Shiv Sena Activists Attack Lawyer's House for Willing to Fight Kasab's Case

PTI

AMRAVATI, Dec 15: About 100 Shiv Sainiks today attacked the residence of a lawyer, who showed interest in fighting the case of the terrorist arrested in  the 26/11 Mumbai attack, Mohammed Ajmal Amin and ransacked his office.

Frezerpura Police said the activists, armed with canes, stormed the Vijay Colony-based residence of advocate Mahesh Deshmukh, who had shown willingness to fight the legal battle for Ajmal.

Police said the irate Shiv Sainiks stormed Deshmukh's office in his house and ransacked it. They damaged telephone and furniture and threw books and documents out of the house. They also damaged the two-wheelers of his tenants, which were parked in front of the house.

The Sainiks were against Deshmukh taking 'Vakilpatra' of Ajmal when the Bar Associations all over India had decided not to take up Ajmal's case. Deshmukh had sent his assistant to Mumbai District and Sessions Court today to request the court to allow him to meet Ajmal, who is in police custody, and express his (Deshmukh's) desire to take his Vakilpatra if he permitted.

The Shiv Sainiks also allegedly manhandled Deshmukh and a couple of cops present at the spot. The activists then went to the District and Sessions Court here, shouting slogans and waiving flags.

They met the office-bearers of Amravati Bar Association and requested them to take action against Deshmukh who was "acting" against the decision of the Association.

Many readers in their eagerness to blame Shiv Sainiks have made sweeping comments against Marathi people as if they are cowards. If national army has been pressed into service it means soldiers from all states who work in that unit had to participate- that does not mean Maharashtrians or marathi people failed. So blaming a whole class for the sake of few may not be correct. In fact we have the Maratha Light Infantry on our own soil at Belgaum.

Heaven is not going to fall if a terrorist is not given legal assistance. He himself can defend his case- if he wants. The terrorist is not our citizen and he does not owe allegiance to our Constitution. Then where is the question of giving him a fair chance as per our constitution? Now a days the word terrorist seems to be used in any context and against anybody ! May be even a pickpocket may be called a terrorist because he creates some fear in the mind of travellers in buses and trains. The principle is if you dont like somebody call him a terrorist! Kis ka kya jaatha hai?

These mindless MNS activists do not understand what India will gain, by advocate Mahesh Deshmukh’s coming forward to take-up Pakistani terrorist’s case. Their understanding is very limited, so let’s ignore such people. These type of people can attack only innocent, harmless, unarmed and peace loving people.

Can someone explain why doesnt the Bar Association want to take up the case of Ajmal. Is it because they know that there are a number of loopholes in our judicial system or is it purely due to the respect to the people of our great India. If you dont want such terrorists to walk free then why do you want goondas, corrupt officials and public servants to walk free. Please repected lawyers of the Bar Association forget this inhuman terrorist and fight a rightful battle for the innocent who are rotting behind bars for no reason. As for Shiv Sainiks, leave your shiv sena and join the Bharatiya Sena (The great Indian Army) and serve the nation .

This is nothing else but publicity gimmicks, when the terrorists attacked Mumbai, Shivsainks were mere spectators. If they have the national pride then they should legally fight against the terrorist and not attacking the lawyer. MNS & Shiv Sena should think about another tactics to attract the voters.

Last night I was watching NDTV 24x7 and the same things were discussed. I agree that Sainiks dont have any rights to take law in their own hands. On the other hand, the Indian Constituition says that the culprits should get a chance to defend themselves (although we all know that he is the terrorist). There is no way that he can escape the punishment (if the judicail system of India takes right steps), but atleast we can say to the whole world that India stands for democracry and still give a chance to the terrorists to come clean in their activities. Long live India !

All thanks to Mr. Deshmukh, Shiv Sena Sainiks have woken up from their deep slumber. I wonder what would the Shiv Sena have done if the lawyer was a muslim instead of a Hindu. Simple, they would have created Hindu-Muslim riots. These Shiv Sena guys do not deserve to call themselves SAINIKS. SAINIKS are those who give their life for their country and not those who attack their own countrymen. What Mr. Deshmukh is doing, if not for publicity, then only proves one thing, that no matter what we INDIANS always give our attackers the benefit of the doubt.

