Udupi: Nejar quadruple murder - Accused Praveen Chowgule denied bail again

Udupi, Mar 31: The Second Additional District and Sessions Court of Udupi rejected the bail application filed by the accused Praveen Chowgule in the Nejaru mother and three children massacre case.

Praveen Chowgule applied for bail for the second time on March 13, and special public prosecutor Shivprasad Alva filed an objection to this application on March 27.

Arguments took place between Rajesh, the lawyer for the accused, and the special government prosecutor. After hearing the arguments of both sides, Judge Dinesh Hegde passed the final order on the bail application.

Justice Chandrachud quoted Kannada writer Dr Shivaram Karanth and said, “For the bird sitting on the tree, there is no fear of falling because of the branch breaking. The bird trusts its wings and not the branch.” He said, “We should always have confidence in our own abilities. As judicial officers each of you must keep these words of Dr Karanth in mind. You have been endowed with important responsibility to do justice without fear or favour. Please remember this without fear & favour when you decide to grant bail to people yearning for grant of personal liberty. Do without favour, but equally important to do it without fear. Have faith in your abilities & don’t hesitate to make bold decisions while adjudicating cases before you.”

    If you can't do the time, don't do the crime. But with Chowgule, he will get bail in good time as soon as his name starts fading from public memory. Gold smuggling is way too important business and eventually everyone involved will support each other - it is about sustaining the biz model than crime and law of any land. A person involved in the killing of 4 is applying for bail; is this not a joke or Chowgule and his cronies celebration of trust on Indian judiciary?

    Mayyaji; with all your wisdom, how are you so damn sure that the "accused" is the real culprit? Secondly; if the evidence is "water tight", this accused will not be able to escape the noose for having committed such a horrendous crime!! Courts want clinching evidence; no doubt so many innocents are languishing behind bars.... bulldozer justice....extrajudicial etc etc....please note this is an unbiased personal opinion, kindly do your own independent study...

    Unless the chargesheet filed by the investigating team has clinching evidence against the accused, he cannot be denied bail for long!! This is an unbiased opinion based on my personal perception!

    Why kept in jail in Bengaluru since months. He keeps asking for bail. Why there is no fast track to solve this case. He needs strict punishment and death sentence as soon as possible. Why waste time of govt police to feed him and take him up and down from bengalore to udupi. He needs punishment like Saudi law. Cut one of his parts of body specially his two hands where in he killed those innocent people due to his lust on their daughter. Shame on our Indian law.

    @MB, DGO, MANIPAL; How are you so sure, he is the real culprit? Even in medical practice you'll ask and give "evidence" (USG, CT, MRI etc) based treatment; then don't you think for a case of such a serious magnitude, strong evidence is required before a judgement is passed?

    Dear Rudolf, I must express my disagreement with your statement. If it were your own family member enduring such circumstances, would your response remain the same? There exist numerous pieces of evidence illustrating why the court cannot swiftly execute him. On the day in question, an auto driver dropped him off near his residence. Furthermore, a female neighbor reported being threatened by him. Let us not forget the grim reality: he mercilessly took the lives of four individuals from the same family. Consider placing yourself in the shoes of Ms. Aynaz's father. How would you cope with the profound loss of four beloved family members? I am confident that the victim's grandmother can identify Mr. Praveen Chowgule; after all, she was present and injured during the assault. The case is clear-cut; he must face the consequences. Were I in Aynaz's father's position, Praveen would not remain on this earth.
