BANGALORE, Jun 18: Joseph Chacko, a resident of Bangalore, who allegedly cheated about 100 Non-Resident Indians (NRIs) of Rs. 500 crore has been arrested by the city police in Kolkata.

Chacko and three others were accused of luring NRIs from Bahrain and United Arab Emirates to make investments for construction of Crown Plaza International Hotel and Resorts. This resort was supposed to come up in Hennur. The investors were not only promised a seven-day stay in the hotel but also some share in the earnings for rooms and for resort.

The project was advertised in Gulf News, and Chacko claimed to be the proprietor of the Crown Plaza. As many as 150 NRIs invested, while 76 managed to get sale deeds. The investors later realised the cheating and filed a complaint with the then Chief Minister H.D. Kumarswamy in May 2007, which was forwarded to the city police.

Forty cases were registered in Hennur, Kothanur, Hoskote, Nandagudi and Sulebele police stations. The police arrested three persons and were searching for Chacko. The 11th Additional Chief Metropolitan Magistrate has issued non-bailable warrants against Chacko in five cases.

The City’s Central Crime Branch police, who were searching for Chacko, were tipped off about his presence in a hotel in Chennai. As the police team reached the hotel they came to know that Chacko left for Kolkata by air. The team reached Kolkata and arrested Chacko on Wednesday. He was travelling along with a friend and two children, said Joint Commissioner of Police (Crime) Alok Kumar.

The city police produced Chacko before a North 24-Paraganas magistrate court, which gave the necessary permission to take him to Bangalore. He is being brought to the city by a private aircraft.

Chacko, a PUC dropout, started as a painter and later went into the real estate business. He developed contacts with NRI investors and got finances for his residential projects, more so for the NRIs.

The police said Chacko was taking land from poor farmers with power of attorney assuring them of a good value for sale. But Chacko failed to pay farmers even after the sale. He moved to Kuwait in 1995 and got NRI status.

He exploited the NRIs, especially from Karnataka and Kerala, who wanted to settle down in Bangalore.

The police said Chacko was giving NRI’s an impression of fully developed townships and selling barren land in villages far away from the city. He had forged documents and sold government land as private layouts. One such layout was Elysium Township in Hennur, the police said.

Chacko had 12 projects in Bangalore East, Bangalore South, Bangalore North and Hoskote taluks of Bangalore. Some of the projects were on the same land. The NRIs found it hard to check the genuineness of the projects because of the absence of proper government agencies, the police said.

Convicted

Chacko has been convicted by the Higher Civil Court of Kingdom of Bahrain in a case of cheating of Rs. 3.8 crore filed by M.T. Jose, an investor, in 2004, the police said.

    At last, he has been booked. It is a wonderful news indeed. But what about our hard earned money invested in those projects, especially Planet Regency and Regency Enclave? It is high time now that all the investors in this project come together and dispose the whole plots of about 100 acres, I believe, to any single party.

Secondly I once again say the clarifications given by Atul and Raveendra Urudai justify my reply to Nagesh nayak''s comments. I do not have any personal animosity against Nagesh Nayak, however unfortunately we do not happen to agree on various issues.Therefore i cannot help writing what i feel against Nagesh Nayak or anyone else for that matter,and at the same time i do not expect all readers to accept my views.I too am being criticized for my views and it is ok with me.

    I agree with Mr.Nagesh Nayak. What else can people like Jude, Shanwaz & so on can think. I have seen some people in their past comments, blaming BJP govt. for the accidents or robbery or some sorts done here. If so, then why cant we connect the Chacko to some party or so. People can understand the difference. Mr Nagesh has made his comments, & so did others. The only difference so far as I have seen is that Nagesh comments on subject, while others comment on Nagesh !

There was no need for Nagesh to bring in Atul Rao''s name and cast doubts on his character here in the first place. The whole state is witnessing how the Padmapriya case is being hushed up by state interference and again and again an innocent man is attacked. If he (Atul)is really guilty why is the state shy to pursue the case so that he can be punished. Chacko has now been arrested and let the courts try him and punish him. Don''t worry about Nagesh mamu and me, we enjoy a special relationship.

