Supreme Court seeks ‘help’ to debar MPs, MLAs from practising as lawyers


New Delhi, Feb 17 (PTI): The Supreme Court on Friday sought the assistance of Attorney General K K Venugopal in a plea seeking to debar lawyers from practicing while they are members of Parliament or state Assemblies.

The bench of Chief Justice Dipak Misra and Justice A M Khanwilkar sought Venugopal’s assistance on a plea filed by lawyer and BJP leader Ashwini Kumar Upadhyay, who cited the Bar Council of India’s Rules that barred lawyers from practising while they are lawmakers.

The court slated the hearing for March 12.

The petitioner has contended that legislators who also practice in court were in a conflict of interest situation because as lawmakers, they are doing many things that have a bearing on the functioning of the judiciary.

Citing a serious conflict of interest, Upadhyay contended that as Parliamentarians, practising lawyers have the power of voting on the impeachment of judges of the Supreme Court and High Courts, and such a situation may allow judges to feel beholden to them and to oblige them.

“A salaried person and particularly a public servant cannot practice as an advocate, but legislators are practicing, which is violation of Article 14 of the Constitution. Legislators take fee from litigant and salary from the public exchequer, which is professional misconduct,” Upadhyay said in his plea.

    I guess lawyer and BJP leader Ashwini Kumar Upadhyay is a no match for the other top lawyers who are serving as MP's and MLA's this is why he want the SC to Debar them while they are serving as members of Parliament or state Assemblies. Ashwini Kumar Upadhyay don't you think It would be wise to Debar lawyers from becoming Ministers, MPs and MLAs? or else bar all Ministers, MPs and MLAs from legal practice while they are lawmakers.

    I asked the Lawyer to provide me a payment receipt for the payment i made in cash, but for my surprise, i have been called by police after 3 days in police station by filing a fake complaint against me. This is what has happened to me recently.
    Can we believe these Criminals? Is this not a Terrorism?
    Can anyone expect justice from these type of Criminals? Innocent people go to them by thinking they give us good advice, but it's not true at all. They will make your life complicated if you don't have any clue.
    They are only there to mint money from innocent people nothing else.
    It's the fault of the government which is making all of us suffer in the hands of all these criminals.
    GOD is the only option for us, because rest all the justice system is in their hands.

    Lawyers are the biggest liers. They need their service charges only in cash, they won't provide receipts even if demanded. There are many Lawyers who just terrorise people.
    Government has to take serious measures, Lawyers services should be limited. They are minting money like anything.... They are the most corrupt lot in the country.
    Poor can't afford to go to these corrupt people due to their exhorbitant charges.
    But there are small number of good Lawyers too.... But most of the Lawyers are corrupt.

    ..kudos to Ashwini Kumar Upadhyay...KAPIL SIBBAL/SINGHI/KURSHID/CHIDU minted billions ..all are corporate lawyer (incl., wife some of leader)..its ridiculous to say their profession wont influence judgement..all are powerful ministers in congress Govt & have political immense influence ..good move..for fare justice..
