Mumbai, Sep 6: The Bombay High Court on Thursday sentenced Alister Pereira to three years rigorous imprisonment for moving down seven persons in 2006, enhancing the six-month jail term awarded to him by the lower court.

Pereira's car had run over seven construction workers and injured eight others on the night of November 12, 2006.

He was awarded a six-month prison term in the hit-and-run case under Section 304 (a) (causing death by negligence) and fined Rs five lakh on April 13 this year by a sessions court.

The division bench of Chief Justice Swatanter Kumar and Justice Ranjana Desai enhanced his sentence to three years under 304 (II) (if the act is done with the knowledge that it is likely to cause death, but without any intention to cause death, or to cause such bodily injury as is likely to cause death).

He also has to pay a fine of Rs five lakh, the High Court directed.

"He doesn't deserve any sympathy," the judges said while Pereira stood in court and added that his bail application will be heard this afternoon.

    Mr. Shetty, Muscat. Please don't get emotional and respond like you have. If you read my statement closely, it talks about intention to murder. Salman Khan's intention was to murder while Alistair's wasn't. Alistair is guilty of drunk driving. He's guilty of callous and irresponsible behaviour. But he's not a murderer.

    The Maharashtra High court has therefore, rightly, found him guilty of culpable homicide NOT AMOUNTING TO MURDER. And one more thing, some of the the respondents to this matter feel that Alistair should get more than the usual punishment because he's rich.

    C'mon people, being rich is not a crime. In these days of globalization and freeing of the world markets, opportunities to accumulate wealth are many. More people are getting rich, more kids will have access to cars and sadly, more kids will have unrestricted access to drugs and alcohol.

    The conviction of Alistair Pereira by the Mumbai High Court and the media coverage of the case since last November and similar hit and run cases including that of Salman Khan and others had a positive impact on the Mumbai Traffic Police. They have started a campaign against people drinking and driving. With breath testing devices and initiating strict legal procedure against those who found consuming alcohol above the prescribed norms and driving, the police have succeeded to a considerable extent in reducing drunken driving.

    These measures of the Mumbai Police have drastically brought down the casualties in road accidents on Mumbai roads in recent days. This shows that if the law enforcing agencies such as the Traffic Police are proactive and take their job seriously without fear or favour many lives can be saved on the Mumbai roads and young people like Alistair Pereira need not be in the glare of the media for all wrong reasons.

    Dear Girish, Mangalore. Do you mean that Mr. Pereira fully drunk and drive at midnight UNINTENTIONALLY ? ! You mean someone forced him to do this ! He is very lucky. He should have given atleast 5 years x 7 people he killed, total 35 years. Then only these rich spoilt boys will understand the value of human life.

    Though this punishment make any good to the families of the dead, atleast it will tell others that they should be careful while driving. If the sentence had to be altered that he should work and feed the families of the deceased till the dependants lives or atleast their children start working (If they have any) then the punishment is meaningful.

    Imprisoning for 5 or 10 years or life only ruins the life of both, the killer as well as the dependants of the killed who lost their near & dear ones and perhaps the only bread winners. Also, just paying some money, which is NOT earned by the culprit himself, also does not make much of  sense because No one knows the value of the money till they earn it sincerely.

    You are missing the point, Esther. It's not about who killed animals or who killed human beings. It's about intent. Salman Khan INTENTIONALLY killed a helpless, defensless animal while Alistair UNINTENTIONALLY killed labourers.

    The difference is quite justified if you go by the law of the land. Alister did not commit the crime intentionally or with a motive. It could just happen by me and you for reasons beyond control. And about Salman poaching a animal am sure he knew the animal was an endangered species and the law of the land prohibits its killings.

    All the more Alister may be the son of a rich man but not a person who could influence the younger generation of this country.

    The Sentence given is very Less. For Seven Poor Labourers he should have been given 14 Years of Harsh Punishment (2 Years for each Dead Labourer) plus a compensation of Rs. 5 Lacs for each Dead Labourer. The Courts should pass Harsh Punishment for Hit and Run Case. Hit and Run Case has been a football game for Rich People and by giving them more years of Imprisonment we can bring down their ego to their feet.

    If the Judge can say Pereira does not deserve any sympathy, still he gives him only 3 years for killing 7 people. Then, why should Salman Khan get 5 years for killing an animal, which is mostly killed for meat anyway. Vow, the justice of our country. Isnt it great?

    This is a good news, though not to Mr. Periera's family but for those who lost their lives in this accident. This is going to be a lesson for all those young lads who drive in the influence of alchohol and drugs. Its time that the parents keep a tab on their children's activities and find time to spend a quality time with their children. We have just witnessed recently a kidnap case of Adnan and later he was murdered by his own friends...

    I am sure this will not bring back the life of those who died in this accident caused by Mr. Periera, but atleast gives him a chance to repent for what he did and correct his wrong doings.