In Kasab's case they don't have any right to attack Mr.Mahesh Deshmukh. I don't know from where suddenly the shiv Sainiks existed ? Where they were when the Terrorist kept Mumbai in their hooks for more than 62 hours. They are fit to attack innocent people. For the Lawyer it is business. No doubt the Lawyer should have not taken this case at all. What Shiv Sainiks are trying to show public ? There was not a single comment till yesterday from Bal Takeray, may be Raj, Udhav or any MNS worker ? Now this is a surprise from where they came ? If they would have come when Taj, Obroi, Nariman Bhavan was under seize for 62 hours, I think the Mumbai public not only but the world community would have appreciated them. Now no one needs MNS or Shiv Sainiks for their support.

First of all, I do not understand how and on what grounds this case can be fought by our advocates. I am little ignorant about the constitution. However, in the present case, the person in quesion has admitted that he is not a citizen of this country. Does our court accept the case and admit it for argument. If that being the case, many of our citizens languishing in Pak jail can have fair hearing. Secondly, it is beyond doubt that he has killed many of our country men. An outsider killing our citizen, what is the punishment ????.

It is their Job (Lawyers' Profession) to defend, Argue, With Stand with any of the culprits in this earth. If the Suspected Culprit is really done something wrong he will be punished if not an Innocent's life will be saved! I don't say Kasab in an innocent, but Ofcourse he is the person with tainted face! Now, the Lawyer needs to find out who are those behind this act and the real Culprits must be severely punished even though if he is a Chief Minister or a Party Leader. When you have caught a person red handed shooting AK-47, why do you have to take him to court. Why do you have to proove he is guilty or not. There is no question. HE IS A PRISONER OF WAR. THE TERRORIST WAGED WAR. So he must be handed over to the militarty and court marshalled. India is a very poor in handling terrorists even when the plane was hijacked the whole india with 1 billion population did bow to the terrorist demands and handed over the most wanted terroriststs who are now the creator of new terrrorist organisation in pakistan. India will be always vulnerable for more terrorist attacks as we are so weak to concentrate on our own security.

As an Indian, I really appreciate lawyers for not taking up the case of Kasab. We as Indians need to show unity in all ways. But at the same time, in technical perspective, trial can not be conducted without lawyer in this case. Worst case, the culprit has to be shifted to other state if No mumbai lawyers come forward to take up the case. It results in unnecessary delay in proceedings. "India is a secular and democratic nation." Transparent trial should be conducted and guilty shud be punished in public. So, as common Indian I oppose anybody taking up terrorist case. But in reality it can not be so. It will hurt more to us. Let us not question anybody here..Let everyone have their own views..Freedom of expression. Some time we need people like Shiva-sainiks. Otherwise there will be some lawyers like RAM JETMALANI who always want limelight and come forward first to take terrorists case without guilty feeling

They(MNS) probably thought that the whole of Mumbaikars/Indian dispora will appraise them of their great heroic deeds of restraining another Mubaikar advocate which wouldn't have been possible without adopting their spectacular means, methods and gestures. Does any body feels secure by promoting these darpoks to power with our precious votes and rights? What example these people want to set before a weeping and angry India? Clearly, armed Kasab alone was enough to drive them out to their desired destination. What a hell of idiocy to do anything wothout retrospecting or introspecting. May God give enough wisdom to all to live peacefully on this planet.

Shivsena or any other organizations should not take law in their hand. Everyone knows that Kasab is the terrorist sent by the Pakis to harm India and the Indians, who has killed a huge number of innocent civilians. However, as per our Constitution he must be given a chance to defend himself or hire his lawyer. In India, if Indian lawyers can't fight for him, can we expect Pakistani lawyers to come to India and fight for him? While I appreciate those lawyers who do not want to fight for Kasab, it is disgusting to note that some of our greedy lawyers can go to any extent, even for fighting these hardcore terrorists. We have lawyers who in the past, have defended terrorists like Abu Salim and many other criminals and terrorists belonging to Dawood Ibrahim, who must have got sackful of money for defending these crooks.
