Rajya Sabha approves bill to make divorce women-friendly


New Delhi, Aug 27 (Agencies): The Rajya Sabha today passed amendments to the divorce law but not before several male members dubbed them anti-men and an assault on “human rights”.

The Marriage Laws (Amendment) Bill, passed by the Lok Sabha in the last session, promises women a larger share of their husband’s property during divorce.

Trinamul Congress member Derek O’Brien led the charge, asking: “Why empower women at the expense of men?”

He argued the bill should be made gender-neutral, giving men the same rights as women. Replace the words “wife” and “husband” in the bill with “spouse”, O’Brien said.

Samajwadi Party member Arvind Kumar Singh claimed the bill could be misused like the anti-dowry law.

“If you read this bill, it seems that husbands alone are responsible for divorce. This law is being made to enslave men. One party should not get disproportionately high benefits while the other stands to lose all,” Singh said.

While many women MPs protested against this logic, Vandana Chavan of the Nationalist Congress Party stood on the men’s side.

“There are many women who may be earning the same as their husbands or sometimes even more. We have to fight not just for women’s rights but for human rights. Why make the current generation of men suffer?” Chavan said.

Many members wanted know how unemployed husbands fared in the bill.

“If the husband has no property, does he have a right over the (wife’s) property in case of a divorce?” asked Bahujan Samaj Party member Narender Kumar Kashyap.

Bharat Kumar Raut of the Shiv Sena said the bill would bring family pressure on women not to get a divorce. “Families will think that despite couples having differences, it would be better to stay together to avoid a division of the property,” Raut said.

DMK member Kanimozhi defended the bill stoutly.

“That women will misuse the bill and use it (to seek) revenge against their husbands and mothers-in-law seems to be the dominant thought here. When we have 50 per cent women in this House, we will talk about making such bills gender-neutral,” she said.

BJP members, however, ignored the issue as they pressed their long-standing demand for a uniform civil code. Party member Najma Heputallah accused the government of ignoring the plight of the country’s Muslim women.

Law minister Kapil Sibal said the bill was obviously pro-women and would send a clear message that Parliament was on the women’s side.

“Women’s rights have to be protected. We are in a patriarchal society. Around the world, while women constitute 50 per cent of the population, they own only 2 per cent of global assets,” Sibal said.

Addressing members’ concern about unemployed husbands, Sibal said men were entitled to alimony “under Section 25 of the Hindu Marriage Act”. The bill was cleared as presented by the government.

The Rajya Sabha later discussed the Mumbai gang rape, with junior home minister R.P.N. Singh making a statement.

    This bill affects Hindu marriages and Special marriage only and does not apply to Christian and Muslim marriages. In order to protect ones family property a rich man has only to convert to Christianity or become a Muslim. I guess this is what some people in power want.
    What are the so called champions of hindu way of life doing? It’s time that every hindu in parliament woke up and stopped this nonsense.

    We live in 21st century in an advanced modern world, Our living style keeps changing. We have Smart phones n gadget, Automatic cars, Kitchen equipment's, many touch screen enabled devices to use in our day to day lives. With GPS, Phones, security cameras & comfortable transport has made travelling around the world much safer and secure. So it is oblivious that present day women has got more power and safety to their side, so present day women love to travel and work in offices which is more profitable and enjoyable than being at home.
    With all these technology at their finger tips, I still don't find these Women as Bold, Forward, Modern and hardworking as shown by Media when I compare them to those who had lived in older generation (19th, 18th … Centuries). Older generation Men used to go away for work and Women do all work in and around the house. They were not aware of what was goes around the world, so had to put up with all commands, but they were hardworking and Bold.
    Today’s women have lot of high education degrees (some even with fake) which should not be a difficult thing to get with so many institutions around. Some do just to get a good marriage proposal or to show that they are well qualified women. But I have seen many girls who are engineers, doctors, dentist once they are married, they sit at home and never work, not even do any Social and charity work or help society with knowledge they have. I feel all education provided to these girls is a total waste. Waste of resource of Govt\public, seat in college, time, money, energy. Idle mind & body leads to devils activities.
    Now in present world there are many Laws which are in favour of women, which can be misused to trap and put innocent men in trouble. We live in a Advanced world and not in a world where we live with swords and muscle power. So I feel that the law should be Gender Neutral, if not then there should be strict law against anyone who misuse or make a joke of Indian Judiciary system.

    I know a couple, where the girl got married to have fun when the husband goes sailing for months (merchant navy). When he came to know about it, there was a huge fight and led to divorce filing. She demands property money inherited from his ancestors. If this bill is passed, I doubt the guy who is the victim here will have any justice. This bill has so many loop holes.

    You are lucky that your wife is with you in Dubai. Some of our Indians left their wife/family in India and given them all the comports i.e. Vehicle, Gold, House and luxurious life and these people in Dubai staying in Company’s bunk bed/or bachelors accommodation . When they retire and go back if wife gives divorce than this instead of sleeping on bed this man has to sleep in floor and wife will sleep on bed.

    The Institution of marriage not created for Divorce . Marriage is the essence of family where children grow up and become individuals under the guidence of their parents. If divorce and separation is the only motto and materialistic things hold supreme importence then my dear youngsters dont spend lavishly on marriages, let the priests not bless you, no need of any emotions, just have court marriage or opt of live in anyhow one of u will apply for divorce and fight for rights. where we have reached? where are our ideals lost? common ssense is lost? There was a time when one of my relative celebrated 75 years of his marriage. Time has come where people cannot distinguish between what is right and wrong. All the best to those who divorce and to those lawyers who support these people.

    P1. 50% of property which was acquired after marriage - the man and woman are union of 1, so when it becomes two, the acquired property gets divided by 2. I am sure, the womans salary and man's salary - combined becomes acquired property, she can't stack away hers separately. So the law is fair. I hope the man is helping the woman in household work and rearing children.

    P2:Alimony to decide the inherited/inheritable property: A sure motivator to donate inheritated wealth, some social goodness here.

    P3: A woman can not conduct life alone (manipal, delhi, mumbai, bangalore rape cases), so she really needs a man by the side, so she can oppose! This point is fair considering the present environment, clear the problems faced by women, automatically P3 will clear itself.

    P4: It is gender neutral.

    So where is the problem?

    getting serious: The inherited property part should be revalidated. I think the children should have the right more than the wife.

    If any woman uses marriage for financial gains, then the whole society should outcast her - starting with her own family. I can understand how nervous the men are. If there is a movement to make this fair for men, I surely will join.

    First of all this bill is gender biased and only favouring the women in the country.
    Now women can use this law as their business.
    This bill should be unbiased to any gender and both the parties shoudl have equal benifits.
    50% share in the property acquired after marriage is fare and fine. But why the inherited / inheritable property of husband should be considered during divorce.? On what basis women claim the 50% share on the inherited / inheritable property of husband.?

    Looks like UPA Govt is in hurry to pass all these bills without thinking all the pro and cons.!

    I know a very gentle and honest person, his wife is kinda society lady of these days, he does all the work at home and this lady doesnot even allow his mother and sisters to come to their house... when he went for divorce this lady went to a police station and gave a case of harassment against this man... police is after this man, he cant help and now he is absconding ..... men in this country doesnot need justice? rape against women is condemable think and do laws to prevent them such laws will only increase discrimination
