Goa consumer panel orders EV firm to refund buyer over defective e-bike

Panaji, Feb 21: The North Goa District Consumer Redressal Commission has directed Hyderabad-based PUR Energy Ltd to refund Rs 98,692 to Moira resident Sheshan Rawool for supplying a defective electric two-wheeler. The commission also ordered the company to pay Rs 25,000 as compensation for deficiency in service.

The commission, presided over by president Bela Naik and member Auroliano de Oliveria, observed that asking the consumer to pay Rs 11,068 for battery-related issues despite the product being under warranty amounted to deficiency in service and caused mental and financial stress.

“A consumer cannot be expected to have equipment to test a battery. Only the EV company responsible for servicing has machinery for conducting such a test,” the commission noted in its order.

According to the complaint, Rawool booked the e-bike on February 24, 2022, and later purchased it on March 3, 2022, after availing a loan of Rs 82,000. In November 2022, he reported a sharp drop in mileage to 50 km per full charge, contrary to what was promised at the time of purchase. The company initially claimed the issue had been resolved.

In January 2023, the vehicle reportedly stopped functioning despite being fully charged. Rawool approached the dealership and was assured that a battery management system would be installed. However, the replacement battery fitted was allegedly defective.

Rawool also claimed that despite repeated requests, the company failed to provide a warranty card. In June 2023, he was informed that the battery had been repaired but was asked to pay Rs 11,068, even though it was under warranty. He later issued a legal notice to the company on September 25, 2024.

The EV firm contended that Rawool had not availed mandatory services and stated that the battery was replaced free of cost as a goodwill gesture. It further argued that improper maintenance by the consumer led to the issues and sought dismissal of the complaint.

Rejecting the company’s contentions, the commission ruled in favour of Rawool and directed PUR Energy Ltd to refund the amount paid along with compensation.
