Mangalore: Forceful Eviction - Kemaru Swamiji Demands Probe Into Human Rights Violation

Mangalore, Apr 30: Kemaru Sri Esha Vittaladasa Swami visited the spot where a house was bulldozed by KIADB for MRPL near Kalavaru and demanded an enquiry into human rights violations on Thursday Apr 29.  

“I think a goonda administration is present in the state. The act of bulldozing the house is merciless. They could have shown some manners and sympathy”, he said.  

He expressed his sadness when Gregory Patrao described the act of the officials who threw every thing from the house including rice cooked for the day. 



























Gregory told the Swamiji that money and gold ornaments were also taken away by the officials during the demolition.  

“Our rulers should understand that only assurances to farmers are not enough, but they should follow it in deeds also,” said the Swamiji.  “The farmers who are the backbone of this country should not be tortured in this way”, he added.  

Gregory said that their house dates back nearly a hundred years and is under Pejar Diocese, and where his ancestors and community members held prayers and mass was conducted.  

Mother and Son in Hospital  

Gregory’s mother Mary Patrao was hospitalized after she collapsed due to mental and physical stress after the demolition of her house. Her younger son Hurman Vincent Patrao was also admitted to a hospital due to the same reason.  

Both were fasting after the demolition of the house and hence had to be hospitalized.   

Family is Unwilling to Eat Anything  

Gregory’s family is unwilling to eat anything after the demolition of their house. Seven family members excluding children have been fasting from Wednesday. Gregory said, “After losing our livelihood, what is there to achieve by eating?”  

The family wanted to stay at the same spot where the house existed earlier with the sky as the roof.  

Gregory said, “We can move to a hotel or elsewhere but our cows and oxen cannot be shifted to hotels or rooms, so we will stay here only”.   

He said that out of 7 acres listed for the acquisition there is more place has been acquired from his land which has totally 14.28 acres.

    My problem with this is not land accuisition, but how it was implemented...in my opinion it was done in a cruel and inhuman manner...

    Government has extra land, it can give an equal amount of agricultural land to these folks say near a river, nearer to their house as far as possible....

    OK now, are you happy with the way these folks were treated?

    About old lady your heroine, you wrote " She knows only God Almighty's constitution and not one written by Mr. BR Ambedkar".

    Ambedkar was chairman of Drafting Committee. Others were - Nehru, C.Rajagoapachari,Vallabhai Patel, MAK Azad, SP Mukerji & NR Ghosh.

    Coming to topic - Ambedkar drafted correctly that private property can be acquired by Govt. on payment of "compensation". It is during Indira Gandhi's time, with her more than absolute majority in Parliament, she nationlised the Private Banks for which Nanipalkiwala as their Advocate argued in Supreme Court saying "Compensation" means "just equal to" as per Oxford Dictionary which Govt. failed to pay.

    He won the case. So, Indira again amended the constituion to read "by payment of an amount" which means even a single paise given is enough. But Supreme Court has put certain rules/conditions later on for such acquisition and saved the people. Later on certain SEZ etc. concepts also came into being with their own rules. I respect Dr. B.R. Ambedkar for he made no mistake.


    This topic is one of the conflicts here. Whether one's right to refuse to sell his property is greater? or any acquistion law made for that matter is greater though in the public interest?

    If a man is living today, it is for his tomorrow. Because, his fundamental right of ownership of propety is guaranteed. Hope you will also agree with me.

    The Bishop of Mangalore should go on a hunger strike in support of Gregory Patrao. The Catholic community of Mangalore is a community of farmers and their lands are being acquired forcibly and cunningly by the people who want to snatch away their livelihood. The head of the community is sleeping or looking the other way. If he gets up and starts a hunger strike the inhuman SEZ can be stopped.     Mangalore is a beautiful fertile level land with red alluvial soil best suitable for various cultivation rich in green environment. Most of them directly depend on farming and agriculture, though not they earn more they have a peaceful life and happily settled.

