CBFC has no power to censor films, says Bombay High Court


June 13, Agencies: In a significant ruling, the Bombay High Court said on Monday that that the Central Board of Film Certification (CBFC) does not have power to censor films.

CBFC is not empowered by law to ask for cuts as the word ‘censor’ is not included in the Cinematograph Act, observed the Court.

The court said that cuts can be suggested only to ensure compliance with Constitution and earlier Supreme Court orders.

The Court said it did not find anything in the Udta Punjab script that questioned the sovereignty and integrity of India. The film simply depicted the menace of drugs in Punjab and it was entirely on makers to choose the way they wanted to send out the message.

The ruling of the Bombay High Court came in response to a petition by the producers of Udta Punjab row who had approached it opposing the cuts asked by the Censor Board.

    Yes, The CBFC is very much necessary. Their job is to only CERTIFY a film and tell which film can be viewed by which age group and not to tell what should be the content of the film or to cut.

    It is high time to re-write cinema certification guidelines. And Pahlaj Nihlani and these bunch of jokers should go.
    However, a country like India where "freedom" is taken literally (I can do any thing attitude), some form of censorship is indeed required.
    What if certain Togadia or Mutalik or Owaisi make films to suit their ideologies and say that they have freedom of expression to do so? Should Censor board certify the film H rated and M rated?
    A serious dialogue is required considering the diversity and sensitivity in India.
    And on a lighter note, can we see the uncensored films of certain Ms Leone now?

    Exactly, it shows the backward rather illeterate thinking of Modi Govt., which proclaims to be all pro progress.

    Hiding truth is it progress? It works with illogical mind set but not Indian mind set, which is much more progressive, logical and advanced than RSS liking.

    If this kind of cuts is norm, then we would find a typical self proclaimed modi chamcha nehlani sitting next to every film shooting and telling them how to create a set and story of his liking.

    Indian is won again from the cluthes of ignorent chamchas.

    Modi Govt., has forced and tried to make every institution in India, to play their brand of politics. Tell no truth, malign people who speak truth, do little - market more.

    A slave mentality or yes boss man to such leadership becomes the leader of such organization. CBFC chairman is the best example and there is no need to speak of his credibility, as he himself claimed publicly he is a chela.

    Yes, Chela mentality is good for personal progress and monitory gains, but dangerous to country as a whole.
