Aruna Shanbaug's assailant now in UP village, says report


Mumbai, May 29 (PTI): Even as police remains clueless about Aruna Shanbaug's assailant, a local newspaper today claimed to have traced him to a village in Uttar Pradesh where he is working as a labourer and said he cannot recall what happened on that fateful day.

Taking note of the report here that Sohanlal Bhartha Walmiki, who brutally attacked Aruna leaving her in a vegetative state for four decades, Mumbai Police today said they will seek legal opinion to decide on any further action against him.

A journalist with Marathi newspaper Sakaal Times met Walmiki, the ward boy who assaulted Aruna at King Edward Memorial Hospital here on November 27, 1973.

Walmiki, who throttled Aruna with a dog leash rendering her a cripple at the prime of youth, said he cannot recall anything about what had happened on that day.

However, he asked the journalist "why are you people calling it as rape".Walmiki was jailed and released in 1980, not to be heard of again. Now after Aruna's death, he has been traced to Parpa village in Ghaziabad district of UP. He was never convicted for rape or sexual molestation but for assault and robbery.

For 42 years, Shanbaug lay comatose in the hospital until her death earlier this month, where she was cared by nurses and members of medical fraternity here .

She also became the subject of a landmark case about euthanasia that went all the way to the Supreme Court. There is a law that bears her name that allows passive euthanasia under strict conditions even though it could never be applied to her.

Pinki Virani, who wrote a biography of Shanbaug and petitioned the Supreme Court for mercy killing, has claimed, based on her talks with hospital ward boys, that Walmiki moved to Delhi, changed his identity and went on to work in a hospital there.However, Walmiki says he never worked in Delhi.

Meanwhile, reacting to the report that Walmiki is alive, Mumbai Police said that it would seek legal opinion on whether to file a fresh murder case against him.

"Prima-facie it seems that this old case may not attract any fresh sections as Aruna died of pneumonia," Mumbai Joint Commissioner of Police Deven Bharti told PTI, when asked if they would consider re-opening the case after the victim's death.

"While giving judgement on plea of mercy killing filed by a journalist, the Supreme Court had said that let Aruna die a natural death. Hence in this purview, Aruna died of pneumonia that seems to be the immediate cause of her death," he said.

However, Bharti added that the police would seek legal opinion first and then decide further course of action.

    Lydia Lobo: First, do not judge so ye not be judged. A guy that committed a sin and undergone the required punishment and possibly repented has the right to live peacefully. If you rake up the same story after 42 years where is justice? Why the jails are for? Do we give a chance for REFORMATION?

    You need to run a view of the entire episode. A person restrains a woman with a dog chain and rapes her anally. Reason ? He reprimanding him over non-performance of his duties properly. He a cleaner, she a Nurse. You please note, cleanliness if of utmost priority in health services.

    Now, he got charged for very menial offence by her dear ones with hopes that she will recover to lead a normal married life, stringent charges will mar her self respect and cause her public humiliation.

    Fine - the man is charged the minimum and servers sentence. What does he do next ? Sneaks into the very ward where the victim, in vegetative state, is kept and tries to kill her.

    You say he repented ? That too after sparing his life by charging him with very menial clauses of crime ? You must be joking !

    Lydia Lobo: Do not judge, so ye not be judged: still holds good.

    Do not go by only what you hear/read in the press. I do not know or bother to know what happened that day or previous incidents culminating into strangulation of a nurse.

    What I know today is a person, a living being, who had committed a crime 42 years ago and undergone the punishment prescribed by the relevant law.

    Do you think there is a way for "Crime and Punishment"? Or you do not believe in reformation of a sinner?

    Walmiki says he doesn't remember anything but he also asks 'how is it a rape'.

    He is either feigning to have forgotten everything or thinking himself a saint since he has served the sentence imposed by the court. Meaning, one can kill and serve sentence and pretend as if nothing happened.

    We must first set certain things straight like who (and why) decided to charge him with assault and theft only, not rape, if this compromise is reasonable considering the degree of damage caused to the victim.

    Nevertheless, with no victim nor her relatives available to file a case at present, its a waste of public money. Aruna should be left to rest in eternal peace than disturbing her soul all over again.

    You are selfish. You are connecting Modi to a case to which he was no way connected but just to satisfy yourself by demonizing him.
    Modi did very good job by banning BBC report which would give voice to brutal Rapist and not for any self-pride. Do you have any idea of what rapist said in the interview ? But explaining this to you is waste of time!!!
