Distressed Family Pleads to Set Free Lohitaksha from Dammam Jail

Saudi Arabia, May 16: The family of Lohitaksha Devadiga ( 51) are in intense sorrow and have spent sleepless nights eversince he was imprisoned for his inability to pay the huge fine imposed by Dammam Court here.

The Court ordered him to pay damages of Saudi Riyals 80,000 (around ten Lac Indian rupees) after he met with an accident in his heavy vehicle while he was discharging his employer’s duty.



Lohitaksha basically hails from Derebail-Konchady, Mangalore. Holding a Saudi residence permit (Iqama) no. 2047500596,  he had been working as a crane operator since 15 years in a Block & Tiles Company in Dammam, the eastern province of Saudi Arabia. He was very efficient and earnest in discharging his duty having a clean track record without any sort of mishaps.



But unfortunately, an accident took place when he was operating the crane in September 2009. It was alleged that the accident caused damage to the employer’s property though there was no harm to the lives of  individuals. It’s worthwhile to note that he was successful in preventing injuries and casualties to others in the vicinity.

The police authorities took him under custody and charged him with the case of damage to the crane. In January 2010, the case was decided in Dammam Court and found him liable to pay the required sum of money as damages. His sponsor was neither kind nor helpful to get him out of the tight spot, insisting for the decreed amount despite Lohitaksha’s long services under his sponsorship. He remained in Dammam jail for eight months as he was  unable to pay the amount.

Speaking to P A Hameed, advocate and Daijiworld correspondent from Saudi, Rajani, daughter of Lohitaksha said, "I contacted my father’s employer directly over telephone, but it was of  no use as he was demanding for the said amount to be paid which is unaffordable for us and he was not in position to hear our grievances at all  finally, he severed the call”.

She further informed that her mother was hospitalized recently due to the increased tension related to her fathe and around five lac were spent for her medical treatment. "The doctor advised us to bring my father back which would help in her recovery  from mental distress. Further, my sister’s scheduled marriage was also cancelled due to this; we are really in utter shock and hardship as we are helpless to deal this case directly with the concerned authorities”, Rajani added.  

She urged various social organizations in Saudi Arabia including other gulf countries to help her father. Besides, she petitioned to the Indian Embassy in Riyadh requesting it to actively involve in the issue. Though the Indian Embassy approached the employer, there was no  fruitful result from them to comfort the hapless family. Instead, their response was said to have been dispiriting to the family as well as the whole Mangalorean community. Organizations like MASA in Dammam-Khobar and other associations, social workers in the Kingdom including UAE Kannadigas under the leadership of Sarvotham Shetty, are working hard on the matter. 

Lohitaksha’s family has now been worrying about his condition in the jail as he is a patient of hypertension.  His wife got bedridden because of her worry being snowballed every day. They are spending their sleepless nights without knowing what to do next. If at all, the decreed money has to be paid unless his employer doesn’t relinquish it, then they cannot afford to pay such huge amount. They are, in fact, inevitable to seek financial helps from social organizations, philanthropists, donors and others in the gulf countries and other parts of the world.

Hence  Daijiworld requests the readers  to extend a helping hand. Indian foreign minister, S M Krishna, law minister, M Veerappa Moily among other laeders are requested to discuss about the case with  Saudi authorities and help to set free Lohitaksha from prison.

The only ray of hope for Lohitakhsa's family is help from generous people.

    Its quite sad to see Indians are victims!I worked in Dubai over 10 years. I find Arabs are nuisance and for money they get dirty..they just do not care..mark my words.. Do not know the human values, they do not care for human feelings.I wonder if the sponsor of this dear man has anything called heart..? My advice is Lets help him through payers and financial support.What if this kind of things happens to one of us...? Please tell us what we can do and how?

    This is total Andha Kanoon in Saudi Arabia. No where in the world such baseless law exists. I wonder court has passed the verdict thru vasta. Any construction machine in operation requires a full insurance and the owner knew that the crane is operated by a expats so no insurance required. If found damage the Indians would get together and contribute. We as Indians of all faith will stand together to help no matter what may come. But the case should be fought legally and get deep into the matter on how the law passed wrong justice. Take this case to the human right and fight. We all pray all goes well and justice prevails.

