking.

    Irrespective of the religions, for a stable society, it is good for marriages to succeed. It will give a good environment for the growth of the children. I love the sight of elderly married couples going together. Never mind which religions they belong to, it's a joy to see the elderly people supporting each other.

    When a marriage is broken what is the worth of waiting for 2 years or 1 year ?.The law should be amended for a quicker dissolution of marriage to avoid physical and mental harassment to both the parties. With the way judiciary is working even 2 years may not be sufficient to dispose off the case. I have seen this in the case of one of my relative where the church annulled the marriage within a year on mutual consent. But court made them to wait for another 3 years.Imagine the pain the parents in both the families had to undergo although they had consented for separation

    What is required is validation of present canon laws which are already there . For example , christian marriage laws across globe age of marriage for girls and boys to be , 14 , 16 respectively . In today's time where fornication ( pre marital sex ) is at large and significant spoiler in marital harmony , such issues needs to be addressed. And with the above proposed amendment , case should be allowed to transfer into either of spouses place .

    Slowly but surely RSS guru's Hindu rashtra of treating other religions as second class citizen is materialising.

    Last year the government wanted to celebrate Dec 25 'Christmas day as 'Vajpayee birthday'. This year 'Santa claus' from RSS arrived too early with one more Christmas gift.

    There are many Christian brothers wrote against Muslim Sharia law without studying the UCC in detail.

    Now fanatic party wanted to rewrite 'Bible' on the Christian woman expenses.

    This ammendment has nothing to do with the Vatican or the Pope. This was a British law. It was the Christian couples who were fighting for the ammendment. Civilly, if all the procedures are followed, it makes no sense as to why a couple has to wait for 2 years just because they are Christians. This ammendment will help the Christian couples to get the annulment of their marriages quicker in the church.

    Whatever man or government does in marriage matters is purely civic, does not alter any spiritual law pertaining a person's soul, which will live forever to eternity without death as we believe.
    A man can separate from his wife for reasons that are not compatible for their joint living as guided his heart and conscience, but marrying another is committing adultery automatically, whether it is ceremonial marriage or secret marriage(fornication).
    Interestingly, a good old joke is a boy who robbed a cow, confessed to a priest that he robbed a rope, (logically cow with rope).
    God knows your heart, cheating whom will not get repentance.

    Centuries old rule also prescribes that women have right take khula which is annulment of marrage and in normal divorce in the same centuries old laws also grant her right for childrens custody , You would know this if you would go to a better school instead of shakha's

    This divorce law makes makes perfect sense compared to some other nonsense where divorces are thrown at faces for some petty reasons and the women ceases all her rights especially on children, for whatsoever reasons the divorce is thrown at her with their fate at the hands of male dominated century old rules.
