Daijiworld Media Network - Bantwal (MS)

Bantwal, Jul 9: In a shocking incident that has come to light from Vittal in the taluk, a minor girl got pregnant because of continuous sexual assault by five men. A case under the POCSO act is registered in the Vittal police station after the issue was unearthed.

The girl in question is a 17-year-old. She was at home after completing SSLC. It is said that a gang of five men, including a gram panchayat personnel, used to sexually assault the girl continuously since some time. As a result the girl is six months pregnant now. It is also learnt that the members of the gang had threatened the girl not to divulge the matter to anyone.

The minor girl hails from Madnoor Vitla. As per deatils available, one of her relatives, Ganesh in the pretext of taking her for a tour, took her to Subramanya where he booked a lodge for two days and raped her.

Later in the month of February, Krishnappa (38), a local, raped the girl when no one was there at her home.

The girl got in touch with a boy named Pavan through phone. When the members of her family were out at Brahmakalasotsava, Pavan forcibly had physical relation with the minor.

Later when the girl was on her way to school, a man named Punith raped the girl when no one was there at home.

An auto driver Dhanush (23), did the same with the minor girl.

During the month of March, Ganesh once again took her to Subramanya lodge and raped her.

Since January, the girl’s health started deteriorating, When the girl informed about this to Ganesh, Krishnappa, Dhanush and Pavan, they threatened her of killing her if she informs anyone.

In this regard, a case has been registered at Vitla Police station, under the section 376, 506, 34 IPC, 3(1), W (1), (11) SC ST act, POCSO Act.

We can term this as a rape just because she is below 18. Otherwise it is a clear cut group sex story with consent.

THERE IS NOTHING TO BLAME ANYONE..SEX IS A PART OF GODS CREATION AND NOTHING DIRTY IN IT IF IT IS USED IN A PROPER WAY
ITS MOTHERS DUTY TO ADvICE A GIRL FROM 13 TO 19 YEARS. THEY SHOULD EXPLAIN THEM EvERYTHING ABOUT SEX...
IT IS SAME LIKE COWS, DOGS AND ANIMALS..
WE HAD A COW WHEN ITS MATING TIME COMES ITS DIFFICULT TO CONTROL HER. AND WHEN SHE FINDS A MALE PARTNER SHE CALMS DOWN. THIS IS A PART OF GODS CREATION AND NOTHING DIRTY IN IT...
IN THE SAME WAY DOGS , THEY TOO BECOME RESTLESS DURING THIS TIME...
    HEN AND COCKS ALSO...
FROGS CROAKING SOUND IS A SEX CALL THATS WHAT I READ IN SCIENCE DURING MY COLLEGE DAYS..
COOKOO BIRD ALSO CRIES TO FIND HER PARTNER..DURING MARCH APRIL
IN THE SAME WAY HUMANS ALSO DO IF THEY ARE NOT GUIDED PROPERLY.. BCOZ AFTERALL THEY ARE CHILDREN THEY WILL REALIZE ONLY AFTER THE MISTAKE..
ITS MOTHERS ROLE IS IMPORTANT IN DAUGHTERS LIFE DURING THIS AGE
BUT OUR MOTHERS ARE BUSY IN THEIR OWN WORLD...

John mangalore kuwait,I agree to your comments regarding the animals. But here it is a girl of 17years ,not a animal ,can understand what is good and bad ,can think, when something abnormal or case of rape ,that too many times by many people, could have resisted and reported to her parents or care taker.I feel she too enjoyed it or wanted it .Only when she got pregnent it became rape? .why did she didnt complain when cousin raped her,and parents allowed her to go to a far place twice?A mother atleast should be aware of her change of body ,.strange ,I find..Now complaint.whom will they now arrest?and why when girl willingly did?Parents should be punished for not taking care of girl.

It appears that the victim did it consensually with the first accused who might have invited his gang members to join him; but the issue came to light only after she became pregnant!

BTW, how did the victims parents didn't come to know when these activities were going on for such a long time with different men?

Reading through the article it looks like clear case of consensual sex. However since the victim is minor and the accused are majors it deems fit to be a rape case as per the existing laws. All major (18+) citizens of India are expected to know whether their partner is 18+ or not before involving in any sexual intercourse with them. Else they will be in trouble for life as the anti rape laws are very stringent especially when the victim is minor

    Rahul,

In our society, why do people get married ? (1) To find a partner to have s*x (2) To have children to continue his/her family. Now, is a marriage coming for free ? No, there are some expenses, they have to be met. Secondly, does a man/woman feel ashamed when the wife gets pregnant ? No, they are proud to be parents soon.

