Madras HC fines school teacher Rs 50,000 for pinching student’s cheek


Chennai, Oct 31 (Express News) : The Madras high court has imposed a fine of Rs 50,000 for pinching her student’s cheek as a punishment. The order was issued by the first bench of HC comprising Chief Justice Sanjay Kishan Kaul and Justice M Sathyanarayanan.

In 2012, Rama Gowri, a teacher at Kesari higher secondary school in Mylapore, pinched the cheek of a class VII boy for not doing his homework and he sustained minor injuries.

After Meharunnisa, the boy’s mother, took the matter to the State Human Rights Commission, there were several proceedings besides a criminal case filed against the teacher.

During the hearing before NHRC, the teacher reportedly claimed that she had only twisted the boy’s ears. Her argument was that the boy’s cheek was injured when he tried to move away while she was holding his ear.

In May 2013, the commission imposed a fine of Rs 1,000 on the Mylapore school for violation of human rights. But the boy’s mother decided to appeal the Madras HC, complaining of the school management for delaying the issuance of transfer certificate and demanding an increase in the quantum of compensation .

She had also filed a fresh complaint against the teacher before a magistrate court in the city.

Meanwhile, calling all these multiple proceedings a harassment, the teacher moved HC seeking help. However, on Thursday, HC ordered the teacher to pay a compensation/fine of Rs 50,000 and approach the judicial magistrate court, Saidapet where the case was pending against her.

    The day is not far away when kids fight, bully,rag,beat and punch in the school.teachers are horrified.My friends 8 years old kid threatened her teacher with dire consequences because teacher asked for delay in homework.I met the teacher and principal and could not bear to see the tears in the eyes of teacher. I blame my friend who uses influence and her kids are copying it.Now she is afraid and want to change her behaviour, which turning her own kids into monsters of the future.
    My advice to to parents, please correct your self first and then your children will follow your path ! Do not blame the poor teachers and school.Open your eyes now

    As a teacher with an experience of over 20 years, I deeply feel for the students of today and the citizens of tomorrow's India. Today the concept "education" is limited to the study of text books and exams. Imparting values, morals and socially accepted manners has taken a back seat. Can a pet animal be trained without punishing it? To some extent, small children are like pet animals. They cannot reason out matters. At times a little bit of physical pain does help. I am not supporting those who are ruthlessly beat the children. Today, in our nucleus families, children call the shots. They are not punished there. The parents want the school to do that job. But the media, the courts and the so called children's right activists blow small incidents out of proportion and shame the teachers. Teachers are projected as monsters. Once I heard a V std students in a government school in Uttara Kannada saying " I will beat you with my chappal" to the HM when she corrected him. the HM kept quiet. He tried to say the same thing to me as I was the DEd Principal and had gone to observe lessons of my student teachers. I immediately gave him on his face. From that day He behaved himself and never disturbed the classes of practice teaching. If parents shift their responsibility on the school and the soceity ties the hands of teachers what will be our future? No wonder today, women cannot walk freely on the streets. This may be the foretaste of what is going to come. It is better to buy a PC, load it with all sorts of programmes related to school lessons and keep the children at home and prepare them of their final exams.

    Why nowadays both male and female teachers are engaged with crimes, they are turning into criminals. Rapes, molestation, physical assault etc. Why they are allowed to beat the children?

    Last year, same thing happened with my Son , for not doing his homework. Now he is doing his homework without fail. We never went to school and asked about this incidence. As parents we should know what is right and wrong. Teacher is doing for the benefit of children. During our childhood, teachers used to beat us never our parents interfered, instead they used to say " nanala raddu paadle". As Mr. Bhadarkar said, I too miss my teachers. Whatever I am today, that's only because of my parents and GURUs.

    I was thrilled when i read the head line. Later i realized its a lady teacher pinched the cheek of 7th STD boy & got injured. Oh! its not a molestation issue.
    But still, this is a good precedence in future. There will be a fear in future, no ill handling the students.

    My school teacher ,going by the same yardstick, some decades back, would have had to shell in Crores!!
    This NHRC was not there those days I believe!
    My Poor teacher's salary too was very very negligible then! how I remember them even today...My dear Gurus...
