Mumbai: Anjali Waghmare to Defend Kasab, Gets Z+ Security

by Rons Bantwal
Daijiworld Media Network - Mumbai

Mumbai, Apr 1: A day after seeking time to consider appearing in the 26/11 attacks trial, advocate Anjali Waghmare on Wednesday informed a special court that she was willing to represent arrested terrorist Mohammed Ajmal Amir Kasab.

Waghmare had on Tuesday asked the court for a day to think over whether she wanted to represent Kasab following protests by Shiv Sena activists outside her residence in Worli after she was appointed defence counsel by the special court.

She had also given a letter to Sena activists on Monday apologising for taking up the representation of Kasab and said she would withdraw from the case.

Special judge M L Tahiliyani on Wednesday asked Waghmare if she had any problem with continuing as defence counsel for Kasab, a resident of Faridkot in Pakistan.

"No, I will continue with the case," Waghmare said.

The court then appointed advocate K P Pawar, also an advocate from the Maharashtra Legal Services Authority, to assist her in the case.

Judge Tahiliyani said that adequate security had been provided for Waghmare, who along with Pawar, will appear for Kasab for the trial which is scheduled to begin on April 6.

According to reports yesterday. She will be provided with Z+ level security and asked for cases against the protestors to be withdrawn.

Z+ level security is typically provided by members of the elite National Security Guard force in New Delhi and is reserved for politicians or public figures who have been targeted by a specific threat.

I dont see anything wrong in Ms. Anjali representing as a lawyer for Kasab but if she is trying him to defend and the court rules out that Kasab is not guilty then she will have the consequences.

Jaimini P.B - Yes, in certain cases we have seen the Indian Law/Courts were soft. Taxi serial Killer case might have been well argued by his Advocate Brother on the ground "it is not a rare of the rarest cases" to save from hanging to life imprisonment while pleading mercy for lesser punishment. But in Ajmal's case, we do not know how well Anjali Waghmare may argue. Do you think, she will argue that shooting training he got is his professional qualification. His association with terrorist group is his privilege. Ajmal needs no passport to enter India. He can come to India without invitation( Visa)or intimation. He need not come by Flight and it is his choice to come to Sasan Dock (Fishing Port) in Bombay by country craft (boat for cost cutting). It is not necessary for him to buy a Platform Ticket to enter V.T Railway Station before killing. He also needs no licence to kill the people. He has just followed the orders of his superiors like the Generals of the Nazi Hitler - Case reference Nuremberg Trial II World War,- so on and so forth and hence he is "not guilty" and therefore he should be honourably acquitted from all charges levied on him. Do not worry, this case will not have a soft corner.

Anjali to defend Kasab. If Anjali is genius or extraordinary, then she can save Kasab from the jaws of death .Indian law is very very soft.It reminds me of a serial killer Ravindra Prasad, who killed six taxi drivers with the help of 3 friends for money.Death sentence was 100% sure when they were caught in Mysore. But Ravindra Prasad was saved from HANGING by his brother who was a lawyer and who defended him in all the six cases. Finally they were given life imprisonment only because of public pressure.(ref:Serial killer Ravindra Prasad by Ravi Belgere),Hope this case won't be like that.In some cases we need tough and fast verdict ,It is heart breaking when we come to know that rapist who raped 5years old girl easily coming out of the jail on bail.We are fighting for religion for nothing. Why can't we fight for poverty, rape, unemployment? It is a million dollor question to me.Can you solve it ?

For the Crime, Ajmal Kasab committed, he is fit to be hanged is known to all of us. He is not just accused but cought red-handed being one amongst the well organised and trained terrorist group. But in Indian democray there is a thing called "Court of Law". Decision should be given by it. That too only after a fair trial with "Due process of Law" followed, without which the verdict given has no validity which in case of appeal will go in his favour and he may be acquitted. For that we should conduct the proceedings providing him Legal Assistnace/Advocate. So that in appeal, he can not use the ground of "Legal Assistance not Provided" or "not allowed to defend". Our prosecutor/Govt. should not lose the case and Kasab should not be allowed to win. Why should we make that mistake and make our own strong case a weak one? He is caught re-handed. So, let us see how well he be defended as "not guilty". How many proofs our Govt. provides and how strongly the case is argued. What decision ultimately will come out.Till then let us watch coolly.

Dear Mr. Prashanth Poojary, why can’t Mr.Ajmal Kasab and Mr. Modi be garlanded and paraded in public because both are butchers. When one butcher can contest elections why can’t the other? One is an internal terrorist another is an external terrorist. (Clarification from my side: Both are guilty before the law and both should be brought before the law and the law should provide justice. Internal terrorist can contest elections the external cannot because no citizenship. I have no regard for any person internal or external those who break the laws of the country and love of God).

Well Done , Ms. Waghmare ! You became famous overnight , just like Jethmalini in Mrs. Indira Gandhi assasination case. But do the justice to your profession. Don't steal only limelight. Shiv Sena has no right to protest as they themselves said that they are ready to provide every legal aid to Sadvi Pragnya and others who too are terrorists.

Respected Sir M.Siddique ,why just arrest for Shri Ajmalji Kasabji should be garlanded and paraded along with Smt. Soniaji. Recall that a man is innocent unless proven guilty. So, Shri Ajmalji Kasabji is innocent. Why lose out on minority votes by harassing an innocent person belonging to a minority community?

The majority community can of course be neglected without any consequence as it has no self respect and it will not result in loss of votes. Let us all "secular" world's largest democracy forces of India unite and collect money to defend Shri Ajmalji Kasabji.

UPA should make him an Indian citizen and give him a ticket to contest election for a Lok Sabha seat. Then we can vote for song JAI HO..........

All you guys who are commenting against Ms Anjali, please be aware that we do not live in a banana republic. We live in the world's largest democracy and everything we do has to be done under the law of the land. 100% of India knows that Kasab is guilty and should be punished. He will in due course of time will surely be punished, but the whole thing has to go through a process of law.

In case Kasab is not represented and no lawyer takes up his defence he can even go scot free, as noted lawyers have said. The families of the victims want quick justice, but by these stupid acts the shiv sena is only prolonging their agony, and helping Kasab. Ms Anjali did not volunteer to take up Kasab's case, but she has been directed by the courts to do so. Instead of supporting her, people are passing silly comments here.

Truth is already learnt. There is nothing more to know. Police cannot keep anyone in the custody or jail forever without authorization from the constitution. Indian Law is part of Indian Constitution. Gives a chance to the person contesting the case - to defend, elaborate the truths (good or bad). Every law breaking action that is proved will be punished. Punishment will be as per the costitutional agenda. Advocate Anjali is the one who speaks in the court not Kasab. To speak in the court one should be qualified. Just like any common man (like one of us) Kasab also needs someone to speak for him. Win or lose, unfortunate for Pakistan now, they have lost a chance to try their wits. Whatever the outcome there will be punishment waiting for Kasab - unless every Indian voices in favour of Kasab. Just wait for the court to finish formalities. Sene people should keep out of sight. Anjali is just doing her duty.

Somebody has to represent Kasab. It is not just hanging !!!! He shall be proven guilty in the court of law. Why we are against the representation. As common people we can say he is terrorist who has come from pakistan and killed several people in Mumbai and hence kill him. It is not so simple do that ... Let somebodyrepresent him and close the issue. Even then we know, how many of the criminals who have been given death sentence are fed and given free medical at the tax payers expense....this kasab will be one more to get free food and accomodation...!!!!??????
