All 5 Mumbai gang-rape accused to be tried in fast-track court


MUMBAI, Aug 25 (PTI) : All the five accused in the gang rape of a photojournalist in a secluded area of a defunct mill here have been arrested by police with the remaining two suspects on the run being held on Sunday three days after the crime which will be tried in a fast-track court.

The Maharashtra government announced appointment of noted lawyer Ujjwal Nikam as the special public prosecutor in the case that has triggered outrage across the country even as Mumbai police intensified the hunt to trace the mobile phone used to shoot pictures of the brutal attack.

Mohammed Kasim Hafiz Shaikh alias Kasim Bengali (21), a resident of Agripada in central Mumbai and one of the accused, was arrested at 4.15am on Sunday from Mumbai Central while his accomplice Siraj Rehman Khan (24) was arrested last night. Both were remanded in police custody till August 30.

Another accused Salim Ansari (27) was arrested from Delhi by Mumbai crime branch sleuths on Sunday. He was arrested from Bharat Nagar in northwest Delhi, when he was on his way to a relative's house in the capital. He was taken to a hospital for medical test and later to Mumbai where he would be produced before a court on Monday, police said.

"A team of Mumbai Crime Branch today (Sunday) reached Bharat Nagar police station and enquired about a locality about which they had inputs that Ansari will be visiting. He was then nabbed when he was on his way to a relative's house here," said a senior Delhi Police official.

Two others involved in the case, Vijay Jadhav and Chand Babu Sattar Shaikh, were arrested earlier. They were on Saturday produced before the court which remanded them in police custody till August 30.

All the five accused have been booked under various sections of IPC such as 376(D) (rape), 342 (wrongful confinement), 506(2) (criminal intimidation) and 34 (common intention).

Chief minister Prithviraj Chavan said in Pune this evening that that the gang-rape case would be tried in a fast track court to ensure speedy justice to the victim. Chavan also said he had asked Nikam to appear as public prosecutor in the case.

Nikam confirmed the development saying that Chavan and home minister RR Patil had called him up to inform about his appointment as the prosecutor. "I have given my consent," he told PTI.

The 23-year-old survivor, working as an intern with an English magazine, was gang-raped in the premises of the defunct Shakti Mills compound where she had gone along with a male colleague on an assignment to shoot pictures on August 22.

Jaslok Hospital's acting CEO Dr Tarang Gianchandani, meanwhile, in a statement, said, "The victim's condition is steadily improving from all aspects. She is eating normally and her medical parameters are in control. Team of experts specially assigned to this patient is continuously monitoring her."

The accused had tied up the woman's colleague at a little distance away from the scene of crime and gang-raped her after threatening her with a piece of broken beer bottle, which they placed near her neck. They also shot pictures of the shameful act from a mobile phone and warned her against telling anyone or else they would circulate the pictures.

Seeking custody of the accused, police on Sunday told the court that they were trying to find out from the suspects where they had kept the mobile phone.

Police informed the court that the accused were not cooperating with the probe and were not disclosing where they had kept the mobile phone. However, police had picked up the broken piece of bottle from the place and said that it was a vital piece of evidence.

Meanwhile, in another statement, the survivor's mother said, "My daughter and I are overwhelmed with the support given to us by police, media and public at large. We hope and pray for your continued support and campaign in the fight for justice for my daughter and women at large in India."

"Now that stringent laws are in place, we are optimistic that your and the government's efforts will help on putting the matter on the fast track so that the severest of punishment is meted out. This will ensure that even the most sick-minded think twice before they act in such an inhuman and insensitive way".

"I have one small request to all of you. Please continue to respect the privacy of my daughter and me," the statement said.

The victim had said in a message to the people on Saturday, "Rape is not the end of life. I want strictest punishment for all the accused and want to join duty as early as possible".

Kasim Bengali and Siraj Khan were produced on Sunday before a magistrate, who inquired whether they had any complaints against police and whether they had hired any lawyers to defend them. Both of them replied in the negative.

