Muslim board against triple talaq


New Delhi, May 19 (DHNS): The All India Muslim Personal Law Board (AIMPLB) on Thursday told the Supreme Court that it did not want the practice of triple talaq to continue, and would issue an advisory against it. The submission came just before the hearing on the Constitutional validity of triple talaq. “We have held a meeting on Wednesday and will send a circular to all the qazis within a week to mention in the nikahnama that it would not be permitted,” senior advocate Kapil Sibal told a five-member bench headed by Chief Justice J S Khehar. A nikahnama is an Islamic marriage contract or prenuptial agreement.

The board had earlier admitted triple talaq was “sinful and undesirable” but defended it, saying it had flourished for 1,400 years. In his concluding arguments on behalf of the board, Sibal cautioned the apex court not to take the “dangerous and slippery slope”. He said it was not the domain of the court to declare the practice illegal or unconstitutional.

The bench, also comprising Justices Kurian Joseph, R F Nariman, U U Lalit and S Abdul Nazeer, reserved its judgement after wrapping up the six-day hearing on a batch of petitions challenging the constitutional validity of triple talaq.

The court asked the counsel when the board was going to issue directions to the clerics, and if it was willing to submit details in an affidavit. When the counsel agreed to file an affidavit as early as possible, the petitioners expressed their reservations. They said such an advisory would have little effect on the ground.

The court had earlier asked the board if the women could insist on a condition in the nikahnama that the husband would not deploy triple talaq. Countering Attorney General Mukul Rohatgi’s argument that triple talaq had to be tested on the principle of equity, good conscience and Constitutional morality, Sibal said such an examination could not take place in the absence of a relevant law.

“It is for the legislature to pass a law which can be tested on the principle of constitutional morality. Otherwise my right is protected under Article 25(1) of the Constitution,” he said. The article enshrines the right to practise, profess and propagate religion. “So bring a law if you want some social reforms. There is a process, follow the process.The court is not to decide what are the sinful practices in the world. Lots of sinful practices are still protected as customs,” Sibal said. His contention that the women have accepted the practice was opposed with a loud “no no no” in the courtroom by counsel representing affected women.

    Divorces is a serious issue dangling the structure of the family.

    Saudi Arabia is the largest number of divorces in the world compared to their 99 percent Muslim population.

    For the whole country of KSA in 2014, there were 33,954 divorce cases.
    In 2015, with roughly 133,000 marriage contracts, there were roughly 40,000 divorces.
    This year,(2016) there have been some 157,000 marriages and about 46,000 divorces.

    Also please remember these figures coming in the Arab news are controlled / dictated figures. Truthful figures are very much higher than stipulated above.

    I believe we are talking about tripple talaq in India. According to census figures divorce rate in hindus is more than Muslims in India.

    So Divorce is the crux of the problem.
    Give us Hindus divorced figures as I have stipulated above Saudi Arabia's divorce figures.

    Meaning, the leaders of the community have understanding how devastating could TT be on women.

    Not related any faith only.....its matter connected to women welfare and safety in social life....Please understand that majoroty of women from Muslim community are against the age old Tripple talaq system.....
    More over any political party does not belong to any particular community only.....

    This type of shutting off from each other has brought the society to this level. All neighboring countries have thought the bad affects of the practice on their women, hence have banned it. Only in India the practice is continues. You may say 'why should it bother non-Muslims' whereas, we, whether Hindus, Christians or Muslims, in general are called Indians. As such, if one community lags behind while others prosper, it does not give a scenario of mutual coordination.

    For example, if Polio vaccination is not given to every child of a locality, they will be victims of the fever and after some years, there will a certain percentage of handicapped citizens who will be a burden on the government. Similarly, if TT is not curtailed before its too long, there will be a group of people still destitute, not able to come above struggles of day to day life.

    Quite apparent that men are not agreeing with curbing TT but its women who must come out and express their anger against the practice and support the movement. Else, they/she have/has continue to live in uncertainty that any day their/her husband may utter TT and some day it could be a reality.

    TT has less attachment to religion but more to male domination and power over female. If it was purely religious, all major Islamic countries would not have banned it. Therefore, men, please don't think yourselves as just husbands, but also put yourself in the shoes of a father and imagine what your daughter will do if she will be a victim of TT.

    WITHIN 3 MONTHS. SHE CAN GO ANYWHERE SHE LIKE. BUT IT WILL NOT BE DIVORCED. IF SHE OR HE WANT TO SORT OUT THE ISSUE WITHIN THAT PERIOD OF TIME.

    David, I am sorry. It seems you have not understood what Milan is trying to say. He is also against TT and suggesting that the 3 month period should be followed (not instant talaq or tt). This method of giving 3 month time is preferred by all and it is advised by the Quraan. It is accepted by everyone including all Muslim women.
