Udupi: Student moves high court seeking to declare Hijab a fundamental right

Udupi, Jan 31: A writ petition has been filed in the Karnataka high court on behalf of Resham Farooq represented by her brother Mubarak Farooq.

The writ petition has been filed with a prayer to declare that the students' right to wear a hijab is a fundamental right guaranteed under Article 15 and 25 of the Constitution of India and is an essential practice of the Islam religion.

The petition also seeks to permit the students to attend classes wearing hijab, without any interference from the college administration.

The petition states "On 28.12.2021, the Government PU college for girls, Udupi district, denied entry to 8 students who practice and profess the Islamic faith. These students were denied their fundamental right to education as they were wearing a Hijab. The wearing of Hijab is a part of the essential religious practice in the Islamic faith. It is a fundamental right that ought to be protected by the state. The actions of the college administration are unconstitutional, arbitrary and exclusionary in nature."

Shtahabish Shivanna, Arnav A Bagalwadi and Abhishek Janardhan are the advocates in this matter.

The first hearing is expected to be held by the end of this week.

    I have silly querry...does the college/institution/government specify any headgear as part of the prescribed uniform? If so what happens to the turban wearing sikh students? If the students wear any headgear while adhering to the prescribed uniform - then is there any problem for Hijab/safron shawl/ turban etc? Can anybody please enlighten the readers of this forum?

    Fundamental right to practice religion in School of all the places? And wearing hijab to school is commensurate with practicing Islam in School? These radicals have historically used court and loop holes in our constitution to push their hidden agenda. It started as issue of uniform and now it has manifested into fundamental right to practice religion. Some lawyers are going to be enriched by this extra-curricular activities of few students. Wonder who has the money during this pandemic to spend like this?

    If a school prescribes a uniform , then every student must follow it irrespective of cast and religion . In this school only a 6 out of 100 students of a community is created this issue, So it is clear that it has nothing to do with religion, Iam sure that there is some terrorist group backing up these students. From last so many years there was no such issues, but now it is happening in many places in the country

    School uniform is a must but how the head cover or a veil comes in ones studies and educational standards. If our educational system expect 100 pct discipline from students and moral and ethical behaviour in their future life, then how and why in our country rape culture and communal hatred is crossing all the limits normal human behaviour.     I agree with the dress code inside the schools and Colleges. Everyone must follow. But my point is in some religions they don't wear any dress. Is there any dress code for different religious like, Hindu Christian, Muslims JAINS specially. When any body coming in public place they must come on decent dress. Whether priest or anybody.     The girl should win. An educational institution, that too run by the Government, cannot make arbitrary rules in the guise of uniformity. The girls have not committed a crime by putting on this head covering. In my opinion, a school should not have a right to dictate a uniform. All that is needed is modest clothing.     In case of triple talak only women of Karnataka and some southern states opposed while in the northern states they overwhelmingly supported.     Will you kill all those muslim ladies who don't wear a hijab? Stop your natak and follow the rules of the institution. Study well and become self reliant. These Mullahs and his henchmen must be deported to Afghanistan so that this part of planet is safe and peaceful . Meanwhile the honorable courts must admit their plea and give partial judgment to stop their studies till the full judgment is delivered by the concerned bench. No attendance should be given to such students who are adamant in wearing hijab in educational institutions and barred from undertaking exams .
