New Delhi, Aug 25 (IANS): Former Indian cricket board president A.C. Muthiah Wednesday moved the Supreme Court seeking to restrain the Board of Control for Cricket in India (BCCI) secretary N. Srinivasan from taking over as the cricket body's president in September.

At present Srinivasan is the president-elect of the BCCI.

The application seeking to restrain Srinivasan from taking over the reins of the BCCI was mentioned by counsel Nalini Chidambaram before the apex court bench of Justice Altamas Kabir and Justice S.S. Nijjar.

The court directed the listing of the matter before Chief Justice S.H. Kapadia following objections from BCCI counsel P.S. Raman that the case could only be mentioned before the chief justice of India.

Besides seeking to restrain Srinivasan from taking over as BCCI president, the application has sought direction to restrain him from functioning as the cricket body's secretary.

The application said that since an inquiry was pending against Srinivasan it would lead to an anomalous situation, if he assumed office as the president of BCCI. "Srinivasan will be the judge of his own cause," the application said.

"Thus, there is an obvious conflict of interest…," the application said.

The application pointed to March 24, 2010 split verdict of the court wherein Justice J.M. Panchal and Justice Gyan Sudha Misra differed whether continuation of Srinivasan as BCCI secretary created a conflict of interest.

Due to the split verdict the matter was referred to Chief Justice Kapadia for it to be placed before a larger bench.
