MHA notification: HC adjourns PIL till Aug 5


New Delhi, May 29 (IANS): The Delhi High Court on Friday posted for August 5 a PIL challenging the union home ministry's May 21 notification saying the lieutenant governor has discretionary powers to appoint and transfer key bureaucrats in the capital.

A division bench of Justice B.D. Ahmed and Justice Sanjeev Sachdeva noted that the Delhi government has already moved the court with similar plea that will be heard later later in the day by Justice Rajiv Shakdher and adjourned the PIL of a law student.

"When both the affected parties (centre and Delhi government) are fighting vehemently, who are you ? Why should your plea be heard now," the bench asked Vibhor Anand, the student who had filed the PIL.

The bench also commented: "When two constitutional authorities are fighting with each other and they feel that they have the right, let them fight. They are entitled to fight. Now they are doing it the right way by going to court, and seeking legal opinion."

During the hearing, the bench also enquired about the status of an appeal by the centre in the Supreme Court against a high court order terming as "suspect" the May 21 notification.
