No intention to run Delhi govt: Rajnath


New Delhi, May 29 (PTI): In the midst of the ongoing stand-off between the Delhi Lt Governor and the AAP government, the Centre today said it has no intention to run the city government through anyone but is conscious of its Constitutional responsibility and committed to uphold it.

"We have no intentions to run the Delhi government through anyone. Let them run the government. We just want to uphold the Constitutional provisions," Home Minister Rajnath Singh said at a press conference here.

He was replying to a question on whether the Centre wants to run the Delhi government through the Lieutenant Governor as it has given him absolute powers in several matters, including transfer and postings of senior bureaucrats, by issuing a notification, which was challenged in the court by the Arvind Kejriwal government.

"We are not against anyone but it is our responsibility to uphold constitutional provisions. Everyone should remain within the framework of the Constitution," he said without naming anyone.

Asked to comment on Delhi Assembly's resolution holding as "illegal" the Centre's May 21 notification giving more powers to the LG and Kejriwal's statement that the Narendra Modi-led government is trying to push the country towards "dictatorship", the Home Minister said he would not like to say anything on this but added that the government was committed to uphold the Constitution.

Singh further said that if any law and order situation arises in the national capital, the central government is obliged to intervene.

"I don't want to say who is doing what but we are committed to uphold the Constitution. Law and order is also my duty...we will see," he said.

When asked if a jung (war) is going on between the Centre and the Delhi government, Singh said in a lighter vein, "There is no jung, only Najeeb Jung."

The Home Minister's comments came on a day when the Supreme Court sought Delhi government's response in three weeks on Centre's plea seeking stay on the High Court judgment which termed as suspect the notification clipping powers of the AAP dispensation.
In its May 21 notification, the Centre had restrained the Delhi government's anti-corruption branch (ACB) from acting against its officers in criminal offences and holding that the LG can act in his discretion.

The apex court also issued notice and sought response within six weeks from the Delhi government on the appeal filed by the Centre against the High Court's judgment.

The Supreme Court said the High Court would hear the fresh petition filed by the Delhi government challenging the May 21 notification of the Centre independently and without being influenced by the observations made by the single judge in his verdict.

As per the notification, the Lieutenant Governor (LG) will have jurisdiction over matters connected with services, public order, police and land and he may consult with the Chief Minister whenever he thinks necessary on issues of services using his own discretion.

The Supreme Court today sought Delhi government's response in three weeks on Centre's plea seeking stay on the High Court judgement which termed as suspect the notification clipping powers of the AAP dispensation.

In its May 21 notification, Centre had restrained the Delhi government's anti-corruption branch (ACB) from acting against its officers in criminal offences and holding that the LG cannot act in his discretion.

Clarifying that there is no stay on observations made by the Delhi High Court single judge in the May 25 judgement, a vacation bench comprising Justices A K Sikri and U U Lalit said, "we are not inclined to go into the issue of stay at this stage and after getting the reply, we will look into it".

The bench also issued notice and sought response within six weeks from the Delhi government on the appeal filed by the Centre against the High Court's judgement. The bench also said the High Court would hear the fresh petition filed by the Delhi government challenging the May 21 notification of the Centre independently and without being influenced by the observations made by the single judge in his verdict.

As per the notification, the Lieutenant Governor (LG) will have jurisdiction over matters connected with services, public order, police and land and he may consult with the Chief Minister whenever he thinks necessary on issues of services using his own discretion.

At the outset, the bench said that it is upto the Delhi government to decide whether they want to pursue the matter in the Supreme Court or the High Court as the issues are related to Centre's notification. The bench also suggested that the matters from High Court be transferred to the apex court. "Let it be decided for once and all by the final court," the bench said.

    In 1 year's BJP rule at Centre the whole truth is coming out of Namo incapability to run centre. In fact there has been no development in Gujarat other than Adani and the MLAs and it has been media hyped. People were fed up of UPA and gave an opportunity to NDA and BJP but they have bungled the working of the govt. The BJPs humiliating defeat in Delhi has not gone down well and they are unable to digest the defeat even till today and i.e., why they are trying to control the govt through back doors. People of Delhi will teach BJP a lesson and this 2015 they got 3 seats and next they will not get a single Lok Sabha and Assembly seats too. AAP is waiting for MCD 2017 election and mark my words BJP will have no chance but to run away from MCD governance. Since Feb., 2015 Delhi has seen lots and lots development which was not seen in BJPs 5 yr rule, Congress 15 years rule and BJPs 7 year rule in MCD. They are unable to digest this development. Also the crack down on corruption has it BJP and Congress very much and all their goons or thieves have ran away seeking shelter. So AAP doesn't have to worry as God and People of Delhi are with them.

    whats thee issue here? I think you have not read news properly!... Issue went up to president's door and he referred back to state central govt position and MHA came with the gazaette notfication about the doubts in delhi govt mind!.. now issue went to Supreme court after the HC verdict.. SC has upheld the same and it will independtly come up with a verdict without bias on HC single bench verdict.. it is good for democracy no? things will be clear as to who has to look after these aspects LG or delhi CM!

    we have seen many maverick governors, PC Alexander, Hamsaraj bharadwaj, Romesh Bhandari - but our constituion is supreme!.. these people may come and go.. governor position is sacred!... if Najeeb jung is pushing trhough his agenda - then let us sack him.. may be Kiran bedi can come in his place!.. its purely political appointment and finally every state has to stick to protocols!