In this girl's case, whether she enjoyed being with all these men (consensual) or not, as per law she is not old enough to have s*x ? If a man does that to her, he is at fault ? If he still did it despite knowing she is minor, should he answer the law, or not ? Now, since there are not one/two but five men, whose child could it be ? Can she tell ? No ! Therefore, let all the men submit to DNA test - they deserve it because none of them will readily agree it to be his ? The girl knows their identity. Even one of them denies, the DNA can prove it to be his ?

Therefore, don't conclude it to be consensual. She is a minor - she has the law on her side (so is the child - don't envy her for the law to be supporting her or it being bias towards men). Let the men go and drown - who cares ! Because, they have not used their brains when they should have ! They have enjoyed s*x without spending for it - without accepting (marrying) her publicly as hers. Now, let them pay in multiples !

You are misreading my comment. I have just stated facts not sided with anyone but anyway I disgaree with some parts of your comment which says marriage is essential for sexual intercourse. Consensual sex between 2 adults is not a crime whether they are married or not is immaterial.

More of consensual sex than rape . How can she go with a person twice out of station who has raped her already once . And every now and then a new person gets in touch with her and rapes her . Not possible. She is a culprit . Otherwise she should have raised the alarm after very first incident.
Once it has gone too far she thought of complaining. Girls have the same duty towards society to prevent crimes but in this case it looks very much consensual.

Irrespective of the doubts whether the intercourse was consensual, coerced or done with threat, the act is rape since the victim is a minor. Aptly, the culprits were booked under POSCO act.

    Read the report of 2013:
No idea whether it has been superseded by a higher court later on?

A court in Delhi sparked outrage this week when it handed down a controversial ruling in a sexual offense case involving a 15-year-old girl.

In a potentially precedent-setting decision, the judge ruled that consensual sex with minors in India is not punishable under the 2012 Protection of Children Against Sexual Offenses Act, which defines individuals under 18 as children.

As Dawn.com notes, the court hedged its opinion in its decision to acquit a 22-year-old man, who was accused of kidnapping and raping a 15-year-old girl. (The pair later married.)

According to the Times News Network, the judge rejected the argument that the law prohibits minors from any type of sexual relations, holding that the interpretation is too broad.

"I am afraid if that interpretation is allowed, it would mean that the human body of every individual under 18 years is the property of the state and no individual below 18 years can be allowed to have pleasures associated with one's body," additional sessions judge Dharmesh Sharma told the court......

Agreed the girl is a minor and even sex with consent amounts to rape.. But how can this be called Gang rape.. Different people at different time line has indulged in this activity.. Also Ganesh has done it twice in the same context.. How is this justified.. Are the family so stupid they allow 2 days tour with a young relative?! Something is fishy

    One is responsible for oneself...

Messages to Maria Julianna of Hungary – 17/18/28 April 2018

    17 April 2018

    ...
“Dear children! Understand that if you want to be saved, you must wait for your Lord as vigilant virgins. You cannot hide from Me. All your thoughts, words, actions have been recorded before you face Me. When Eve and Adam sinned, they hid themselves, but they did not know I had seen them. When Cain killed Abel, he also hid himself, but I saw and called him. Even those who live in sin try to hide from Me, but eventually they all come to light and give Me an account of their lives, because every person at the end of life has a separate judgment. They are not responsible for the mistakes of others, but are for their wrongdoings ― one is responsible for oneself ― and I will only judge his or her life and actions.”

“Those who take my doctrine and turn it to action will be very happy at the Great Warning, which won’t wait long for you. They will see the good things they have done and their good example of life.”

Pregnancy upto two months can be concealed but six months ? Obviously her parents knew. They may have been either subjected to life threats or paid handsomely so that the girl was made to deliver secretly and all pretend as if nothing happened.

They did not think about consequences - legal and emotional ? Very strange !

If death would stop rapes then some of the Middle Eastern countries who behead rapists should have been void of rapists; unfortunately every now and then you see someone being beheaded for rape.

Similarly for drugs the death sentence by shooting or beheading or hanging still has not managed to deter drug runners from attempting to cross borders with their stash.

It seems that greater the punishment; there is a breed of people who seemingly have the guts to do exactly what is forbidden by law.
