Ensure no Muslim youth is wrongfully detained, Shinde writes to CMs


New Delhi, Sep 30 (PTI): Home minister Sushilkumar Shinde on Monday asked all chief ministers to ensure that no innocent Muslim youth is wrongfully detained in the name of terror.

In a letter to chief ministers, Shinde said the central government has been receiving various representations on alleged harassment of innocent Muslim youth by law enforcement agencies.

"Some of the minority youth have started feeling that they are deliberately targeted and deprived their basis rights," he wrote.

The home minister emphasised that the government is committed to its core principle of combating terrorism in every form and manifestation.

"Government has to ensure that no innocent person is subjected to undue harassment," he told the chief ministers.

Shinde asked the state governments to constitute special courts in consultation with concerned high court for trial of terror-related cases, appoint special public prosecutors for trial of these cases and give priority to terror cases over other pending cases.

The Home Minister said law enforcement agencies should be satisfied with regard to communal and social harmony while ensuring zero tolerance for terrorism.

"Strict and prompt action against erring police officers where there is malafide arrests of any member of minority community, wrongfully arrested, person should not only be released immediately but they should be suitably compensated and rehabilitated to join the mainstream," he said.

In May, the central government has set up the 39 special courts under the NIA Act to take up terror-related cases.

Minority affairs minister K Rahman Khan had also written to Shinde expressing concern over "wrong arrests" of Muslim youths in different parts of the country in terror cases.

Apprising the home ministry of the concerns expressed by various Muslim bodies that the "draconian" provisions of the Unlawful Activities Prevention Act can be misused against minorities, Khan had proposed setting up of special courts to ensure speedy trial of all terror cases.

Fully backing the minority affairs minister's suggestion of setting up of special courts, Shinde wrote back to him saying, "You have my assurance that this will happen".

    Whenever there is a fresh terrorist attack anywhere there has been a tendency for the police in India or anywhere in the world to profile suspects with respect to their race or religion depending on the identity of the culprit persons who were involved in previous similar attacks . It is known that when terrorism by pro-Khalistani militants was at its peak in Punjab, all young men from the Sikh community were always viewed with suspicion both by the police force and even by society. Similarly now because some ‘misguided’ muslims have committed terror attacks the entire community is being victimised. This is a bad tendency and highly undesirable. In future if attacks are from some other religious community or group then all people from that community or group may have a shadow of suspicion cast over them whenever there is a new attack.
    PEOPLE MUST UNDERSTAND THAT A TERRORIST HAS NO RELIGION, COLOUR, FACE, GENDER, LANGUAGE, RACE OR NATIONALITY. A TERRORIST IS JUST A TERRORIST – A CRIMINAL AND NOTHING ELSE !
    Having said this there is also a tendency for groups or political parties to exploit this situation to their advantage.
    I cannot say for certain whether in this case Home Minister Shinde made this directive to genuinely prevent victimisation of muslim youth or whether he did it solely with the intent of gaining from the muslim vote bank. If done solely for electoral gains then Mr. Shinde is wrong but if done out of genuine concern for protecting wrongly accused muslim youth then I think it would be unfair to target Mr. Shinde. However, knowing that elections are round the corner Mr.Shinde could have been more cautious with his wording as the law is equal for all communities and as any statement from now on will be scrutinised minutely to see whether it is being done only for electoral benefit. Same caution must be exercised by the opposition party too. Note that politics of polarisation is also a form of ‘vote bank’ politics. India must stay united !

    This is sheer a statement and I am sure nothing is going to happen to the youths detained wrongfully. Dear friends when HM of India says something it is not a baseless statement, I agree there are few terrorist among muslim youths who are brainwashed as in other communities, but there was a planned conspiracy against the well educated muslims youth and hope all will agree on this and most of the friends here misunterstood wrongfull detaining with deatention with solid ground. The list provided by Prakash D'souza is are few samples, there are thousands muslim youths wrongfully detained without producing to the court in accrodance with the law of the land and we should condemn this irrespective of religion. Dear Muslim brothers the fast track court, seaperate university etc. are not going to happen sooner or later let them to give us the rights provided under the constitution that will be far enough and we ourselves should growup and educate oureselves rather looking for spoon feed from others.

