Govt asks Law Commission to examine uniform civil code issue


New Delhi, Jul 1 (PTI) : Government has asked the Law Commission to examine the issue of Uniform Civil Code, an issue that is dear to BJP and the sangh parivar. The Department of Legal Affairs has asked the Commission, a recommendatory body, to submit a report on the issue.

The move assumes significance as the Supreme Court had recently said it would prefer a wider debate, in public as well as in court, before taking a decision on the constitutional validity of 'triple talaq', which many complain is abused by Muslim men to arbitrarily divorce their wives.

Law Minister D V Sadananda Gowda had earlier said that the issue could be referred to the Law Commission for examination.

Gowda had said "wider consultations" will be held with various personal law boards and other stakeholders to evolve a consensus and the process may take some time. "...Even the Preamble of our Constitution and Article 44 of the Constitution do say that there should be a Uniform Civil Code...it needs to have a wider consultation," he had said.

A decision "cannot be done in a day or two. It will take its own time", Gowda had said.

Implementation of a common civil code is part of the BJP's election manifesto. But the NDA, when it came to power in 1998 and 1999 and now under Narendra Modi, had kept contentious issues, including the UCC, on the backburner.

    If the uniform civil code has the hidden agenda of the RSS/VHP ideology through enslaving the minorities, that will be turning as a national disaster uniform civil order. All these hidden agenda's are causing greater alarm due to its very mysterious nature.

    There are, in addition to the Supreme Court, 24 high courts and a huge number of subordinate courts, CBI courts, tribunals in India in the mainstream legal system.

    But, according to the various reports in the media, the Chief Justice of India, TS Thakur, has been making an emotive appeal to the government to have more judges, as there is a terrible shortage of judges.

    According to some reports about 3 crore cases are pending before the judiciary. In addition, most cases drag on for years and decades. All because of the terrible shape the judiciary is in.

    The Government might need an amount exceeding 1 lakh crore to change the setup.

    With such situation, the Government will not make the "Uniform Civil Code" happen in a hurry, as it would add lakhs of cases to the courts!

    It is one thing to play vote-bank politics before the elections, and something else altogether to deliver later.

    This is long overdue. Need to implement this as soon as possible. If India wants to come out of caste and religion based politics this is a must. Not only for politics, we as a nation and society need to get matured and UCC is a first and essential step towards it. Only then we will be get more respect in the world as a nation. This is a big step in social reform.

    Only uniform civil code will be legal When Government or its custodians/Politicians/Administrators separate Government from Religion and all religious activities Just like developed countries and religion, cast, region, Gender based discrimination is removed.

    Its a welcome move though its BJP's pet issue, as all citizens who enjoy all the things & laws uniform way having different civil laws for different communities or religious groups itself is discriminatory as those who have seen or have found themselves on the wrong side because of the present law.
    The parties irrespective of their vote bank need to see it as essential to have unity in diversity to get a legislation if not now after UP elections & put an end to archaic laws that are misused by many.

    We are in favour of UCC...(not the UCC of sang parivar which they think UCC means a tool to defame any community or means to impose Hindu civil code)if...
    1)Tax benefits and exemption given to Hindu undivided family need to be abolished..
    2)Muslim and Christian dalits should be provided SC/ST benefits..
    3)Govt should abolish hajj subsidy...even after Muslim org requesting govt is is no mood to abolish as it benefits Air India and their lobbying...
    4)Govt should stop spending crores of rupees on kumbh mela or any other similar religious festivals ..
    5)Beef should be made available to every citizens
    6)Govt should stop inaugurating or introducing any govt scheme according to religious customs of particular religion and Govt offices should be void of any religious symbols...
    If RSS/BJP obeys above condition we are into it...Let all of us have equal law ...if it is ively imposed only targeting particular community then it is just a sham

    And all Sadhu and Sadhvis should selflessly serve the sick, lepers, tuberculosis patients instead of living in air conditioned, lavish villa. Donations to temples, churches and mosques should be distributed equally. If this is done, ucc is welcome.
