‘Avatar’ director James Cameron sued over alleged use of actor’s likeness for Neytiri character

Los Angeles, May 7: Acclaimed filmmaker James Cameron and The Walt Disney Company are facing a lawsuit filed by actor Q’orianka Kilcher, who has alleged that the appearance of the iconic Avatar character Neytiri was based on her facial features without her permission.

Kilcher, who portrayed Pocahontas in the 2005 film The New World opposite Colin Farrell, claimed in the lawsuit that Cameron personally admitted to using her image as inspiration for Neytiri, the character played by Zoe Saldaña in the Avatar franchise.

According to the complaint, Cameron allegedly extracted facial elements from a published photograph of Kilcher and instructed his design team to use them as the foundation for Neytiri’s appearance.

The lawsuit argues that the filmmaker and associated production companies exploited the likeness and cultural identity of a young Indigenous actor without consent, credit or compensation.

“This case exposes how one of Hollywood’s most powerful filmmakers exploited a young Indigenous girl’s biometric identity and cultural heritage to create a record-breaking film franchise,” the complaint stated.

Kilcher has also named Cameron’s production company Lightstorm Entertainment along with multiple visual effects companies in the suit.

The legal filing claims that Kilcher first met Cameron at a charity event shortly after the release of Avatar in 2009. During the meeting, Cameron allegedly invited her to his office and presented her with a framed sketch of Neytiri that he had personally drawn and signed.

The lawsuit states that Cameron also included a handwritten note saying: “Your beauty was my early inspiration for Neytiri. Too bad you were shooting another movie. Next time.”

According to the complaint, Kilcher’s representatives had earlier attempted to secure an audition opportunity for the Avatar project, but no role was offered to her.

“I never imagined that someone I trusted would systematically use my face as part of an elaborate design process and integrate it into a production pipeline without my knowledge or consent,” Kilcher stated in the lawsuit.

The actor further claimed that she became fully aware of the alleged use of her likeness only after a video interview of Cameron resurfaced on social media last year. In the clip, Cameron is reportedly seen referring to Kilcher while discussing Neytiri’s design.

“This is actually her … her lower face. She had a very interesting face,” Cameron allegedly said in the video.

The lawsuit seeks compensatory and punitive damages, a share of profits allegedly connected to the use of Kilcher’s likeness, and a public corrective disclosure.

The Avatar franchise remains one of the most commercially successful film series in history. The original Avatar film earned more than USD 2.9 billion worldwide, while its sequels collectively grossed over USD 1.5 billion globally.