    Why government want such fertile land in Mangalore ? Why can’t they go and acquire less fertile dry land which is vacant in Bidar, Bijapur, Gulberga, where there is no rainfall nor cultivation ( drought area) Only because it is close to MCF, International Airport and convenience means of transportation and earn more income make more money!! Directly or indirectly .

    Our political leaders are also supporting the so called developments for their personal benefits and seats !! but they do not have any sentiments or feelings of so divested people. Who cares when it is someone’s land ? Various promises before acquisition were not fulfilled. The rehabilitation colony do not have any community living or developments !! No pure drinking water, nor proper roads, primary or secondary schools or collages, no supermarkets forget about Malls and luxury shopping areas. No Government hospitals Nor private hospitals. ( Mangalore is having highest level of Malaria now Where is Environment Health and Safety ?) lot of crimes and less protection of people Where is Law and Justice ?and No place of worship Temples, church or Mosques !! Where is Fundamental Rights given by Indian Constitution? Forget about religion, caste creed, political status just say “WE ARE ONE” as the people marched in NANDIGRAM.

    Forget about compensation which are peanuts just wake up all community and march towards one more NANDIGRAM IN MANGALORE !! SAVE THE RICH EVREGREEN AGRICULTURAL LANDS AND FOREST WEALTH. We need to stop Global Warming!!

This is Lawless Karnataka State. Stupid Police Officer is laughing while 85 year old Mrs.Patrao is weeping over the tragedy. Another Govt. Officer is shaking His head like Gorrilla while the tragedy stuck family is looking for answers from Him. NRI Mangaloreans are you proud of your motherland called Mangalore. Do you want to invest in this state which is anti farmers. A Good Hearted sympathetic Shri Shri Swamiji came to offer his help to Patrao Family and fight for justice while Catholic Parish Priest came to see the drama and left without helping, and we call them Shepards. They only care about Wealthy and Healthy Sheep.

    Catholic Political leaders should understand that if you dont come to the rescue of the farmers of your community,I am sure they will think twice before voting.

    There should have been a better way to settle these matters than just demolition of a home built years ago. This is really is human cruelty. Justice must be done, but that cannot allow inhuman methods of this kind where the livelihood of the entire family is endangered.     I strongly condemn this inhuman eviction of this innocent family from their own house. I whole heartedly thank Kemaru Swamiji for visiting the spot & sharing some moments with the family and taking initiative for an enquiry. Every word what Swamiji said is true.

    The authorities say they sent notice. As Swamiji said may be the family didn't receive it or family needed more time. Whatever it is they should have made contact with the family & discussed things first. It is their only rightful property. MRPL didn't have the full consent of the owner for eviction. This was a case of forcefully evicting the owner. No respect shown for the human rights. Let there be a detailed enquiry & R S Sharma Chairman, U.K.Basu MD of MRPL should answer some of these questions for us Government can't take anyone into granted. Poor or rich, any religion everyone deserve respect, civil treatment & their basic rights need to be honored. Meaning of being a democratic country has to be displayed in these situations. God bless Kemaru Swamiji and this family. Hope this family finds a meaningful solution for their problem.

    MRPL deposited this 1.6 crore to state tresury, not to her, by looking at her possesions like bullocks, cow, dog,hen,plates does she look like crorepathi to you?

    She knows only God Almighties constitution not one written by Mr BR Amedkar and his team!

    Now where she should go with her family and animals? Does your hotels in mangalores take her extended family(animals) in??

    My suggestion to her, she should take her family and extended family(animals) to Circuit House Mangalore and forcibly occupy Suite 1, where Yeddy and two Vidhvans stay when they are in Masngalore...., let Seemanth go there and try to evict her with his team....

    She is my candidate for CMs post next time......

    It's one of the most inhuman behaviour that our government/district administration/Police have shown in handling the issue. Do we need a contingent of police personnel to guard the demolishing party while leaving the poor farmer & his family including a old age mother as mute spectators while their house is brought down in matter of seconds.

