Bengaluru: State government opposes Centre's cow slaughter rules

Bengaluru, May 31: The state Cabinet on Tuesday May 31 took strong exception to the rules notified by the Central government on cattle slaughter. The Cabinet said the rules are unconstitutional with an argument that rules will not stand the scrutiny of law.

Law minister T B Jayachandra, speaking to the media after the Cabinet meeting, said “The Prevention of Cruelty to Animals (Regulation of Livestock Market) Rules, 2017, brought into effect from May 23 by a gazette notification by the Centre, is contrary to the Prevention of Cruelty to Animals Act, 1960 of the Centre,”

“Besides, the Centre does have the legislative competence to frame such rules. The rules ban the sale of cattle for slaughter at animal markets,” he added.

“The rules do not meet the objective of the parent Act of 1960 and hence are ultra vires to the Constitution.” he said.

The minister also opined that Parliament will have to amend the 1960?Act to bring into effect penal provisions and, it cannot be incorporated in the rules.

“Also the rules framed by the Centre override the provisions of the Karnataka Prevention of Slaughter and Preservation of Cattle Act, 1964, which again is unconstitutional,” he explained.

Jayachandra said the Cabinet will take a final decision on its next move on the Centre’s notification at its next meeting after getting legal opinion on the issue.

    Centre Cow Slaughter Rules-Spells Death of Farmers since :

    1. Farm Holdings are too small , economically unviable despite all developments.
    2. The Basic realities of and the Rural Infrastructure facilities are very poor and India is
    25 years behind China.
    3. Only the large land holders get incentives and they do not share it with others generally.
    4. Farm Insurance is not available to Farmers and the Fact is that the Public Agriculture Sector Insurance Firms do not even have a CEO for quite sometime.
    5. The uncertain monsoons apart there are serious issues like high input costs, costly labour, no stable MSP(minimum Support Price) for most crops,and lack of good quality seeds as well as hamper the farming sector.
    6. As per World Bank, effects of demonetization which have hampered day to day farming activities . Digitalization is yet a far off cry for atleast 60 % of our rural areas .
    7. The G.S.T is too complicated and it’s going to mess all Agri Input sales like Fertilisers, Seeds, Pesticides, Micronutrients and others which the poor farmer depends.

    How the New Law and the Prevention of Cruelty to Animals will effect Farming Sector immediately:

    1. Tractor use and mechanism in Farming is limited to a very small percentage in India.
    The average farmer is still, dependent on draught animals and the Buffalo/Cow /Bullock to run his farm.
    Once the animal has completed it’s productive / useful phase and is of no use, the farmer has no option but to dispose off the same and use this money and add some of his own savings and buy another animal as replacement.

    2. The farmer is least worried about who buys the animal and it’s not practical to expect him to ensure the animal is not sold for slaughter purpose . If he cannot dispose of the animal in the current new scenario , then the only option will be to leave the hapless animal in some remote area.
    3.Even if he is completes the required cumbersome paper work as per the new law, he cannot ensure law compliance.

    It has been proved that beef is the main cause of Cancer,mad cow disease and heart diseases (red meat). That is why most of the western people turning In to Vegetarians. Here in India people getting edicted to beef since it is cheaper than mutton and chicken. Why people want to hurt feeling of majority. God made so many things to eat on this earth and I do not understand why people stuck to beef as we people are living to eat. People are not going to starve if there is no beef. Cow is important part of Hindu family which feeds whole family with nutritious milk. So cow has been given respect next to God as much as parents. Do you send your parents to hell when they become burden to you,?? Many countries Pork is banned totally which can feed millions. Do they revolt?

    India produced 3.643 million metric tons of beef in 2012, of which 1.963 million metric tons was consumed domestically, and 1.680 million metric tons was exported. India ranks 5th in the world in beef production, 7th in domestic consumption and 1st in exporting.[25]

    With all these realities the decision which is taken by Central BJP government is wrong, and State government is having all rights to oppose it and should not implement it.

    Muslims never consumed Beef In India. Kureshis were forced to slaughter Beef by the British to create communal fights between religions in 1820s. Many of the sanskrit teachings were doctored by the British to achieve their target. I have decoded many Veda writings. you wont find any claims said here in any writings published prior to 1820s.

    Beef is not compulsary for muslims but we consume it because its declared halaal by almighty. Dont bring your history to forcefully impose gomatha ideology on anybody. An animal is just an animal and to uphold the oneness of god or thauheed we along with other community must consume it proving blind believes are not the spirit of democratic constitution. Can u imagine tomarrow if ALOO BECOMES GOD OR SABJI BECOMES GOD. WHAT WILL U EAT. JUST GRASS. the list of implanted gods have no limit.

    It has no right to peep in my house kitchen what is in my plate/ what should be in my plate.

    Humans have all the rights over animals including slaughter of animals for food purpose.

    I STRONGLY URGE THE ಪೆತ್ತ ಸರಕಾರ TO WITHDRAW THE ORDINANCE IMMEDIATELY WITHOUT ANY DELAY AND ISSUE MORE PERMITS TO CATTLE SLAUGHTER HOUSES SO AS TO BRING DOWN MEET PRICES IN THE MARKET.

    Dear sri_elder, Karkala, Which ever animal I like to eat as my food I have natures gift to cut and eat. If you like monkey to eat as your food you have your right. I can eat any cattle for my food permitted in the Holy Bible. Suppose your Veidhaas are not permitted to eat any cattle you don't eat. We are not dictated by anyone to eat this and eat that. None of anybodies business.

    Ask your ಪೆತ್ತ ಸರಕಾರ to increase cattle population and stop sending meat to foreign countries.

    WHY INDIAN NATIONAL'S ARE DEPRIVED OF EATING INDIGENOUS CATTLE AND WHY THE FOREIGNERS ARE ALLOWED TO EAT INDIGENOUS CATTLE.

    I think you guys need to come out of hunter gathering group mind set.
    If tiger can eat human since it is source of good meat. If human is a vegetal then tiger would not have eaten . It also hunts monkeys . From the tigers eyes both humans and monkeys are animals. If you are a tiger please proceed with hunting cattle. Then by the way tigers need to live in forest and not in cities.

    A toddler / boy fell in to the Chimpanzee dwelling place in the zoo.

    To rescue the toddler / the boy, Chimpanzee was shot dead.

    Similarly if a cheetah, chimpanzee, tiger or a Lion captures a man the cheetah, chimpanzee, tiger or the lion will be shot dead.

    Do the Cheetah, Chimpanzee, Tiger or the Lion have thinking capacity to eat only the non-vegetarians.

    It is a human right to kill any animal if it attacks to a human.

    Cattle meat is good for human consumption.

    Government should increase cattle population for Indian beef consumers.

    Try your best to send all veggies into the cage of tigers or in to the forest where tigers are located.

    Then see whether the tiger eats the veggies or not.