    Hi, I am Athul Rao,I was shocked to see the news paper, portraying me as a business partner with Mr. Chako. Regarding this case : I am the GPA holder for 113 NRI s from Gulf, USA,CANADA and Australia who have been cheated by Mr.Chako by not giving Possession of CROWN PLAZA International Hotel and Resorts. It is known fact that i have been fighting against Mr. Chako in 11 cases in several courts. After a span of two years fighting in all the courts in Karnataka , and winning all the cases against the said builder, association has finally entered in to an understanding (MOU) with the interest of NRI investors not to drag the issue further and settle the issue amicably. The said NRI s are very happy with this, as they have got the justice in the court of law against the builder , and finally settling the dispute with the builder and the association on association request.

    Crown plaza flat owners association hereby clarifies that the article related to crown plaza hotels at Hennur and nri investors from gulf in this project , and details of the case status as on date with reference to the arrested builder Mr. Joseph Chaco is totally misleading the public. Hence the association clarifies following facts. It is true that NRI investors in the above said project have filed several FIRS and cases after getting letters from the embassy of Qatar, and approached the, then chief minister of Karnataka, filed FIRS complaints, with CCB police Bangalore .After a span of two years fighting in all the courts in Karnataka , and winning all the cases against the said builder association has finally entered in to an understanding with the interest of Nri investors not to drag the issue further and settle the issue amicably.

    An memorandum of understanding with the builder Mr. Joseph Chaco has reached on 7th April 2008 .An affidavit was filed on 16th April 2008 in the court as the association has entered an MOU with the builder, and all cases, FIRS to and allow the parties to settle the issue out of court as the trail is only an waste of public time. In another development high court of Karnataka on its judgment dated 3rd Nov 2008 has squashed all the FIRs by the association with the reasons “as the parties have arrived at a compromise in the matter , the continuance of the proceedings is futile , it is the drain upon the time and money of the parties, witnesses and of the courts.

    The policy of law as contained in section 320 of the code of criminal procedure is to promote friendliness between parties, so that peace between them is resorted, HENCE THE SQUSH. The association again here clarifies that the all these cases are fought by association power of attorney holder Mr. Atul Rao , on the behalf of NRIS who are 113 from various gulf countries. , giving justice to them in the court of law against the builder , and finally settling the dispute with the builder and the association on association request. The association clarifies “There is absolutely no truth in the articles appeared on 18th June 2009 related to this episode ,in various news papers that Mr. Athul rao was a partner to the accused Mr. Joseph Chaco in any case and at any time”.

    IT is high time that the entire Nri community salutes MR. Atul Rao for fighting for them for justice in all courts in Karnataka up to Supreme Court of India and keeping their investments and interest in the property safe and alive, with their absence in India. FINALLY NONE HAVE HEARD SUCH A FIGHT BY NRIS EVER BEFORE FOR A NOBLE CAUSE , SINGLE HANDEDLY BY AN ABLE POWER OF ATTORNEY AND THAT IS THE TRUTH.

    Nagesh Mamu, as said by Jude, Atul too was cheated by this Chako and not vice-versa. Regarding Atul''s role in Padmapriya case, I think, the longer he keeps his mouth shut, better will it be for many a ''bing heads'' of Udupi politics.

    The day Atul lets the cat out from the bag, a few big heads will be rolled for sure. Today the question is not about what happened to Padmapriya, but why it happened and why did she choose to end her life (as stated by the home minister).

     Even every Tom, Dick and Harry of Udupi knows what has been the role of MLA, a former MLA and a minister it this case. You may not be knowing since you are from Hebri. I do you comment on things and issues, of which, you hardly have any information, forget about knowledge?

    Nagesh Mamu, please remember that Atul Rao is another person who has been cheated by Chacko here. I find it very strange that Atul Rao and Raghupathi Bhat were close friends until the disappearence of Padmapriya. As long as they were friends Atul Rao was Ok to you guys, now suddenly he has become a bad guy.

    If Atul Rao is a crook, then the same applies to Raghupathi Bhat as they were close friends and business associates at one time. If Raghupathi Bhat has nothing to hide then why is Acharya and the BJP government trying to shield him?.

    I agree on your second point of daylight robbers. The Reddy mining mafia which holds the BJP government together is the prime example. They are looting our state and people of its resources and Mr Yeddi is just watching the fun while all this is happening.
