Release of young convict triggers urgency - Juvenile Bill to come up in RS on Dec 22


NEW DELHI: Dec 22 (DHNS) : The Juvenile Justice (Amendment Bill) will be taken up in Rajya Sabha on Tuesday after the Opposition objected to the government’s decision to bring it through the supplementary agenda route.

On Monday, some MPs argued for immediate passing of the amendment that would consider youths between 16-18 years of age as adults while prosecuting them in heinous crimes like rape. The government immediately announced that it would bring the bill in the House on the same day through supplementary agenda.

However, senior Opposition MPs like Ghulam Nazi Azad and Sitaram Yechury said the government did not list it in Monday’s agenda and they could not be blamed for this. As soon as the House assembled, a day after a juvenile convict in Delhi gang-rape case was released, Trinamool Congress MP Derek O'Brien said he gave a notice under rule 267 seeking suspension of business and taking up the Juvenile Justice (Care and Protection of Children) Act, 2014.

“It is incumbent upon the House to listen to what is going on outside,” O’Brien said. As other MPs pointed fingers at the government, the treasury benches said it was willing to bring the bill through supplementary agenda route.

When the House reassembled for the post-noon session, the Opposition criticised the government’s move to bring the Juvenile Justice Bill through the supplementary agenda route.

Azad said the ruling side itself was complicating the issue. “We have said that we want to pass the SC/ST Bill. At the all-party meeting, I had said that the Juvenile Justice Bill should be tabled. But it was not in agenda today. But because of media reports, the government has now put it in the supplementary business. It is only a ruse to shame the opposition in public by saying that we had presented (the bill) but the opposition had objected,” Azad said.

He said the matter can be taken up on Tuesday and should be listed as the first in the business.

The House was adjourned due to protest by Congress and when it reassembled, the government wanted to take up ‘The Commercial Courts, Commercial Division and Commercial Appellate Division of High Courts Bill, 2015’, but the Congress did not relent.

    Even if Bill get passed it will be applicable only to future cases. Even amendment of the law by Parliament cannot affect the present case, as under our Constitution a criminal law cannot be amended retrospectively vide Article 20(1) which says :
    " No person shall be convicted of any offence except for violation of the law in force at the time of the commission of the act charged as an offence, nor be subjected to a penalty greater than that which might have been inflicted under the law in force at the time of the commission of the offence "

    I agree with you. This bill will not help to punish the culprit of Nirbhaya case.

    However, on Dec 13, a juvenile raped 7 year old girl in Delhi.
    Had congress passed the bill in Rajya Sabha last year, the new law could have been applied on this culprit.

    Now after three years, we will again helplessly witness this so called juvenile getting freed by courts as per law in force at the time of the commission of the offense.

    ha ha ha... that bugger is already released and Nirbhaya's ( Jyothi ? ) parents fought their level best not to get this evil to be released. But as usual, the evil is out and today Govt felt the urgency of this bill. We the public would have appreciated if by any exception his release could be stopped and an entry a evil mind entering the society freely would have been avoided... now it's too late. any ways, hope this will help in future at least.

    discussion on the issue was listed 3 times in Rajya sabha, due to congress High drama could not pass the bill.
    any way even central govt confirmed to have discussion for yesturdays session even it is not listed. But Congress and CPIM refused to do so and post poned for today.

    Modi Govt interested to bring only GST Bill & Land ordinance because their financier Ambani and Adani waiting for this. Juvenile Justice Bill is last preference for BJP because they don't care about crimes on women. If BJP had tabled it in RS, it would have passed long ago. When the rapist MP Nihalchand sitting in Loksabha how BJP can take action against juvenile rapist???

    Some sickular party supporters telling that bjp stalled the Juvenile justice bill in RS,they should know In loksaba where bjp have majority passed this bill 7 month before .Total 16 bills were passed in LS but pending in LS because of anti national congress drama.Sickular party supporters thinking that by stalling bills in RS is lose to bjp but truth is it is lose to entire country including congress supporter also.Congress supporters and workers should know that only congress leaders and Gandhi family benefitted during their regime and not poor's including congress supporters and workers.During sickular party regime and now also congress thinking about its party future and not about people of the country including congress workers and supporters. These Congress supporters become blind slaves of Gandhi family.

    This is a important bill waiting for a long to pass in both the houses and legislate it soon but the bill is pending due to the logger heads in the upper house which the government failed to take them into confidence.

    How can you make such statement ?

    You mean to say that Congress MP’s were not even aware/confident that, Nirbhaya incident has happened three years back ?
    Are congress MP’s still in doubt whether such an heinous crime has happened or not ?

    Or are you suggesting that Congress MP’s should have been given “SOMETHING” to pass this bill ?

    Is it not the responsibility of congress MP’s also to ensure to pass such bills on priority rather than disturbing parliament to save criminals ?

    We hope that CONGiss Members will keep quiet for some time to pass the bill on that day!!!!! Even our Courts can’t give verdict based on the common sense prevailing in this society???? How come a person who rapes and murder someone argue on the basis of juvenile act to sneak out from the clutches of law?