    I think the crane is old and insured for third party liability. IBRAHIM ABDULLAH MOHD AL BIBI must be a bankrupt man. Approaching higher authorities will take a lot of time by the time Lohitaksha is released. I am sure SR 80,000/- is not a big amoutn for us Mangaloreans to contribute as similar amounts were contributed in the past to needy people. It is better we all contribute the amount and get Lohitaksha released immediately so that his wife's life is saved.

    Dear Friend's the priority issue here is to get Mr. Devadiga out from the Jail and send him home, then we can proceed with a fresh case as to why the crane was not Insured. Every year when the Istimara (Permit) is renewed of a machinery or a vehicle, the transport authorities verify the Insurance paper's and then only they will give the permit. I think he surely has a Comprehensive policy for, I dont think they will give third party coverage for Crane. He must have collected the money from Insurance and his Avarice has made him to take more money from Mr. Devadiga. He does not know some one from above is watching him closely.

    This is the responsibility of sponosr and insurance co. Why the sponsor is not registered his vehicle in insurance, he may be insured but no body is going to near him or his insurance co.So the sponsor may be earned more than SR 80000 from this vehicle and now he is a selfish to get more. So it is the duty of Saudi Authoritis to check the bank balance and insurance document of sponsor. So if insurance co is sanctioned SR 40000 also the contributors can come forward to help this selfish sponsor the balance he is demanding. So I request from Saudi Govrnment to check the insurance company what is the reality, if sponsor is not registered his vehicle in insurance co, he is fully responsible for the damange, not a poor indian. thank u daiji

They have to defend themselves and the expatriates are always at the receiving end unlike in UAE / Oman.     Sad to hear about Lohitaksha's plight in Dammam, Saudi Arabia. I am a resident of UAE for the past 30 years, and with my experience, the rules and regulations in all GCC countries are the same. Nobody should be allowed to operate commercial or private equipment without proper insurance and registration. This poor man is the employee of the same organisation. His sponsor must be held responsible for the consequences of the property damage instead of demanding such a huge amount from the family. We should all join hands to fight for this case by hiring a renowned lawyer. Our consulate cannot be bothered to help unless it is a celebrity case so it is upto us to take action and help them out. Our heartfelt wishes for the family to overcome this trauma.

    Great Feeling,keep it up. Before handing over the amount to the employer make sure why the insurance company backed out, i am sure without insurance none of the heavy equipments can be registerd in Gulf. If not insured then the employer at fault, why Mr.Devadiga?

    It is heartening to read comments from people belonging to various faiths, who are deeply concerned of their fellow-Mangalorean who is languishing in a Saudi jail. This shows how people want to live in peace and help each other in their distress.

    When we read their concerns not only to this issue but various issues involving people from Mangalore, one can be sure of that it is not a common man who wants to fight in the name of religion and de-harmonize the society but it is those leaders who instigate the people to destroy peace for their greed and own purpose. These leaders have communalized our Mangalore which was hitherto a peaceful place. The recent Daijiworld report shows how a religious leader caught in camera who was all out to destroy peace among two communities. There must be many such cases which are not caught in camera but people should be wise enough to know the motives of our politicians and so-called religious leaders. The more united we are against those forces, the more stronger we will be.

People should be pro-active to make GOI have some regards to its citizens. I advise all the mangaloreans in the Gulf to advise their family / freinds / neighbours to boycott the next elections. Atleast approach via e-mail/letter giving all details. as i know from source even earlier His Highness helped lot of indian expatriates with free medical facilities as well people are in disarray. If all the doors closed why not approach higher authorities?..where there is a will there is a way. no need to give any money to sponsor. as it's his fault not insured, if in any case. case will be turned immediately and will be released Mr.Lohitaksha on humanitarian ground.. if our indian embassy is not helping in this case..why should we approach them?..

    In fact, this case was brought into IFF – Riyadh at first by one of the Mangalorean. IFF Riyadh chapter toook the initiative immediately and has taken steps on this case and was succeeding normally. Mean time, one Mr. Sunil who is relative to Mr. Lohitaksha interrupted our f team and advised us that to stop proceeding legally in this case. (Mr. Sunil was concerned after effects in the case if we proceeded legally). Mr. Sunil was found a Saudi mediator to release Mr. Lohitaksha from Prison with the agreement of paying SR. 10,000/- to solve the case.

