Mangaluru: Elderly couple lives without electricity and water for past 15 days!

Mangaluru, Oct 23: In a shocking incident, it has come to light that an elderly couple which resides in a luxurious apartment in the city, has been forced to spend days without water supply and electricity since the last 15 days.

Shantharam Prabhu and his wife, Veena Shantharam, have been residents of a luxurious apartment complex in city. When Shantharam was working in Mumbai he had booked a flat in this complex. First of all he did not get the key of his flat within the time limit agreed upon, and the flat which he got was not in accordance with the blueprint. But, to avoid the legal hassles, old Shantharam agreed to occupy the flat which the builder had provided to him.

As per the agreement entered into at the time the couple started to live in this flat, Shantharam had deposited one lac rupees into the account of builder. As a deposit for maintenance, the builder had collected a total of Rs 3.6 crore from residents of the apartment complex. But six months back, all of a sudden, the builder formed an apartments’ owners association and sent notices to all flat owners to pay maintenance charges every month to the association.

Shantharam questioned this and told the association that he already had deposited one lac rupees towards maintenance at the time of purchase his flat and refused to pay money illegally, as this fact was not mentioned in the agreement. He put a demand that if he gets back his deposit he was prepared to pay maintenance fee.

After a six-month tussle over paying maintenance charges, the association recently disconnected the water and electricity supply of Shantharam’s apartment. Since the last 15 days, the elderly couple has been spending their days without light and water. After electricity supply was withdrawn, the couple used to keep their medicines and food in neighbors’ refrigerators. After coming to know about this, the association threatened his neighbours and instructed them against helping the elderly couple in anyway.

After the supply of electricity was stopped to his apartment, Shantharam fell down few times when moving around at night and while the using toilet. The injuries on him bear testimony to the horrible condition in which the couple has been living. Both Shantharam and Veena suffer from high blood pressure as well as diabetes and are under treatment. But now they cannot store some medicines and milk in refrigerator because of disconnection of electricity.

“Regarding this we have already complained to Mescom, City Corporation and Kadri police station stating that we are paying electricity and water bills without fail. But no one is showing interest in our matter. The Supreme Court itself had banned the disconnection of water supply and electricity and stated it is deprivation of the fundamental right to livelihood guaranteed under Article 21 of the Constitution. Definitely if we go to the court we will get justice. But our bad health and age do not permit us to do this. But at any cost, we are not prepared to pay money illegally to anyone,” says the couple.

    What about when the association isn't registered? What about the collection of sinking fund? is it to be collected for a lifetime till the owners leave the building? Is it to be collected only for a particular period of time? Or for a particular case regarding the building?

    Home Owners Associations (or Apartment Owners Associations) should have the right to evict the occupant and rent out the unit to recover the unpaid bills to the Association. This is the law in developed countries. Associations doesn't have to go through lengthy court procedures like laws of Cooperative Societies in India. Association dues are first to be paid before paying the mortgage, if any. In this particular case, the owners have not paid Rs.1 lakh to the association but to the builders. Therefore, the owners have to recover the balance of maintenance from the builders separately. However, it is absolutely wrong on the part of the Association to disconnect the basic amenities thereby endangering the lives of the residents. Be care in dealing with builders. Get everything in writing.

    Really bad thing , it should not happen . Though they refuse to pay maintenance charges, should convince them as the world is going. If not possible the President could go for legal support. Otherwise power cut, water cut, is not a solution.
    Each and everyone who wish to purchase a flat, should know the terms and conditions of the apartments rules. If once they compromised and agreed to those rules, they should obey.

    My sincere appeal to elderly couple, kindly do not get in to tussle with the apartment owners association. Once the Association is formed, association will become the head of the building as the DOD is registered as per Karnataka Apartment Owenership act 1972. They should understand that they have paid One lakh rupees to the Builder, not to the association. Since the builder already washed his hands by forming the association, its the responsibility of all the owners of the flat to comply with the terms set forth by the association time to time.

    What if all the owners do not pay any maintenance ? then who will pay the cost towards security, common areas and facilities ? People who residing there are not fools to forgo 3.6 crore of rupees. I am sure there must be valid reason behind it. I am of the opinion that this building is completed about 3 years ago and the association was formed only about 6 months back, then the question is who was looking after the affairs of common areas and facilities for all these years ?

    may be the builder himself through the advance money collected through the owners by collecting Rs one lakh each which might have got finished by now. That is the reason association is formed now, and the knowledgeable and educated people took the responsibility of the association. there are many advocates , engineers staying in the same building , even they are keeping mouth shut means somewhere they are convinced that builder has washed off his hands and its the time for the owners to look after it.


