Bishop Franco abused position, repeatedly raped Kerala nun, police tell high court


Kochi, Aug 14 (PTI): As per the initial investigation of the police, Roman Catholic Bishop of Jalandhar Franco Mulakkal abused his position and repeatedly raped a nun from Kerala, a special team probing the case told the Kerala high court on Monday.

Responding to a petition seeking speedy investigation, Deputy Superintendent of Police, Kottayam, K Subhash informed the court that the investigation was proceeding effectively and impartially.

After the submission by the officer, the HC disposed of the petition with a direction to the police to investigate the case properly.

The government counsel told Justice B Sudheendra Kumar that a decision on arresting Mulakkal, who has so far claimed innocence, will be taken after he is interrogated and evidence is examined.

In the statement, Subhash said he and his team would continue their investigation in Jalandhar.

The police statement was based on initial investigation and available evidence. It is revealed that the accused Bishop Franco Mulakkal committed unnatural offence and committed rape repeatedly on the nun against her will, the statement read.

The bishop confined the nun to a guestroom in St Francis Mission Home in Kuravilangad in Kottayam district of Kerala, the statement alleged.

No laxity or indifference has been shown till date in the investigation of the case, it said.

The petition was filed by the Kerala Catholic Church Reformation Movement (KCRM), which claimed that the police were not taking speedy action in the case.

In her complaint lodged with Kottayam district police, the nun accused Mulakkal of raping and having unnatural sex with her multiple times between 2014 and 2016.

State police chief Loknath Behera on August 1 reviewed the progress of the case and permitted the investigation team to proceed to Jalandhar, New Delhi and other cities as part of the investigations.

    This spineless CM is expected to remain strictly neutral, allow for impartial trial and law to take its own course. Otherwise there is every possibility of both winning and losing votes from the community. If the accused bishop has influential supporters, the CM shouldn’t forget there is equal number of opponents too in the community.

    As per the various reports, including this article, the police have not interrogated Mulakkal.

    So, whatever is stated by various people, is a mere accusation.

    As per Supreme Court's past declarations, in over 90% of the cases where people have been accused of sexual crimes, such accusations have turned out to be false.

    I do not believe there is any truth in what the nun has been claiming, who never said a word until she was ordered transferred in 2018. And then she claimed all these instances happened between 2014 and 2016.

    Nobody is ROMAN - they are Roman Catholics. Its just a fraction in Christianity, with its administrative head in Rome (rather Vatican City).

    They have no denial that they are converts. Do you have any idea what made them convert ? Do you know why Basavanna created Lingayat fraction ? Indian Christians too are one group that broke away from the main stream, for similar reasons.

    There is difference between Christian Institutions heads abuse followers and other religions' heads do that. Do you remember the protests when 'Asararam Bapu' or 'Nityananda' cases came up ? Now, do you see anybody coming on the roads branding the nun a liar ? That is the difference.

    The man in a position has abused his power. He must be subjected to punishment like any other citizen. No less, no more.