    IFF is really is surprised to see this matter again in Daijiworld hence IFF thought the case was over.

    We assure you that always IFF door is open to lend  a helping hand to such stranded (Insha Allah).

    I totally agree with Mr. Shahanwaz Kukkikatte. The embassy has to interest to hire an eminet lawyer to fight against the monster so called sponsor. It looks like the vehicle was under operation without insurance and it is the falt of the owner of the vehicle to pay the third party liability. The owner should be charged as he doesnt belong to any class of humanity certainly not a muslim. After all what the hell are the embassy of india doing? They enjoy the parties organized by the varous cultural organizations like here in uae doing nothing so is our great foreign ministry spending time always dealing with unsolvable problesms of pak-india so called relations

He is with no doubt innocent and should be freed from the jail by finger counts.     I hope God gives his sponsor a change of heart to release this Gentalman without much more fuss. After all he he has dedicated so many years for the company. Al least the law should have concidered his stand.First of all It happened at work .second he has not put life at risk .Thirdly how will he be able to pay such a huge amount.     Its employers mistake. The employer is a monster with stone heart. Accident can happen to anyone and any time. Employer must have covered the vehicle and the employees with the inusrance. As long as there is no loss of life, the matter is more of civil nature than criminal. Had the vehicle been insured, the damages would have been paid for by the insurance establishment. The Indian consulate must intervene and use its office to get the release of Mr Devadiga. Indian consulates in gulf countries are earning huge foreign exchange for India. Out embassies across GCC are useless and voiceless. They only know how to generate funds and how to make money. But issues like these, they are of least help to its own citizens. The respected members of Indian community must stage a portest infront of Indian embassy in Riyadh and ask for the immediate release of its citizen, as he has not committed any crime and its just mere an accident and unintentional act. The Indian foreign ministry should summon the Saudi ambassador and demand his release unconditonally. I pray and hope for the good health of Mr Devadiga and his family members and pray that saga will end with a happy note.

    Mr Vasanth Kumar Hegde could take a lead in this matter as Dammam near to Riyadh.There is so many Indian NGO's based in Dammam as said by Mr V Kumar provide him necessarry information.Any way we will follow this issue closely through our source in Dammam.But the nature of the case and the punishment meted to him seems to be strange!

    I agree with you, Dr Moilyji and Dr Oscarji can convince Mr SM Krishna, to summon Saudi Ambbassador in New Delhi and ask him for explanation...

    If any US citizen is illegally detained by Saudis thats exactly US will do....

    Normally in any civilized countries accidents are covered by insurance, in Saudi Arabia and Sharjah, how they are covered, i have no idea....

    Atleast SMK can ask Indian Embassy in Riyadh to find a good lawyer and take up his case....

    Just get everything done through Vasanthkumar Hegde of Saudi Arabia who should be able to help. I think everyone should contact him and assist him in getting Lohitaksha free from all his problems in Dammam. But then, there should be insurance as well. May God Bless You Vasanthkumar Hegde. There is no point expecting any politicians to help. Lohitaksha should be free within 10 days for sure.

    Every vehicle is bound to have an insurance either third party or comprehensive, in which case the Insurance co. of the vehicle is suppose to bear the expenses whatsoever. I am confused as to why the poor driver is made scape'goat. Since the penalty imposed is very high, it is better the concerned Indian authorities take up the matter with Saudi Court of Law. It might take some time to fight this case, meantime the only solution to relieve the mental agony of the family members is to convince the sponsor and reduce the amount which the humble doners might think reasonable.

    I am working here in Al Rajhi Bank and I have many Saudi friends and also I know some officials in Indian Embassy. I am based in Riyadh. If the family of Lohitaksha send the name and mobile number of the owner of Ebrahim Al-Bibi trg est, I shall try to reach him and ask his demand to release him. Once I get the details from the owner, I shall let every body know his terms and conditions to release him. Let us pray god that we get good response from him.