    If at all there is any doubt about one lakh paid by the couple to the builder, They should first pay all the dues to the association, and then file case against the builder, if they feel they have been looted instead of suffering like this. alternatively they can also convince the association to file a case against the builder which will have heavy weight. But not paying monthly maintenance to the association will not serve any purpose.

    My suggestion not to go for flat after retirement ages.

    Buy 5 cents land in village area and build small independent house and have breath healthy atmosphere and can meet nice cultured people.

    But in individual house there is no safety for aged people. Very very risky. If you read the news in daiji as well as newspapers most of the time the individual houses are robbed or attacked

    Flats and apartments are much safer with CCTV cameras and security guards.

    This is the fate of all the flat owners. You go to any flats built by the Real estate people. They promise that they will maintain the complex. They take money as deposit and at the end of two years say that the interest from the money is not enough to service the flat and ask the owners to form a association and register it and manage themselves. If you ask for the deposit money the builder will say it is spent. So the owners form committee , start collecting monthly maintenance charges from the owners, make a sinking fund and keep the show running.

    I have seen one of the builder in posh locality in Mangalore built a housing complex sold flats and building a pent house on roof top of the building illegally and living there stealing electricity, water etc etc .The owners committee finds this out and confronts him.The MCC authorities , say that if it is illegal they have to demolish the building. Now the flat owners after spending the money for the building are not able to take action against the truant builder. There is another case in Mangalore where a well known builders sold the children play area to another owner of the flat as a parking lot and owners association could not do anything.

    If the MUDA authorities look at this in all flats in Mangalore ,then most of the housing complex need to be demolished. MUDA knows this and as they are palmed they do not discuss or inspect. There is a situation in one of the building complex where the owners have paid the money to the builders ,but the builder has not handed over the flats to the owners. Some of the owners spent their money on own and occupied the flats without having occupancy certificate.

    This is the fate of Mangalore and the real estate industry ,The old people are only a fly in this Builder- MUDA-Poiltician nexus, The local MLA who is from the same community as the house owner can help but he will not help due to political reasons, because he does not get publicity for such a small work

    This looks like false story. I have seen this Building. It’s a luxury apartment.

    Those who can’t afford the society charges should not have purchased the flat in that luxury building. They should have purchased a small tiles house where there are no lifts, no swimming pool, no garden, no sweepers, no security, no lighting, no GYM , No club house, no car Parking.. I you cant pay please sell your flat and go to small independent tiled house. It seems this lady is problem creator and publicity monger. I think money is not a problem for this lady. If her husband is diabetic he has to take medicine and walk every day for one hour. Not paying the society charges not solution.

    The Secretary and the persons who have done this are liable for Criminal Proceedings by the elderly couple.. They have no right to tamper with
    MESCOM or government installations just because they are privy to the electrical room keys.. No individual has powers to act in such a manner.. The high Court of Karnataka has come down heavily in a strongly worded judgement for similar acts from other societies /Associations...

    The society can disconnect only "paid" amenities. Mescom, Drainage is not part of the society and we pay muncipal tax seperately.

    Pls Note : the Kar HC has said in its order that the JMFC ( Munsiffs ) Court has no jurisdiction to try Apartment / commercial bldg society related cases and only the District Judges Court can take up the matter. Its a remarkable Judgement.

    Sad to hear the harassment of this old couple. The old couple member can approach court so as the association. The Association has absolutely no right to disconnect the electricity and water connection which is given by the Government Departments. The only authorized people who can disconnect are respective government agencies who have provided the connection subject to defaults if any. This is a straightforward criminal offense and the people involved in the association can be arrested and compensation for the damages will have to be borne by them. A complaint to the police has to be done. But, prior to that, you need to approach the agencies who have provided the electricity and water connection to ascertain whether the association has obtained their written permission to disconnect. What Government has provided, a normal citizen has no right to deprive this facility to any person/s.

    Stop giving nonsense comments. Let us be constructive. Where are senior citizen rights? Where are are basic human rights? I cannot believe in Mangalore something like this happening? Most of the building associations are looting residents or in every building there is one flat owner who is a trouble maker. Worst is car parking issues. I want to know when unfair things or if carpark area is not properly allotted where should I go for clarification. What about Watchman for everything he needs commission. If a tenant gshifts from one flat to another in the same building Watchman needs commission. Who can stop this!!!

    Karnataka state is ruled by congi & jds party. also note that India is a democratic country. For administration purpose it divided into states, then district/taluk,municipality,panchayat etc. maintaining the law & order is the main job of state govt. along with that administration also state govt responsibility. Central govt cannot involve in all these case. Incase the state govt is totally failed to maintain law & order and administration then central govt can dissolve the assembly and impose president rule. As per your comment, if you blame central govt that mean central govt is failed to impose president rule. I hope you understood the above points. Still date I thought that you are a educated person but you are totally zero. That is the reason you are blaming central govt for everything even for fault of panchayat clerical staff.