    Shame on the government, authorities and leaders. While acres of prime government land illegally occupied by the powerful people do not get touched, this poor farmer fertile land is being snatched away in the name of development. Don't we have a law to follow in such instances. Where this family have to spend today's night with their cattle and belongings with no roof to cover them. Where are our community leaders ?. Atleast Shri Kemaru Swamiji has shown some humanity here in visiting the place and meeting the family. God will Bless Swamiji for this noble gesture.

    Swamiji has protested the manner of eviction and not spoke against the court order. Mr.Lokanath, I remind you an incident that has taken place in Udupi a couple of days back. When the Tahsildar armed with High Court order, was about to demolish the Kalyana mantapa, the Udupi MLA and Shiroor Matt Swamiji opposed it and the offical has to go back without executing the court order. What do you say about that. If you have money, power and influence, you can stall the court order in our great country.

    In this case the method involved in demolition undertaken of the disputed house stands for criticism. The procedure should have been:
    1. The police should have taken all the occupant of the house into a protective custody.
    2. The police & other authority should have assessed the belongings including all valuables in this occupied house because they are not demolishing an unauthorized house or the house of a criminal.
    3. The authority should have moved all the belongings to a secure place with lock & key and the live stock in a hired animal husbandry premises. Simultaneously a copy of the recorded items should have handed over to the owner/guardian of the house and another copy to the court.
    4. Finally, the next day they should have peacefully demolished the house without showing any aggression because a lot of sentiment value is involved to this property.
    The authority should learn from the mistake and should not repeat it. The poor farmer was living peacefully with their cultivation, plantation and live stocks though against the will of the authority and the monitory benefits offered them.

    As if we are goonda raj.Where are the politicians who swear in the name of ANNADAATHA? If fertile land is used for industries what shall our next generation eat?.Indications are there that we are living in a commercial world.The farmars plight is sad indeed.

    Its a shame to everyone from undivided south canara. Certainly its inhumanitarian act..there is a way to impliment a court order...its verymuch sure that MRPL influence worked above the poor Patrao,s.Really look like Gondaraj in district.     Why is everyone saying "dictatorial"?

    This person went to court and lost. Administration is just carrying out court's order.

    He had not one not two but more than 15 years to plan evacuation. When large projects comes common sense dictates that they won't stop project for just one family.

    It is not as if compensation was not given. District Administration had deposited crores of rupees for this person. He can live rest of his life in luxury.

    If everyone behaved like this person, there would not have been NMPT, KREC or even Bajpe airport. Think big, think future instead of drama.

    I find it strange, not to find any priests or leaders, with the fly. Yes, they are fighting their own battle, its a legal battle. They lived there for centuries and developed the plot of forest land with blood, that feeds people and animals today. They are willing to stay in that demolished house, for their love towards cattle. Does't it say anything? or Appeal anybody?

    It is strange that we are not allowed to lead normal lives in the worlds largest democracy. Although we are one of the fastest growing economies in the world, we are making our own citizens the scape goats of development. It is not always the compensation that counts but the emotional attachment that this family has to their age old home that has cost them their peace. I am sure if our politicians drilled some sense to their lousy heads, our cities would have been much better planned. Our politicians are the bane of our own making.
    This really shows how important it is to vote in large numbers and show that every citizen matter, that we as the people of this great nation choose our leaders wisely. No matter which party, but who guides us in the right way.
    As of now, all we can do is pray for this family and for the scores of them who are the sacrificial animals of so called development.Please excuse me for this philosophy, but this IS the truth.

    Where is district admin?? Where is incharge minister?? where is MLA/Zilla Panchayth Member?? This act of forceful eviction is realy inhuman.Sri Kemaru Swamiji's solidarity with these powerless farmer's plight is commendable.

    BJP govt's apathy towards farmers are not in line with what Yeddi preachs and takes oaths in the name of farmers!Those who were participated in this ugly incident should be punished and as said by Swamiji only hope left is porobe of Human Right Commission.

