Karnataka crisis – The JD(S) rejects Congress offer to replace CM

Daijiworld Media Network - Bengaluru

Bengaluru, Jul 14: Amid the crisis triggered by the resignation of 16 Congress and JDS MLAs, Kumaraswamy in the assembly earlier on Friday said he would prove the majority of his government on the floor of the House and asked Speaker KR Ramesh Kumar to fix the time for it.

On the Supreme Court Friday restraining the Speaker from taking any decision on the resignation and disqualification of 10 MLAs till Tuesday, Yeddyurappa said it has come as a morale booster to the rebels who were 'satisfied' with the order. BJP on Friday decided to move its MLAs to a resort near here amid fears of poaching bid by the ruling Congress-JDS combine after CM announced he would seek a trust vote in the assembly despite the resignation by rebel legislators.

The HD Kumaraswamy-led Karnataka coalition, which came to power in May last year, is hanging on to power by the fingernails after 18 resignations since last week. The coalition's 118 members will come down to 100 and the majority mark will drop from 113 to 105. The BJP has 105 members and the support of the two Independents, which takes its tally to 107.

We have voted from our willingness to our preferred candidates during the Assembly elections to Karnataka.
We have not taken money to cast our free votes to our preferred candidates.
If the MLA's are enticed from opposition offering ministerial posts for money making business or with suit-cases of notes, he has broken the trust votes of da masses.
How was anti-defection law passed when the citizens gave free of cost votes to one's trusted candidates, then betraying our free vote then defecting for money.
Those defecting MLA's should be barred from contesting Assembly and Lok Sabha elections for 7 years.

According to former Lok Sabha Secretary General, PDT Acharya, the Speaker has the powers to conduct an inquiry into the reasons behind the resignations of one or more MLAs and take time to satisfy himself that no undue powers are at play.

He says that the reason for this level of scrutiny is that it is quite unlike a member resigning from a Cabinet. Resigning from an assembly means that your constituency will be unrepresented for some time and to check probably this very circumstance our constitution framers gave such powers to the speaker.
So, the speaker is not bound to accept the resignation.
In a scenario where the speaker rejects the resignation of a MLA, one could approach the courts and challenge the decision.
Since the constitution in Article 190, for Assembly, gives absolute discretion to the Speaker, the Speaker's opinion matters over everyone else's. Since the Speaker has the power to adjudicate on the matter, the court may only check if all procedures laid down in the constitution have been followed.
It is unlikely the court overturns the Speaker's decision.
If there is a floor test, the anti-defection law will kick in at this point, and dis-qualification of a MLA is the predictable outcome if they go against the Whip.
    Athi ase, gathi kedu!
Of course, BJP can pay them every month as they would have come to power, at least for a few months until election are held to fill the vacancy. Voters are fooled by political parties, no matter which party.

Karnataka people need to learn from neighbouring state like maharastra, andra, Gujarat, Telangana in electing their govt.
There is no threat to govt till it complete 5 year and can focus on development.

In karnataka since more than decade (After SMK) people almost lost faith in government

Keeping away JDS will give good government, as JDS cant be King, but they play by being king maker

Unfortunately Karnataka have luck of good government
Previous Cong. Govt had majority but not peoples govt.
Before that BJP too had majority, but had different story
before that Congress and BJP had allience with JD(S) and state was facing same drama as today.
I guess after SM Krishna, karnataka is lacking from a good government in state.

Hope atleast now onwards, people will witness for good government
Be it BJP or Congress, they should get clear majority and leader should be peoples leader not for one community.
Good government can be possible by BJP and Congress together by Keeping JD(S) out…

DEAR CONGRESSMEN, After several failed "OPERATIONS" DR.yeddy B.C.P(Bachelor in Cunning Politics)& his mafia gang with active support from modi/shah M.H.G(Masters in Hijacking govts) seemed to be achieved some success in destabilising a perfectly running govt.
THE MLAs are cattled to some hotel to hotel in mumbai then to goa(now cows i mean MLAs themselves dont know where they are!!!).same people who shout from roof top take protests in alleged cow-theft,now openly stealing MLAs & herding them to a hotel & no one is allowed to meet them speaks volumes about RSS-BJP & their fake concern about anything that moves or moos..of course MLA(gow)-stealing law doesn't applicable here cause its GO-RAKSHAK becoming MLA bakshak.
THEY started this disgusting, vomit inducing full time operations in Arunachala.. then to Gujarat.. Telangana.. Andhra pradesh.. west Bengal.. goa.. Manipur.. & in Karnataka. Soon they'll do it in MP/Rjasthan.
money is not a issue here... name your price feku'll buy it nevertheless.its really profitable to become opposition MLA/MP(especially cong) then quote your price you'll be multi-millionaire in matter of days!!! if EVM doesnt gives enough seats to BJP steal the govt itself!!

The Union Minister Rajnath Singh said on Monday in Lok Sabha, BJP-ruled government has no relation to the ongoing developments in Karnataka and did not put pressure on any MLA or MP to switch parties.

The chartered plane in which 10 dissident MLAs of the Congress and the JD(S) flew from here to Mumbai belongs to a company associated with Rajeev Chandrasekhar, a Rajya Sabha member of the BJP, company sources said here.

    1. How much money spent to buy MLA's?
    2. Who arranged Flights, Hotel Stay for MLAs? Why BSY BJP PA accompanied MLA to aircraft?
    3. Why BJP Maharashtra leaders are visiting Hotel?

The BJP of "denigrating democracy by engineering defections" in Karnataka and attacked Prime Minister Narendra Modi, saying the culture of "Aaya Ram Gaya Ram" has attained a new definition and the new word for it is "MODI - Mischievously Orchestrated Defections in India.

The people of Karnataka will never forgive the BJP for back stabbing the state with such unprincipled and unethical politics. Destabilising state Govts in such a crude manner by encouraging corruption will spell doom for democracy in India and is bad for the federalism.

WE THE PEOPLE OF Kranataka should punish the BJP for these repeated attempts to overthrow the state Govt in the past one year thereby causing instability in the state. The only way to keep the BJP out of the reckoning is to introduce Ballot Papers and the people will give the Congress and the JDS a landslide victory and put the BJP in its rightful place.

When the constitution doesnt provide any powers to the Governor to accept the resignations of the MLAs , the present Governor is meddling unnecessarily with the MLAs issue by entertaining them in his office. His direction should be to go to the Speaker and test the strength of majority on the floor of the house. If the Governors in India start meddling like this violating the SC ruling given in the S R Bommai case then the Governors may have to stand trial while in office for excesses committed by them.
