Centre's intervention in judiciary dangerous, says former SC judge Santhosh Hegde


Mysuru, Jan 24 (IANS): Former Karnataka Lokayukta and Supreme Court judge, Justice N. Santhosh Hegde (retd) on Tuesday termed the Union government's intervention in the appointment of judges and in the judicial system incorrect and "dangerous".

At an interaction programme with media, he underlined that the executive should not intervene with the judiciary. "This kind of intervention is a dangerous development," he warned.

"The politicians will not have any knowledge about the judiciary. If this is the case, it is not tenable to intervene in the appointment of judges or in the matters of judiciary," Hegde said.

"I didn't know much about the society before becoming Lokayukta. Those who become rich will get all the respect. Those who come out of jail are received with grand welcome," he said.

Hegde further said that there is danger of the country getting divided on the lines of religion and language. However, one can't say when it is going to happen, he added.

"Corruption is rampant in the country. The representatives of the people are having the feeling of being owners of the people. The politicians are just talking about corruption and making allegations against each other. No one wants to correct it," he said.

If this situation continues, people will rebel against the system, he said, but added that he wouldn't know when this situation will come.

"I got many awards, recognitions. I have donated money to organisations. I have not accepted money from anyone. I own an apartment and nothing else. We have to be clean," he said.

Hedge also said that the delay in disposal of cases should not happen, but society is getting a different message as mediators are being approached for solutions.

    The judiciary is as corrupt as the other pillars of democracy .. The testimony for this statement is the number of pending cases in all courts from the supreme court to the local court. Mr Hegde needs to comment on this. It is swindling money from the poor man ...who will die fighting a court case,by mortgaging his enitre wealth to pay the advocates and the jury to get a date for next hearing ..and this goes on and on . A poor convict from a poor background is denied bail because he does not have the resources to fight for him .. While a high profile Rich person is immediately granted Bail (even at mid night) for murder cases too. out of 100 .80% of the time this is the truth we see .

    All said and done, IMHO, the administration has virtually interfered in every department, which are supposed to act autonomously! Recently to block one news report the I&B people have used the emergency powers! So, if you see the situation broadly, it sounds dangerous in the long run! Yesterday, Jan 24, there was an editorial in the Deccan Herald, Mangalore edition, titled: "The questions won't go away"; please read it and analyse for yourself objectively, in an unbiased manner and conclude! Jai Hind!!

    Two things caught my attention, Retired Justice Hegde mentioned that "there is danger of the country getting divided on the lines of religion and language. However, one can't say when it is going to happen, he added." AND "If this situation continues, people will rebel against the system, he said, but added that he wouldn't know when this situation will come." This is not a mere prediction, but there are sound possibilities the way matters are being taken care of, the above is bound to happen. On the lines of the famous Hollywood actor Morgan Freeman....... “Maybe if we underpaid politicians and overpaid teachers there would be smarter people and less shitty laws.” Looks like the wait would soon be over!

    India require Qualified MP's, MLA's, Academics, historians and Wise Men/Women to represent people in Parliament and State assemblies. Nominated members too should be qualified in all fields and to represent people for their grievances. What is happening now is most of our MP's, MLA's, MLC's and Nominated members some are having criminal backgrounds, various court cases against them, business interest of their own for Government contracts, corrupt and vote on party lines and don't use their mind to express their opinion on various issues of concern!?

    Best of the judges should be appointed -- who will do justice without fear or favour---- But does not happen sadly---- Problem is Many judges look for post retirement assignments -- Governor -- Heading some committee etc etc -- Judges in collegium system known to indulge in nepotism --- Last 20 years appointments there is evidence-- to this -- NOT ALL BUT GOOD EXAMPLES -- JUDGES APPOINTING JUDGES -- many a times passing orders in high courts favouring for future elevations etc -- SO A BOARD WITH UNBIASED TOP LEVEL MEMBERS SHOULD APPOINT -- ALONGWITH LEADER OF OPPOSITION -- etc -- IF JUDICIARY IS COMPROMISED THEN THAT IS THE LAST BASTION __--- COUNTRY WILL BE IN A MESS --

    In a democracy, everyone has an opinion. Like how Mr, Hegde has an opinion on actions of the elected government. At the heart of this matter is real power conflict between Judiciary and the Executive. Legislature is just the joker in the middle. In all democratic countries, except India, appointments to highest courts are always vetted by the people (Legislature). Not sure, why we cannot bring in a transparent system of vetting appointments to all constitutional positions.

    It is a great pity that the experts and well wishers of our nation are questioned by elected goondas, murderers and their supporters in the current times. Of course we are ruled by peoples power since ours is a democracy but we should not think that everything can be handled by common man, i.e. by uneducated and economically weak common man. That is why our Indian constitution was written by Baba Saheb Ambedkar, common man could not have visualized it, so handling everything by common man or his representative is senseless. Some of us think that we can change the constitution, we can execute our own narrow minded policies and systems. Let us understand this and give this responsibility to experts in Law, engineering, education etc. We can not solve all problems single handedly. That was tried by autocrats and dictators in world history and results are before our eyes. It s a foolish thought and should not be entertained by any educated citizen. Jai Bharath.

    while the elected reps are accountable to the people and judged every 5 years, how are judges held accountable? why shouldn't their personal wealth be made public too? we can't have different standards to different organs of the constitutional body! its one thing to make sweeping judgements which affect everyday life of citizens but not to held accountable.

    Judiciary is unelected. So there must be some accountability to the citizens of India. At the moment it appears that there is no accountability. So, some changes to the whole setup is a must. Of course, then we run the risk of political interference in various appointments. Either way, it is problematic.
