Soujanya rape & murder case: CBI files appeal against acquittal of accused


Bengaluru, Nov 8 (IANS): In a major development, the CBI on Wednesday filed an appeal before the Karnataka High Court challenging the acquittal of the accused in the sensational rape and murder case of Soujanya, a 17-year-old girl in Pangala near Dharmasthala in 2012.

The CBI Special Court had on July 16 acquitted the accused Santhosh Rao and rapped the investigation officer and prosecution for framing him in the case. The court had also suggested initiation of action against police officers and others for botching up the probe.

The CBI’s appeal was filed four months after the verdict. The lower court had given 60 days to the CBI to file an appeal on the judgment.

Experts said that it remains to be seen whether the appeal would be accepted by the High Court.

Sources stated that the CBI had claimed that Santhosh Rao, who was acquitted in the case, is the real culprit and it would submit required evidence in this regard to prove the charges against him.

Massive rallies are being held in costal Karnataka by activists demanding reinvestigation into the case and arrest of the real culprits. The supporters of the accused are also holding massive rallies in the support of the accused and saying that it is an attack on a pilgrimage centre.

The High Court had earlier rejected the petition seeking reinvestigation into the case and stressed that the demand had to be made by the family members. However, the family members of the victim had not approached the court.

A minor girl’s rape and murder was reported on October 10, 2012 at Pangala near Dharmasthala.

Soujanya was a 17-year-old student of second PU in a private college. While she was going towards her house after class, she was allegedly kidnapped and later her dead body was recovered in a state of undress.

    CBI claiming to have required evidence to nail the so called culprit is very unfortunate. First of all what evidence was left for the CBI when it was already tampered by the state police and CID? Any evidence found, when the case was transferred to the CBI, was almost fabricated and simply made strong enough to put the scapegoat behind bars.

    The samples after rape were deliberately left to get destroyed --NOW So many holes in the investigation ---- so many inconsistencies -- post mortem -- etc --all point to the fact this was a work of very powerful persons -- behind the scenes for a massive cover up -- a poor man like Santhosh would not have such resources -- so all know actual facts--

    I just can't imagine how much the police must have tortured the innocent "accused". who I understand also has mental issues. Just to protect the real culprit, they made this man bali ka bara. It's 12 years now and how shameful that the police are still not able to trace the culprit!! Now the CBI should investigate the Investigation Officer, who can spill the beans.

    This is a ridiculous appeal after the honorable HC has mentioned earlier that the investigation was botched up due to shoddy work of the IO and forensic team and there is absolutely no evidence against the accused! On what grounds is the investigating agency claiming, after 4 months that they have all evidence against Rao? Anyone with a little bit of common sense can understand why this frivolous exercise is being done and at whose behest! It's but understood that there is absolutely no merit in this frivolous appeal and the honorable HC would dismiss it outright!!! The appellant stands a chance to be chided for this appeal! Hope truth prevails!

    Oh my gosh!! This poor man doesn't even have one coconut shell full of flesh ....Then, from which angle this ma can commit rape/scrape/murder and tortured that poor Sowjanya ? ??     Everyone knows that Santosh Rao is innocent and he has been framed by the real culprits. The judgement of the CBI court has also said the same thing has asked that the real culprits should be cought. The general public is also asking for the same. Why rhen this appeal by the CBI against Santosh Rao? Looks like India is being taken into a jungle raj by this caged bird CBI. Just nonsense.

    After such a long incarceration and lack of evidence -- various other witnesses who have come forward that the wrong person was punished --meaning SANTHOSH -- made to suffer enormously -- and his post release behavior also points to the same -- again, gross total injustice will be handed to Santhosh if taken in ---with money power it will prove anybody can be fixed ---- (our investigating agencies -- police officers are excellent -- only when powerful persons get involved their hands are tied--)-- -

    The CBI initially releases the individual, only to later file charges against him. This situation raises concerns about potential political influence on the CBI's actions. We can only hope that the true wrongdoers are apprehended and held accountable.

    As directed by the court, Why is the Victim Family not filing a petition for Re- Investigation ? Why only doing Beedhi Dombarata which will not take them anywhere or bring any Justice to the poor soul.

    SB Mangalore why family is not filing case?First of all they may be thinking their daughter will not come back after all these years.Second they may ashaming ?Or it is a torture to hear what their daughter went through.?Somehow I feel too they must file a case and clear it.They might help so to clear.It is terrific incident self to know how girl was killed.

    The victim's family has suffered enough. They have neither the means or the strength to go through all that legal process. It is upto some goodwill group to take up that case. Are you ready to bear the burden. I must confess, I don't have that courage.

    Victim family is attending and arranging beedi dombarata in each small city of dakshina Kannada district. They have all means and strength for this drama and not for legal process ? What is their real agenda ? It looks like victim family is completely misguided by some vested interests.
