Dec 16 gang-rape: Juvenile is 'threat to society', should not walk free, say victim's parents


New Delhi, Dec 14 (PTI): With a day to go until the impending release of the juvenile convict in the 16 December gang rape case, the victim's parents today feared that he might be a "threat to society" and demanded that his mental condition be assessed before setting him free.

The convict, then aged under 18, is said to have inflicted maximum injury on the 23-year-old paramedical student, who died 13 days later, triggering a massive public outrage.

"We demand that he should not be allowed to walk free as he is a threat to the society. There is a need to assess his mental condition before releasing him, so that he does not attack some other girl, like he had killed our daughter," the father of the victim said. The Juvenile Justice Board had on 31 August, 2013 sent the juvenile to a remand home for three years. He will walk out of the home on 15 December.

Amid media reports that the juvenile has written to the home ministry that he should not be placed under a watch of an NGO after being released, the girl's father said, "It will be as good as setting him free. He should not be released at all. If at all released, his face should be shown to the world."

The Aam Aadmi Party leader Kumar Vishwas also expressed concern over the issue saying, "as far as the Nirbhaya case accused is concerned, with just days to go for his release, I can only say that he will pose a danger to the society as he will be living among us."

"No one has seen his face and now one doesn't know who would be his next victim," he said.

The Delhi High Court had on Friday sought the response from the Centre on BJP leader Subramanian Swamy's plea that the juvenile convict be not released till it is "demonstrably assured" that he has reformed himself and was not a menace to the society.

The high court had issued notice to the Ministry of Law, Ministry of Home Affairs and the juvenile through the JJ Board, and is likely to hear the matter tomorrow.

Amid apprehension raised by the victim's parents, the home ministry is contemplating asking the juvenile convict to sign a legal bond affirming good behaviour after his release.

The bond as per Section 107 of Code of Criminal Procedure (CrPC) will act as security for keeping the peace after his release from the juvenile remand home, a senior ministry official had said.

Union Women and Child Development Minister Maneka Gandhi had recently emphasised on the need to keep a "close watch" on him (juvenile) following his impending release.

The juvenile, arrested for rape and murder of the victim, was tried under the Juvenile Justice Act.

The victim, who was brutally assaulted by six persons, including the juvenile, in a moving bus in south Delhi, had succumbed to her injuries in a Singapore hospital plunging the country into grief.

    Three long years have gone by, and this monster 'minor/juvenile rapist' has now become a major.

    In these 3 years since the brave Nirbhaya's death, there doesn't seem to have been any major change in the legislation with regard to dealing with minor(?) rapist/s.

    One shudders to think of what could happen, if such a perverted criminal is once again freed and given freedom to prowl on hapless girls/women.

    People have become so fake and foolish that nowadays people have become intolerant towards innocents like mohammed Akhlaq and tolerant towards this monster rapists.Out of all 6 he was monstrous.It was
    because of ion of rod on the intestine which is done by him that led to her death.So he should be stoned to death.Why do Gov't want to save him.What's the point in keeping him alive.Where r the delhites,can't u see him as a threat???This is injustice.

    If released this individual will have no fear of the law let alone any hopes of him being reformed during the time spent in the juvenile remand home and yes he will continue to be a serious threat to society.
    This guy should not be released for atleast another 10 years during which time he must be made to go through programmes to develop a vocation and to reform his diabolical mind.
    Yes, chemical castration may not be a bad idea for such criminals.

    Releasing the culprit into civilized society is no problems at all, but disconnect the vein that makes his tool tight to carry out further rapes !

    He should live the rest of his life drooling at beautiful women but unable to do anything !

    In the Nirbhaya case, the release of the juvenile convict in the 16 December gang rape case,will be a threat to society.He will pose a danger to the society especially to Nirbhaya's parents and relatives, as he will be living among the people.No one has seen his face.
    The convict, then aged under 18, is said to have inflicted maximum injury on the 23-year-old paramedical student, who died 13 days later. He deserve the maximum punishment. Why because he has done the worst than the matured grown ups in this case.

    Govt. has delayed the amendment in the law. Isn't this a lesson or proof to change? Wake up BJP government and prove that you are concerned about the women of this country, some of them are your mothers, sisters, cousins, aunts and friends. Its a do or die situation. Change the law and keep this person in the jail. Let him learn and become a worthy individual.