    Dear Ravi B Shenava, Mangalore,I appreciate your comments.No one is guilty until proved otherwise.I would like to add that many terrorists arrested are Muslims.
    If so then what you would say for thousands of innocent Muslim boys detained for several days during BJP rule and not produced at court for many days.
    What would you say for the Police who run their own custody houses at guest houses arranged by RSS leaders to keep the innocent or accused for many days before producing them at court.
    What would you say on the special Police at every stations who are just interested in chasing Muslim boys and arresting them just on a phone call by BD goons.
    The Police also used the accused or arrested victim as a bait to arrest more boys.They beat the accused and then admit at a hospital and then arrest the boys who visit the that accused patient.
    There should be impartial system at the Police System to conduct enquiries on crimes. The situation has reached to an extent where a Muslim youth arrested means it is free Biryani for all constables and if the accused is from a BJP/BD/VHP/RSS then all constables end up answering phone calls from political leaders.
    I am worried what will happen in the future when the events will turn other way round.

    I whole heartedly welcome the decision of Shinde in this regard. Friends/ Brother and sisters., Let me put some point before you.

    1) In Makkah Masjid blast Case, 20 Innocent Muslim youth were put behind the bars, They were innocent but the police use 3rd degree and confessed the crime which they have not comminted.
    2) In Samjautha Blast case. 15 innocent Muslim were arrested.
    3) In Malegaon, 12 innocent muslims were arrested. Here when the real culprits were caught, Court questioned the police about the proof that were produced in the behalf of innocent muslims which led them to jail, Those all proofs were bogus proof created by police.
    4) In Ajmer case, 10 Muslims were arrested.
    5) Recently 8 Top Muslims Students were arrested like DRDO Scientist,
    Journalist, Engring Student just on a suspect and later released since no evidence could be proved against them.

    Clearly shows that some vested-interest people and organizations is trying to malign the muslim community for supporting their hatred agenda and ruining the innocent muslim life and giving the bad name for their community.

    Since muslims are easy and soft target, it becomes easy to target them in big cases like terrorsit cases.

    I being a christian and i am writing this because I have being staying in the gulf for more than 15 years and it has given me everything I need and in return I would like to help this community atleasy by giving the true comments about this coomunity. I really Feel This community has faced harsh days a lot. Requesting people from Christian, Hindus and all like-minded people to support muslims as they are also like us.

    Truly appreciate your comments. In my 20 years of gulf experience, I haven't come across a single muslim who had any characteristics of that of a 'terrorist'. For that matter, pakistani's make a good colleague at work place, fun to deal with unlike some of our own people from north-south. Ofcourse, there are mis-informed or brainwashed people on either side of the border which we cannot deny.

    Shinde cannot dictate terms on how the law of the land can be applied. Suspected person irrespective of any caste or religion would surely come under intelligence and police scanner. Judiciary will decide how to punish the guilty. It is vote bank politics being applied to gain sympathies from certain section of the community. One can imagine the wisdom of Congress to bring on board the Ordinance on criminal law makers. The general perception is that we lack a stable Central Government to take our country forward in the right direction to safe guard our national interest.Home ministers unwarranted comments really hurts the sentiments of the people of Greater India.

    Thanks for agreeing Sachidanand. Initially for a moment I thought you had a change of heart and were becoming a Congress supporter. Anyway, its good there is atleast something we can agree on. However, I must add that it would be more appropriate to have said that as per 'your opinion' this is the 'first time' I said something correct.
    What I am saying is that from my point of view I always believe that what I express is correct (based on the information I have at the time) whether you agree or not and similarly from your point of view you may believe you are always correct whether I agree or not. That is the beauty of a democracy.

    Unfortunately it is the muslim innocent youth who are always targeted. The case in Andhra Pradesh where innocent Muslim youths were arrested, tortured and then released after 6 months after finding them innocent. This has a big impact on their lives and no one is concerned about that.