    It is great heartwarming to see that Kemaru Swamiji visited this Christian family to give some solace and support in his turbulent times. We need more and more such Swamiji's today to usher into a just society.

    However, nothing is mentioned of the SCC and parish level self help groups. Can't any help/legal assistance be given to this distraught family at the parish level.

    A very disturbing and inhuman pictures. Cant see the pain and yeling of the affected family. The policeman is very very rude and inhuman to them and he is shouting and showing the true color of uniform. I support the Swami and his statement. Such policies and actions of the government is repsonsible for the breeding of naxalism and terrorism in our country. The administration must and must immediately release 1.56 crores and help them hehabilitated elsewhere. When it comes to selfish means and money making, even the so called holy cows are not spared. They have made their own Gods homeless and shelterless. All people are against such action by the state administration. Now where is Pejawar Swami. All people irrespective of their affiliations must stay put and fight the government. Today it is very clear from this footage that we dont have humanity and I really sympathise with Petrao family. How one feels if in front of his eyes, his own house is brought down. The emotional value and attachments have been murdered and only one thing evident is that authorities are showing their power and flexing muscles. Very bad and highly condemnable act. The govt must go. Very are those ministers and others who claim that they are the welwishers of farmers? I pray God to give enough courage and patience to the Petrao family to withstand this pain and May Lord bless them and help them in settling down elsewhere. Mera Bharat Mahan!!!!!. This is democracy!!!! This is govt of the people.

    Kemaru Sri Esha Vittaladasa Swami is doing the right thing. He has gone there on humanitarian grounds when police or politicians have not done anything to the common man. This house belongs to the Patrao's for generations it seems like. Whatever the case may be, a house that has occupants should not be demolished.. regardless of them being paid a compensation or not. If they did not vacate at the stipulated time, then they could have been fined!! or taken to jail/court. But this is a decision that is of poor taste. I will compare it similar to physical rape.

    Whoever approved and proceeded directly on demolition of the house without any concern.. probably they might have "CROCODILE BRAIN" just like destroying somebody for living.
    In India people don't have enough knowledge of their Fundamental rights, Law, Rules and Regulations, that is the advantage for the government officials to fool the people easily in the name of law.Now itz looks like India still in 17th century where there was King Rule and Monopoly Rule.

    This is a pure case of lack of proper regulation and procedure. A time frame must be fixed for every move that the district administration makes. Even after court order is passed (in this case, even that is being contested), the occupants should be given some weeks to clear the property. The Government must realize that people don't just see their property as asset, but also attach a huge emotional sentiment to it. It will have a huge bearing on their minds if the acts such as these are committed and however well intended are the government's moves, it will always be suspected by its subjects if acts such as these are committed. Many sympathies to the Patrao family.

    Defense consumes the Fence and the poor will remain poor. See how the diligent hard workers brought up the land in to harvest. The poor are compressed and have no voice.     Are we in a Dictatorial regime? Why so many police to deal with simple farmers?. In a democracy usually people are powerful but in India only during elections these politicians fold their hands to people and after the elctions they use the same hands to take their life. I can never imagine that such a thing can happen to a farming family who are legal occupants of the land. looking at the livestock and the scattered farm goods I sincerely feel bad for Patrao family.

    It is an unfortunate story of rural India, especially of farming community. This fertile land was developed and cultivated by Patraos for generations with lot of aspirations and life long memories attached to it. Agriculture, farming, plantation and livestock – it takes lot of hard work and many years to develop and reap the harvest. Rural India needs orientation and innovation in farming sector to generate food security to feed our population. Instead of discouraging our result oriented farmers such as the Patraos, it is high time that we all put our act together in motivating our youth to take up farming as seriously as the “Cell Phone” revolution. It is heartening to see the entire neighbouring fertile region already levelled and flattened for SEZ. I could not see the horrific scene of the region during my recent vacation.