Kasim and Siraj were produced with their faces covered with a black cloth. Police told the court that identification parade had not been held so far.

In the remand application, police said Kasim, who was arrested on Sunday, had admitted to his alleged role in the crime.

    Now Police have disclosed that Three out of five accused are Serial offenders and they were involved in many crimes earlier and their names already existed in Police records since long, and they are habitual offenders but they were not caught and punished by Police earlier. Here Police are also at fault. Mumbai's underworld Dons namely Chota Rajan & Dawood Ibrahim also started their criminal life similarly while living in the slums of Central Mumbai around old Textile Mills. But since they were not caught and punished they could grow to international level.
    It means - Today's petty Mumbai Criminals are Tomorrow's International Mafia Dons.
    Such Graduation of Criminals can happen only due to negligence of Police.

    Friends, with the Lawlessness increasing day by day, I believe you're wondering why such crimes even after systematic education , laws,& punishment. Some say there w no rigorous laws and punishment and give ample of other good reasons. But I challenge them however stringent action will not put an end to the crime. So whether you believe or not know truth-these r only secondary reasons but primary reason is : the EVIL SPIRIT of LUST using people who don't have the power of God . This is very much evident if you analyse the time , manner of the crime and age and comments from the accused . The EVIL SPIRIT NEEDS PASSION AND BLOOD I.e life.This is a spiritual fact.

    This is closely related to the last book in the Bible:the Revelations. It is also fulfilling the prophesy by a man of God for the 2013 saying, Lawlessness will greatly increase in the nation of india .He had also prophesied the world wide floods earthquakes and a part of a nation will go under waters-www.     Good and Great Job from Mumbai Police.

    (a) All five rapist allowed to sleep only one hour a day.
    (b) all five rapist should be given 25 lashes everyday from victim or victim family members, total 200 lashes.
    (c) all states in india must make separate and big single jail for rapist and acid attackers. it is easy for book / track the rapist.
    (d)within one month judgement, no mercy and no bail.
    (e) Within one year all convicted rapist should be hanged.

    (f) All Rape victims in india must provide Police job or Govt. Job. in other state.

    How to stop Rape and Acid Attack ?
    (a) stop rape and crimes,
    public support and police action is required.

    (b) Need separate police dept. for rape and acid attack, that dept must act only for rape and acid attacker. then police will get time for proper time for investigate and to take timely action.
    (c) need more police force and police station. proper training.
    (d) no political interference.
    (e) finally india need strong law and proper punishment for rape and acid attack.
    (e) all police station india must connect net work, many police station don't have computer and internet. when ever police want information about criminals, police are searching for big log book.

    same information should entered in the computer, so police can easily find rapist and criminals without wasting time. and it will help to our india's investigation team like CBI, and IB.

    but Only S.C. can bring changes in the law. because political parties family not worried about rape and criminal, because they protected with black commando's and police.

    Also add the following :

    Any person below 18 years of age who commits 'rape' should not be treated as juvenile/minor no matter how young the person may be. Excuse of juvenile/minor is made just to escape the harshest punishment.

    No interference from relatives etc. should be allowed saying "my son is a juvenile/minor".

    1.Very good ideas, if seriously applied.
    2. All rapist be hanged once in a year in one place, simultaneously.
    All victims also be invited, rapist family and relatives also be informed. Its going to be an excellent festival, maa kasam.

    The fifth accused had plans to flee to Bangladesh from Delhi, which proves that he has links with Bangladesh. Now a days the ISI of Pakistan is using Bangladeshis for espionage in India instead of using their own Pak citizens. So, immediately it should be investigated whether any of these accused or their relatives are ISI Agents.

    The accused gang rape criminals should be hanged immediately. This will send a stringent signal all over India and put an end to rape menace. Great job by Mumbai police in arresting the culprits very swiftly and kudos for their lightening action. Wise decision by Maharashtra government and thanks to CM. Lawyer Ujjwal Nikam will be the man of the moment and I am sure he will handle the case skillfully and squeeze the necks of these five barbaric criminals. Jai Ho fast track court.
