Centre sets up online gaming authority, new regulatory regime from May 1

New Delhi, Apr 22: India’s online gaming sector is set to enter a new regulatory phase, with the Centre formalising a dedicated authority to oversee platforms, games and compliance under the Promotion and Regulation of Online Gaming Act, 2025.

According to a government notification, the Online Gaming Authority of India (OGAI) will come into force from May 1, bringing online gaming, including esports, under a structured regulatory framework.

The authority will be chaired by the Additional Secretary in the Ministry of Electronics and Information Technology in an ex officio capacity, and will follow a multi-ministry oversight model.

Its members will include joint secretary-level officials from the Ministry of Home Affairs, Department of Financial Services, Ministry of Information and Broadcasting, Ministry of Youth Affairs and Sports, and the Department of Legal Affairs, reflecting the broad impact of online gaming across digital content, finance, law enforcement and youth engagement.

The OGAI will function as the central regulator for online games and is expected to introduce a formal registration and classification system for platforms and games operating in the country.

Gaming platforms are likely to be required to comply with new approval, listing and operational norms, while the authority will also have powers to issue directions related to data retention and regulatory compliance.

The move is expected to tighten norms relating to user data protection, platform accountability and transparency in the rapidly expanding gaming ecosystem.

With the law set to take effect from May 1, companies operating in India will have to align with the new framework. While larger gaming firms may adapt more easily, smaller operators could face challenges in meeting compliance and registration requirements.

The new regime is, however, expected to bring greater clarity to a sector that has grown rapidly amid regulatory uncertainty, while potentially boosting user trust and creating a more structured environment for growth.

The launch of OGAI marks a significant shift in India’s approach to online gaming regulation, balancing industry expansion with stronger oversight of operations, data and content.
