Supreme Court suggests out of court settlement on Ayodhya dispute


New Delhi, Mar 21 (PTI): The Supreme Court today said fresh attempts must be made by all parties concerned to find a solution to the Ayodhya temple dispute which is a "sensitive" and "sentimental matter".

A bench headed by Chief Justice J S Khehar said that such religious issues can be solved through negotiations and offered to mediate to arrive at an amicable settlement.

"These are issues of religion and sentiments. These are issues where all the parties can sit together and arrive at a consensual decision to end the dispute. All of you may sit together and hold a cordial meeting," the bench also comprising Justices D Y Chandrachud and S K Kaul said.

The observations came after BJP leader Subramanian Swamy mentioned the matter seeking urgent hearing of the issue. Swamy said that it has been over six years and the matter needed to be heard at the earliest.

The Parliamentarian told the court that he had approached the Muslim community members who told him that judicial intervention was required to solve the matter. "You must make fresh attempts to arrive at a consensual decision. If required, you must choose a moderator to end the dispute. If the parties wants me to sit with mediators chosen by both the sides for negotiations, am ready to take up the task. Even the services of my brother judges can be availed for the purpose," the CJI said.

The top court said that it may also appoint a principal negotiator if the parties want.
The bench then asked Swamy to consult the parties and inform it about the decision on March 31.

On February 26 last year, the apex court had allowed Swamy to intervene in the pending matters relating to the Ayodhya title dispute with his plea seeking construction of Ram temple at the site of the demolished disputed structure.

The BJP leader had earlier moved the plea for a direction to allow construction of Ram temple in Ayodhya at the disputed site and had mentioned it before a bench headed by the then Chief Justice T S Thakur for an urgent hearing.

In his petition, Swamy had claimed that under the practices prevalent in Islamic countries, a mosque could be shifted to any other place for public purposes like constructing road, whereas a temple once constructed cannot be touched.

He had also sought directions to expedite the disposal of several petitions challenging the Allahabad High Court verdict of three-way division of the disputed Ram Janmabhoomi-Babri Masjid site in Ayodhya on September 30, 2010.

    Will Supreme court of India will give justice to the families of more than 5000 families who have lost their loved ones?
    Is SC will pay the compensation for those who have lost their business and properties?
    Is SC will give the jobs for those disabled?
    What is the credibility of the Supreme court if their is out of court settlemen?
    I doubt the timing of the judgement and intention of the court ruling.

    Is Supreme court is in the process of giving 'clean chit' to LK Advani who is sowed the seed of hate through his famous 'Rath Yatra' and wishing to President of India as Dada tenure is about to finish?

    From Arunachal Pradesh BJP government forming to Ayodhya dispute ,Chief Justice J S Khehar is proving to more handy tool for BJP rather than true justice.

    Dear Daiji Readers,
    Let them Build Ram Mandir Temple. So that problem is solved once for all. There after no one can use ram mandir issue during the election. All the religion have their own worshiping place. We are living in secular state. But don’t impose Hinduism on every one.

    SUPREME COURT cannot ask for an out of court settlement on such a critical issue . The fact that they have approached SC is that this could not be solved out of court ..SC is escaping from its duties and acting under pressure

    Out of court settlement won't be possible....If this is made as precedent...then there will more such type incidents in future where majoritarian views are forced upon....If India is true democratic country masjid should be built where it is...or else it has no right to boast it as democratic republic proclaim it as theocrstic state...

    Not possible dear SC, the saffron party wont let this happen as this is their trump card to fool the Hindus and emotionally use them for their political gain.

    I welcome the SC suggestion, both community people are interested to live in peace, re-building a mosque or mandir wont do anything good to india but create more hatred between the 2 communities, either don't build anything but education center or a hospital or built both masjid and mandir side by side. That would solve the issue.

    what are the chances the hate monger, selfish politicians would agree on the above? a big ZERO.

    Mr.SuSamy if a temple demolished in western countries for the development work or for any other reason what would be your reaction? Just you look other side? or you get a STAY? Cows are sacred in India but what about Indian Cows or other nationality cows butchered in market places in other countries? Why do you are practising your religion in two different way. One in India and differently in foreign countries? Mr.SuSamy, structures are lifeless so, that can be built as per our necessity and can be demolished as per our needs. Try to make uniform Law for Hindu structures universally. Hinduism is the third largest religion in the world. Like Christians and Muslims who follow their religion in the same manner anywhere in the world likewise teach innocent Hindus also to follow uniform practice anywhere in the world.     Supreme court verdict is acceptable to everybody whatever may be the verdict. But Supreme court has lost credibility after Modi came to power and all its decisions are favor to the BJP-Sangh Parivar in recent days. Now SC scared to pass the judgement on Babri mosque-Ram Mandir issue. Means Judicial system totally hijacked by the saffron regime. Then why Supreme court want to intervene on Triple Talaq since that also religion sentimental issue which can be solved by the guidelines of the muslim clerics.

    Mr. Dinesh, who stopped you to build Ram Mandir in Ayodhya? But the Question is why do you want to build on the Babri Mosque structure ? Ayodhya is very vast area so that you can build the Temple anywhere in Ayodhya except on disputed structure.
