Mumbai: Congress men shut down eatery for criticizing UPA government

Mumbai, Jul 23 (Mid-Day): Dissent is not for this UPA-led democracy. Angry, young Congress men on Monday swamped a popular restaurant in Parel, opposite KEM Hospital, because the owner had started printing ‘defamatory’ material against the United Progressive Alliance (UPA) central government on food bills.

Around 30 to 35 workers of the Indian Youth Congress -- which is chaired by party vice-president Rahul Gandhi -- approached the restaurant, Aditi Pure Veg owned by Srinivas Shetty, a Mangalorean. Led by Ganesh Kumar Yadav, city president of the party’s youth wing, and party MLA Kalidas Kolambkar, they approached the hotel and asked the owner to shut shop.

The marching orders for the swoop down came from the party headquarters in Delhi, said Congress workers, and after receiving them, they clamped down on the restaurant and later approached the Bhoiwada police against the businessman for defamation.


The wisecrack-down

“Some of the Congress workers who had come to KEM Hospital had food at Aditi. They saw the hotel owner had printed defamatory material against the ruling alliance and wrote to the Congress party leaders in Delhi, who then diverted the matter to us,” said Pratik A Nakate, president, Wadala assembly of Mumbai Pradesh Youth Congress.

“So our Youth Congress workers approached the restaurant and demanded its closure and asked for an apology. We have informed the Bhoiwada police about it,” said Omshree Kadam, secretary of south-central district Congress committee.

The food bills that patrons of the eatery located on Dr E Borges Road in Parel received came printed with a witticism the owner had come up with:

‘As per UPA government, eating money (2G, Coal, CWG scam) is a necessity and eating food in an AC restaurant is a luxury,’ read the bill receipts on their underside.

The Congress workers, who failed to see the wit when first served the bill, of course, had the last laugh, when cops slapped the proprietor, Srinivas Shetty, with an NC. The central government introduced service tax on eating at air-conditioned restaurants in recent years, aggravating restaurateurs and customers, who ultimately end up footing the extra cost.

Said an officer from Bhoiwada police station, “We have registered a non-cognisable complaint (NC) against the restaurant for printing matter known to be defamatory (Section 501 of IPC) and have settled the matter for now. The restaurant owner has promised that he will not circulate those bills now.”

Youth Congress leaders expressed surprise that despite all the work they put in for the greater good of the people, some failed to notice it. “We are doing such good work in our areas as part of the Youth Congress and such comments de-motivate people from joining the party.

The owner might have his issues but he should fight them in a legal way rather than defaming the party for some people’s corruption,” said Sandeep Pansade, general secretary, south-central region of Youth Congress.

 

I wanted to do it and I did, says restaurant owner

If it is political browbeating, every action has an unequal, over-the-board reaction. The owner of Aditi restaurant, Srinivas Shetty has learned the vital life lesson.

And in these trying times, while his fraternity -- Association for Hotels And Restaurants (AHAR), the umbrella body of restaurateurs — has left him to fend for his own, Shetty feels the issue did not warrant the seething protest mounted by Congress workers. “I have my opinion and India being an independent country, I have the right to express my views.

Because of the government including all AC eateries in its purview for paying service tax, I suffered losses and I had to shut down the AC section of my restaurant altogether,” Shetty says.

He continued, “It’s been 15 days since I got this thing printed on the bills, and many customers came and congratulated me over this. Since I had received praise for the act, I did not think something like this would come up. In fact, I had thought of this idea when the law enforcing service tax at all AC restaurants came out. I had wanted to do it since a long time and I did it.”

Shetty pauses to ask a question that the public and clientele have been openly asking. “Where a tea costs a mere Rs 12 why would someone pay 5% service tax? This is not fair on the part of the government, and I chose this way to show my grievance specially since the government did not even hear our association when we went to discuss the matter with them.”

One of the AHAR members, on request of anonymity, said, “It was a private matter between two parties and until we don’t get a complaint we will not interfere.”

    6 months back, along with my family I had visited Hampankatta Taj Mahal for morning tea. Their AC room was operating without Air Condition because then the MCC was charging them additional AC room taxes and it became too expensive for this Hotel to bear this cost.

    What they have done is just disconnected AC. I liked the owners approach. But they were conveying strong message to the then MCC.
    What happened, earlier MCC majority of the Corporators lost elections and new MCC team elected.

    Always wise brain works better than strength.

    In Mumbai, already the price of food is much higher than Mangalore, & the net sufferer of Service Tax is common customer, besides hotelier.

    If Srinivas Shetty had so much problem with congress rule - he should either begin a newspaper.

    What if I had been to his restaurant and after eating claim his food is rubbish?

    The obvious answer from Srinivas Shettre would be 'Eat in some other hotel, why come here'...similarly if he had a problem with congress ruled state - then he should relocate to some non-congress ruled state.

    The rules are same for everyone. Taxes are collected same for everyone. There are lakhs of hoteliers in Mumbai..why only this Shettr had a problem? Is he the only one who is having A/C in his restaurant?

    There are lakhs of hoteliers who lost business when dance bars closed..but it was for the good. Everyone followed the orders.

