Excise policy case: Delhi HC dismisses Kejriwal's plea challenging ED arrest


New Delhi, Apr 9 (IANS): The Delhi High Court on Tuesday dismissed Chief Minister Arvind Kejriwal's petition challenging his arrest by the ED and the trial court order remanding him to the agency's custody.

Justice Swarana Kanta Sharma, who presided over the case noted the ED's submission that CM Kejriwal was in possession of enough material which had led them to arrest him.

"The files and material placed before us reveal that the mandate of law was followed by the ED. The trial court order is not a two line order. The statements with ED are of hawala dealers as well as AAP candidates in Goa elections," the court noted.

Last week, the ED had filed its counter-affidavit to CM Kejriwal's petition. Since his counsel Ramesh Gupta had submitted before Special Judge Kaveri Baweja of Rouse Avenue Court that CM Kejriwal has no objection to the custody/remand being extended further, it had said that the "petitioner (Kejriwal) has waived his right to question his custody as on today and the petitioner cannot now be allowed to argue that his custody as on today is illegal and present petition is liable to be dismissed on this ground alone."

The ED had submitted that the remand order dated March 22 and the subsequent remand orders dated March 28 and April 1 under challenge are detailed and well-reasoned orders as is evident on a bare reading of the said orders and hence "warrant no interference."

The agency had said that it complied with all procedural requirements of Section 19(1) and (2) of the PMLA as well as Article 22(1) and (2) of the Constitution of India during the arrest and remand of CM Kejriwal.

The agency had claimed that the AAP leader was the kingpin and key conspirator of the Delhi excise scam in collusion with ministers of the Delhi government, AAP leaders and other persons and that it has material in possession which demonstrates that he is guilty of the offence of money laundering.

The ED had also alleged that CM Kejriwal was directly involved in the formulation of the Excise Policy 2021-22, drafted "considering the favours to be granted to the South Group" and that he demanded kickbacks from the South Group in exchange for favours to them in the formulation and implementation of the Excise Policy 2021-22.

The Delhi High Court had, on March 27, refused any interim relief to CM Kejriwal, who was arrested by the ED on March 21 and is currently in judicial custody till April 15.

    Modiji and Amit Shah will taste their own medicine day they loose power....they are riding on a tiger....sooner or later tiger will put them down and eat them....this may not happen in 2024 ...but will happen for sure....In my opinion Kejiriwal should contest against Modiji from Varanasi from Jail like Late George Fernandes did in 1977 from Muzzafarpur....and make Modi tied up in Varanasi...he may loose but will make Modiji to run for his money...Tak...Takk....

    Arvind kejriwal is planning to make his wife CM so that he can have the affairs of government within himself. There must be something suspicious connected to kejriwals arrest , that is why the court refused him bail.Time will alone tell when proceedings start.

    I remember reading your article long ago in Daiji it was good, too many things to write about Kejriwal, he is No 1 Chameleon, he abused congress left and right all these yrs.he calls himself aam admi but does not respect judiciary system, he was summoned 9 times why didn't he clear matters kept sayiny" baad me gaya", 6 months back congress MLA was arrested by AAP On case SC had squashed ,he was arrested based on investigation by ED( that was ok for AAP? ), are you aware each and every provision was vetted by 3 Judge bench of the SC, remember in India is considered as heinous as Terrorism, 3 months ago SCsaid 7% excess of commision on liquor an amout of 338 crores earned by wholesale distributors is a crime, cmon don't be biased, respect the Supreme Court of this Country

    ..politics or not..opposition can not cry vendettaa..court itself not giving relief means there is substantial evidence with court..SC recently cancelled Congress era law where MLAs/MPs had some kind of immunity on corruption cases..i always maintained that Congress is far better than AAP for nation.. AAP is only mixture of evils of all indian political parties..

    ED has to produce the other party with whom Kejriwal did business for cross examination, business dealing and money trail. One person and his associates can not run this racket without having a party who deals with such transactions like one hand can not clap. There are always two parties in any business dealings. If there are none then what is the credibility of this case???????…..Its just an imaginary case without evidence and proof.

    ..well, if you have argued in Delhi court instead of Singhvi or Sibbal, Kajuwala could have got bail..Kejri did a mistake by ignoring summons..he was served 10 summons, every time he gave silly reasons..now courts also in a fix how can they give bail to this arrogant while nation watching..Dear, there is scam, money trail for sure..BRS/KRS leader is in custody not getting bail..just google, there are dozens of people linked to this are in jail since many months..why they are not getting bail till now..
