Shah Rukh Khan Refutes Charge over Smoking Scenes

Panaji, Nov 16: Megastar Shah Rukh Khan on Thursday refuted the charges levelled against him for defying anti-smoking act during twenty20 cricket match and Hindustan Times summit.

National Organization for Tobacco Eradication (NOTE), a national anti-tobacco NGO, had issued a legal notice to the star for smoking in public. The notice was issued under The Cigarrettes and Other Tobacco Products (Prohibition of Advertisement and Regulation of Trade and Commerce, Production, Supply and Distribution) Act, 2003.

"Nothing contained in the notice should be deemed to constitute any waiver or admission by our client. We advise you to withdraw your notice forthwith. Any further action by your client shall be at his own cost and peril" a reply sent by Somasekhar Sundaresan and Karan Bharihoke, on behalf of the megastar, mentions.

The anti-tobacco NGO had objected to the superstar's alleged smoking in public during India-Australia twenty20 cricket match in Mumbai and HT Summit in Delhi. They had contended that he was setting a wrong example for the younger generation while defying the anti-smoking Act.

The lawyer for Shah Rukh has said that although the star was attending the Twenty20 match, he was at no point of time in any air-conditioned enclosure. "Our client watched the match from an open private gallery which was reserved by the Cricket Club of India for persons to be admitted by invitations only. Further, any telecast of the event was neither under my client's control or behest."

The notice mentions that Shah Rukh watched the match from an open space which is expressly excluded from the definition of a public place as per section 3 (1) of the act. "A space where the general public does not have any access and is therefore excluded from the the definition of a public place as per section 3 (1) of the act," the reply states.

The lawyers have pointed out that the high court of Bombay has been pleased to stay the effect of the amendments to the Cigarrette Rules, 2004 that sought to exclude stadiums from the scope of the phrase open spaces.

Shah Rukh's advocates have also said that with respect to telecast of the event, it was neither in the control or influence or behest of our client. "That being so, the element of intent to advertise or to promote is absent in the present case and the allegations in this regard are misplaced," it adds.

Through a letter addressed by me to Mr Shah Rukh Khan, I have brought to his notice that the Notification (Rules) which dissllows smoking in stadiums/bus-stops etc has been stayed by the Bombay High Court sometime in 2005. It is really sad that NOTE has been misleading the media regarding this for sheer publicity. He has to apologise to Shah Rukh Khan immediately because he has spoilt the name of the King Khan as well as he has contempted Court orders by giving false news.     Krutika, Pankaj, are you saying that just because he is a megastar, he has no life of his own? Tomorrow if someone films him at a party having some wine, you will start complaining that he is advertising drinking. Give him a break, he has the right to live his personal life, which entitles him to smoke if he feels like it .And he did not break any law either. He cannot control the cameraman at stadium. Infact if you really want to play the blame game for fun, blame the camera man, because being a part of the TV fraternity, they should know that the act of smoking should not be shown on TV.

    Comon guys, he didnt smoke in a public place. Also there was no intent to publicise smoking. If you think smoking sets bad example, then wat abt drinking in movies, fights, stealing (even if it is to help others, i dont think you want kids to steal and say, "oh, i did it to help people"), car chases all these should also be punished. blaming movies and stars for someone bad behavior is like blaming a teacher for one student not doing well.

    Maybe next time the signs and adverts should read 'NO SMOKING anywhere on these premises'. Atleast this will stop people from taking advantage of loopholes and misinterpreting words set down as law. I thought SRK was above flaunting regulations. Would he do the same if he was in the UK where smoking is banned in many places including stadiums and shows whether public or private and for all whether stars or commoner.

    I don't think that Shah rukh has committed, after all he is also a human being and a citizen of India, who is having is own rights like others. So under that what ever he do, no body should bother about that.

    Shah rukh khan have committed a crime by smoking in public place. law should punish him in such a way that he will think twice before smoking. Entire world is looking at him and he is spreading wrong mesage to the entire world. He should be fined for this act.