    In Bangalore Kallanagi juice is sold at Rs.50 a glass,limbu soda Rs.40 a glass,on Bangalore Hassan highway a hotel charges one wade with curd charges Rs.50,simple good tea Rs.30,normal lunch Rs.150.Another coffee shop shop sells coffee at Rs.150

    I cant believe so many people appreciating Mr.Shetty's bill-mania.

    Everyone in India pay tax. Hotel owner Mr.Shetty alone is not charged of tax to a/c dining. Irrespective of congress, BJP, CMI-M, ... and irrespective of Shetty, Khan, Singh,Modi,Fernades, ... or whoever it is, the tax structure is same n applicable to all. Ideal protest would have been through hotel union. Hotels n restaurants have their union to raise their concerns. What Mr.Shetty did is utter wrong. He may have a valid opinion, but the method he adopted is wrong. If Mr.Shetty does today to print something in a food bill, tomorrow we will have many more people printing all unwanted stuff ending up hurting sentiments of people.

    Gabbu Bhai, as India progress from developing nation towards developed nation, many things change. Today, petrol is no longer a rich mans fuel - it is a common man's fuel. Rich men have shifted to diesel SUVs. Do you know the cost of 1 ltr petrol is not more than 45 ( /-2) rupees including transportation to petrol bunks, and the rest 33 Rs is tax. The thought process of this tax structure was that only rich people use petrol. But, even today the tax is collected from people across the economic spectrum. Similarly, there are CEOs as well as housekeeping staff working in AC offices. Assumptions that only rich go to AC restaurants is false. Have you been to Chennai or Mumbai during summer? And, if a restaurant guy decides to speak his mind, what is so controversial. There have been cases where the facebook commentators have been let off by courts on the grounds of freedom of speech and I think this will also follow suit. Now, as far as BJP or ShivSena handling this matter in a similar way, well ....the point was that these congress folks are no different.

    Hotel owner should have avoided UPA government, instead if he had chose, only Government, may not have landed him this problem.

    Being a business person he has to think about the survival of his business. He incurred a huge loss bcz of the Govt decision to impose 5% service Tax on AC eateries. The government did not even hear the Hotel association, when they went to discuss the matter with Govt.

    At least they did not ransack and vandalise. When Govt imposes service tax on A/C rooms in hotels, the owners are aggrieved. But why? Weren't they taking additional charges from customers for using A/c rooms? Whether it is restaurants, saloons or any other place, when the customers avail A/c rooms services, they are billed more than the usual. This practice is in vogue even before service tax of 5% came into existence for these services. Shop owners, bakeries charge extra for serving cool drinks citing that they need to shell out electricity and refrigerator expences even when these companies provide the shop owners with refs. Even when customers questioned, quite a few of them are abused and roughed up. Trading community often wants all the freebies from the govt for their business but do not pass on even a single pie of these benefits to the customers. As Gabriel said those who wish to use the A/c rooms know that govt is levying tax on that and they are ready to shell out this price. Then what's the problem Shetre? People have noticed that dosas, idlies you serve have reduced their weight and size as if they are on strict diet, tea cups too have been trimmed and rice bowls have become shallow over the years but price has kept on skyrocketing. Yet you want freebies from govt and continue to loot customers?

    Well done Congress. You have not shown intolerance like the one associated with BJP and particularly Shive Sena. It was right to report to the police authorities.     Grt work by the Shetty owner. Proud of him. Has the guts to actually raise his voice. There is nothing wrong in it. The congress workers have never paid their bills so they don't knw.Wht suffers is the general public. With the temperature soaring ac restaurant cannot be termed as luxury. If so all govt offices should not have ac. The govt has not paid any heed to any public grievance. the workers instead should have taken this up with their HO and helped the hoteliers voice heard. Egos bigger than the good work. There is no hope in India with so many parties and no vision where we want to head. Iam sure by oct dollar will be Rs 70 and we will be sending gold as sucurityto world bank falling into the debt trap agan as the middle class with home loans in india.

    Vijay, Mangalore ... May I remind you that none of the past government's whilst in power have ever paid their bills .. this is a feat in itself. You don't need to shout it loud. It is but obvious and sheer common sense. Remember, unlike the goonda raj Shiv Sena and other communal parties, Srinivas Shetty is lucky to have got away with his actions very lightly .. otherwise he would have had to heal his wounds behind the bars if subjected to third degree treatment for his own actions. What is still worse is they would force all your Mangalorean people / businessmen to pack up and leave Bombay immediately and putting more strain on your Mangalorean state. Here in this case he is lucky .. he has NOT BEEN touched and deported outside Bombay ... he is still expected to behave himself lest any trouble befalls him.

    A bill or invoice is an official documents which provides proof of sale for different government departments such as sales tax, income tax etc. It is an official document of government offices irrespective of which party is ruling the country or state. Respective department should take strict actions on printing any other matter other than the matters to be printed on an invoice. A case can be registered in a court and huge penalty can be imposed. Any personal opinion should be expressed through a different media and can be distributed to whomever willing to accept it.
